专利侵权判定指南 北京市高级人民法院《专利侵权判定指南》 发布时间:2013-10-09 09:10:05 打印 字号: 大 | 中 | 小 一、发明、实用新型专利权保护范围的确定 (一)确定保护范围的解释对象 1、审理侵犯发明或者实用新型专利权纠纷案件,应当首先确定专利权保护范围。发明或者实用新型专利权保护范围应当以权利要求书记载的技术特征所确定的内容为准,也包括与所记载的技术特征相等同的技术特征所确定的内容。 确定专利权保护范围时,应当对专利权人作为权利依据所主张的相关权利要求进行解释。 2、专利独立权利要求从整体上反映发明或者实用新型专利的技术 方案 气瓶 现场处置方案 .pdf气瓶 现场处置方案 .doc见习基地管理方案.doc关于群访事件的化解方案建筑工地扬尘治理专项方案下载 ,记载解决技术问题的必要技术特征,与从属权利要求相比,其保护范围最大。确定专利权保护范围时,通常应当对保护范围最大的专利独立权利要求作出解释。 3、一项专利中有两个以上的独立权利要求的,应该根据权利人提出的请求,解释其中有关独立权利要求确定的保护范围。 4、权利人主张以从属权利要求确定保护范围的,应当以该从属权利要求记载的附加技术特征及其直接或间接引用的权利要求记载的技术特征,一并确定专利权保护范围。 5、技术特征是指在权利要求所限定的技术方案中,能够相对独立地执行一定的技术功能、并能产生相对独立的技术效果的最小技术单元或者单元组合。 (二)解释原则 6、专利权有效原则。在权利人据以主张的专利权未被宣告无效之前,其权利应予保护,而不得以该专利权不符合专利法相关授权条件、应予无效为由作出裁判。 专利登记簿副本,或者专利证书和当年缴纳专利年费的收据可以作为证明专利权有效的证据。 7、折衷原则。解释权利要求时,应当以权利要求记载的技术内容为准,根据说明书及附图、现有技术、专利对现有技术所做的贡献等因素合理确定专利权保护范围;既不能将专利权保护范围拘泥于权利要求书的字面含义,也不能将专利权保护范围扩展到所属技术领域的普通技术人员在专利申请日前通过阅读说明书及附图后需要经过创造性劳动才能联想到的内容。 8、整体(全部技术特征)原则。将权利要求中记载的全部技术特征所表达的技术内容作为一个整体技术方案对待,记载在前序部分的技术特征和记载在特征部分的技术特征,对于限定保护范围具有相同作用。 (三)解释 方法 快递客服问题件处理详细方法山木方法pdf计算方法pdf华与华方法下载八字理论方法下载 9、确定专利权保护范围时,应当以国务院专利行政部门公告授权的专利文本或者已经发生法律效力的专利复审请求审查决定、无效宣告请求审查决定及相关的授权、确权行政判决所确定的权利要求为准。权利要求存在多个文本的,以最终有效的文本为准。 10、解释权利要求应当从所属技术领域的普通技术人员的角度进行。 所属技术领域的普通技术人员,亦可称为本领域的技术人员,是一种假设的“人”,他知晓申请日之前该技术领域所有的普通技术知识,能够获知该领域中所有的现有技术,并且具有运用该申请日之前常规实验手段的能力。 所属技术领域的普通技术人员,不是指具体的某一个人或某一类人,不宜用文化程度、职称、级别等具体 标准 excel标准偏差excel标准偏差函数exl标准差函数国标检验抽样标准表免费下载红头文件格式标准下载 来参照套用。当事人对所属技术领域的普通技术人员是否知晓某项普通技术知识以及运用某种常规实验手段的能力有争议的,应当举证证明。 11、对权利要求的解释,包括澄清、弥补和特定情况下的修正三种形式,即当权利要求中的技术特征所表达的技术内容不清楚时,澄清该技术特征的含义;当权利要求中的技术特征在理解上存在缺陷时,弥补该技术特征的不足;当权利要求中的技术特征之间存在矛盾等特定情况时,修正该技术特征的含义。 12、专利说明书及附图可以用以对权利要求字面所限定的技术方案的保护范围作出合理的解释,即把与权利要求书记载的技术特征等同的特征解释进专利权保护范围,或者依据专利说明书及附图对某些技术特征作出界定。 13、解释权利要求,可以使用专利说明书及附图、权利要求书中的相关权利要求、专利审查档案以及生效法律文书所记载的内容。 以上述方法仍不能明确权利要求含义的,可以结合工具书、教科书等公知文献及所属技术领域的普通技术人员的通常理解进行解释。 本指南所称专利审查档案,是指专利审查、复审、无效过程中国务院专利行政部门及专利复审委员会发出的审查意见通知书,专利申请人、专利权人做出的书面答复,口审记录表,会晤记录等。 本指南所称生效法律文书,是指已经发生法律效力的专利复审请求审查决定、专利无效宣告请求审查决定及相关的授权、确权行政判决。 14、权利要求与专利说明书出现不一致或者相互矛盾的,该专利不符合专利法第二十六条第四款的 规定 关于下班后关闭电源的规定党章中关于入党时间的规定公务员考核规定下载规定办法文件下载宁波关于闷顶的规定 ,告知当事人通过专利无效宣告程序解决。当事人启动专利无效宣告程序的,可以根据具体案情确定是否中止诉讼。 当事人不愿通过专利无效程序解决,或者未在合理期限内提起专利权无效宣告请求的,应当按照专利权有效原则和权利要求优先原则,以权利要求限定的保护范围为准。但是所属领域的技术人员通过阅读权利要求书和说明书及附图,能够对实现要求保护的技术方案得出具体、确定、唯一的解释的,应当根据该解释来澄清或者修正权利要求中的错误表述。 15、从属权利要求包含了应当记载在独立权利要求中、解决发明技术问题必不可少的必要技术特征(缺少该技术特征,独立权利要求中记载的技术方案不能实现发明目的)的,该专利不符合专利法实施细则第二十条第二款的规定,告知当事人通过专利无效宣告程序解决。当事人启动专利无效宣告程序的,可以根据具体案情确定是否中止诉讼。 16、对于权利要求中以功能或者效果表述的功能性技术特征,应当结合说明书和附图描述的该功能或者效果的具体实施方式及其等同的实施方式,确定该技术特征的内容。 功能性技术特征,是指权利要求中的对产品的部件或部件之间的配合关系或者对方法的步骤采用其在发明创造中所起的作用、功能或者产生的效果来限定的技术特征。 下列情形一般不宜认定为功能性技术特征: (1)以功能或效果性语言表述且已经成为所属技术领域的普通技术人员普遍知晓的技术名词一类的技术特征,如导体、散热装置、粘结剂、放大器、变速器、滤波器等; (2)使用功能性或效果性语言表述,但同时也用相应的结构、材料、步骤等特征进行描述的技术特征。 17、在确定功能性技术特征的内容时,应当将功能性技术特征限定为说明书中所对应的为实现所述功能、效果所必须的结构、步骤特征。 18、方法专利权利要求对步骤顺序有明确限定的,步骤本身以及步骤之间的顺序均应对专利权保护范围起到限定作用;方法专利权利要求对步骤顺序没有明确限定的,不应以此为由,不考虑步骤顺序对权利要求的限定作用,而应当结合说明书和附图、权利要求记载的整体技术方案、各个步骤之间的逻辑关系以及专利审查档案,从所属技术领域的普通技术人员的角度出发,确定各步骤是否应当按照特定的顺序实施。 19、以方法特征限定的产品权利要求,方法特征对于专利权保护范围具有限定作用。 20、实用新型专利权利要求中包含非形状、非构造技术特征的,该技术特征用于限定专利权的保护范围,并按照该技术特征的字面含义进行解释。 非形状、非构造技术特征,是指实用新型专利权利要求中记载的不属于产品的形状、构造或者其结合等的技术特征,如用途、制造工艺、使用方法、材料成分(组分、配比)等。 21、产品发明或者实用新型专利权利要求未限定应用领域、用途的,应用领域、用途一般对专利权保护范围不起限定作用。 产品发明或者实用新型专利权利要求限定应用领域、用途的,应用领域、用途应当作为对权利要求的保护范围具有限定作用的技术特征。但是,如果该特征对所要求保护的结构和/或组成本身没有带来影响,也未对该技术方案获得授权产生实质性作用,只是对产品或设备的用途或使用方式进行描述的,则对专利权保护范围不起限定作用。 22、写入权利要求的使用环境特征属于必要技术特征,对专利权保护范围具有限定作用。 使用环境特征是指权利要求中用来描述发明所使用的背景或者条件的技术特征。 23、被诉侵权技术方案可以适用于产品权利要求记载的使用环境的,应当认定被诉侵权技术方案具备了权利要求记载的使用环境特征,而不以被诉侵权技术方案实际使用该环境特征为前提。 24、说明书对技术术语的解释与该技术术语通用含义不同的,以说明书的解释为准。 被诉侵权行为发生时,技术术语已经产生其他含义的,应当采用专利申请日时的含义解释该技术术语。 25、同一技术术语在权利要求书和说明书中所表达的含义应当一致,不一致时应以权利要求书为准。 26、当权利要求中引用了附图标记时,不应以附图中附图标记所反映出的具体结构来限定权利要求中的技术特征。 27、专利权的保护范围不应受说明书中公开的具体实施方式的限制,但下列情况除外: (1)权利要求实质上即是实施方式所记载的技术方案的; (2)权利要求包括功能性技术特征的。 28、摘要的作用是提供技术信息,便于公众进行检索,不能用于确定专利权的保护范围,也不能用于解释权利要求。 29、当专利文件中的印刷错误影响到专利权保护范围的确定时,可以依据专利审查档案进行修正。 对于明显的语法错误、文字错误等,能从权利要求或说明书的整体及上下文得出唯一理解的,应依据实际情况予以解释。 二、发明、实用新型专利权的侵权判定 (一)技术特征的比对方法 30、判定被诉侵权技术方案是否落入专利权的保护范围,应当审查权利人主张的权利要求所记载的全部技术特征,并以权利要求中记载的全部技术特征与被诉侵权技术方案所对应的全部技术特征逐一进行比较。 31、被诉侵权技术方案包含与权利要求记载的全部技术特征相同或者等同的技术特征的,应当认定其落入专利权保护范围;被诉侵权技术方案的技术特征与权利要求记载的全部技术特征相比,缺少权利要求记载的一个或多个技术特征,或者有一个或一个以上技术特征不相同也不等同的,应当认定其没有落入专利权保护范围。 32、进行侵权判定,不应以专利产品与被诉侵权技术方案直接进行比对,但专利产品可以用以帮助理解有关技术特征与技术方案。 33、权利人、被诉侵权人均有专利权时,一般不能将双方专利产品或者双方专利的权利要求进行比对。 34、对产品发明或者实用新型进行专利侵权判定比对,一般不考虑被诉侵权技术方案与专利技术是否为相同技术领域。 (二)相同侵权 35、相同侵权,即文字含义上的侵权,是指被诉侵权技术方案包含了与权利要求记载的全部技术特征相同的对应技术特征。 36、当权利要求中记载的技术特征采用上位概念特征,而被诉侵权技术方案的相应技术特征采用的是相应的下位概念特征时,则被诉侵权技术方案落入专利权保护范围。 37、被诉侵权技术方案在包含了权利要求中的全部技术特征的基础上,又增加了新的技术特征的,仍然落入专利权保护范围。 但是,如果权利要求中的文字表述已将增加的新的技术特征排除在外,则不应当认为被诉侵权技术方案落入该权利要求的保护范围。 38、对于组合物的封闭式权利要求,被诉侵权技术方案在包含权利要求中的全部技术特征的基础上,又增加了新的技术特征的,则不落入专利权保护范围。但是,被诉侵权技术方案中新增加的技术特征对组合物的性质和技术效果未产生实质性影响或该特征属于不可避免的常规数量杂质的情况除外。 39、对于包含功能性特征的权利要求,如果被诉侵权技术方案不但实现了与该特征相同的功能,而且实现该功能的结构、步骤与专利说明书中记载的具体实施方式所确定的结构、步骤相同的,则被诉侵权技术方案落入专利权保护范围。 40、在后获得专利权的发明或实用新型是对在先发明或实用新型专利的改进,在后专利的某项权利要求记载了在先专利某项权利要求中记载的全部技术特征,又增加了另外的技术特征的,在后专利属于从属专利。实施从属专利落入在先专利的保护范围。 下列情形属于从属专利: (1)在后产品专利权利要求在包含了在先产品专利权利要求的全部技术特征的基础上,增加了新的技术特征; (2)在原有产品专利权利要求的基础上,发现了原来未曾发现的新的用途; (3)在原有方法专利权利要求的基础上,增加了新的技术特征。 (三)等同侵权 41、在专利侵权判定中,在相同侵权不成立的情况下,应当判断是否构成等同侵权。 42、等同侵权,是指被诉侵权技术方案有一个或者一个以上技术特征与权利要求中的相应技术特征从字面上看不相同,但是属于等同特征,应当认定被诉侵权技术方案落入专利权保护范围。 43、等同特征,是指与权利要求所记载的技术特征以基本相同的手段,实现基本相同的功能,达到基本相同的效果,并且所属技术领域的普通技术人员无需经过创造性劳动就能够想到的技术特征。 44、基本相同的手段,一般是指在被诉侵权行为发生日前专利所属技术领域惯常替换的技术特征以及工作原理基本相同的技术特征。 申请日后出现的、工作原理与专利技术特征不同的技术特征,属于被诉侵权行为发生日所属技术领域普通技术人员容易想到的替换特征,可以认定为基本相同的手段。 45、基本相同的功能,是指被诉侵权技术方案中的替换手段所起的作用与权利要求对应技术特征在专利技术方案中所起的作用基本上是相同的。 46、基本相同的效果,一般是指被诉侵权技术方案中的替换手段所达到的效果与权利要求对应技术特征的技术效果无实质性差异。 被诉侵权技术方案中的替换手段相对于权利要求对应技术特征在技术效果上不属于明显提高或者降低的,应当认为属于无实质性差异。 47、无需经过创造性劳动就能够想到,即对所属技术领域的普通技术人员而言,被诉侵权技术方案中替换手段与权利要求对应技术特征相互替换是显而易见的。 48、对手段、功能、效果以及是否需要创造性劳动应当依次进行判断。 49、等同特征的替换应当是具体的、对应的技术特征之间的替换,而不是完整技术方案之间的替换。 50、等同特征,可以是权利要求中的若干技术特征对应于被诉侵权技术方案中的一个技术特征,也可以是权利要求中的一个技术特征对应于被诉侵权技术方案中的若干技术特征的 组合。 51、等同特征替换,既包括对权利要求中区别技术特征的替换,也包括对权利要求前序部分中的技术特征的替换。 52、判定被诉侵权技术方案的技术特征与权利要求的技术特征是否等同的时间点,应当以被诉侵权行为发生日为界限。 53、权利要求与被诉侵权技术方案存在多个等同特征的,如果该多个等同特征的叠加导致被诉侵权技术方案形成了与权利要求技术构思不同的技术方案,或者被诉侵权技术方案取得了预料不到的技术效果的,则一般不宜认定构成等同侵权。 54、对于包含功能性特征的权利要求,如果被诉侵权技术方案相应技术特征不但实现了相同的功能,而且实现该功能的结构、步骤与专利说明书中记载的具体实施方式所确定的结构、步骤等同的,应当认定构成等同特征。 上述等同的判断时间点应当为专利申请日。 55、对于包含有数值范围的专利技术方案,如果被诉侵权技术方案所使用的数值与权利要求记载的相应数值不同的,不应认定构成等同。 但专利权人能够证明被诉侵权技术方案所使用的数值,在技术效果上与权利要求中记载的数值无实质差异的,应当认定构成等同。 56、对于仅在说明书或者附图中描述而在权利要求中未概括的技术方案,应视为专利权人放弃了该技术方案。专利权人以等同侵权为由主张专利权保护范围包括该技术方案的,不予支持。 被诉侵权技术方案属于说明书中明确排除的技术方案,专利权人主张构成等同侵权的,不予支持。 57、对被诉侵权技术方案中的技术特征与权利要求中的技术特征是否等同进行判断时,被诉侵权人可以专利权人对该等同特征已经放弃、应当禁止其反悔为由进行抗辩。 禁止反悔,是指在专利授权或者无效程序中,专利申请人或专利权人通过对权利要求、说明书的修改或者意见陈述的方式,对权利要求的保护范围作了限制或者部分放弃,从而在侵犯专利权诉讼中,在确定是否构成等同侵权时,禁止专利申请人或专利权人将已放弃的内容重新纳入专利权保护范围。 58、专利申请人或专利权人限制或者部分放弃的保护范围,应当是基于克服缺乏新颖性或创造性、缺少必要技术特征和权利要求得不到说明书的支持以及说明书未充分公开等不能获得授权的实质性缺陷的需要。 专利申请人或专利权人不能说明其修改专利文件原因的,可以推定其修改是为克服获得授权的实质性缺陷。 59、专利权人对权利要求保护范围所作的部分放弃必须是明示的,而且已经被记录在书面陈述、专利审查档案、生效的法律文书中。 60、禁止反悔的适用以被诉侵权人提出请求为前提,并由被诉侵权人提供专利申请人或专利权人反悔的相应证据。 在人民法院依法取得记载有专利权人反悔的证据的情况下,可以根据业已查明的事实,通过适用禁止反悔对权利要求的保护范围予以必要的限制,合理确定专利权保护范围。 三、外观设计专利权保护范围的确定 61、审理侵犯外观设计专利权纠纷案件,应当首先确定专利权保护范围。外观设计专利权保护范围以表示在图片或者照片中的该专利产品的外观设计为准,外观设计的简要说明及其设计要点、专利权人在无效程序及其诉讼程序中的意见陈述、应国务院专利行政部门的要求在专利申请程序中提交的样品或者模型等,可以用于解释外观设计专利权保护范围。 62、外观设计专利公告授权文本中没有设计要点的,专利权人可以提交书面材料,说明外观设计的独创部位及其设计内容。 63、当事人提交的用以证明专利产品外观设计发展变化的相关证据,可以在确定保护范围时予以考虑。 64、在确定外观设计专利权保护范围时,应当区分使用状态参考图与变化状态产品的使用状态视图。 使用状态参考图是国务院专利行政部门在审查过程中对在简要说明中未写明外观设计产品使用方法、用途或功能的新开发的产品,或者在一些使用方法、用途或功能不明确的产品无法进行分类时,为了便于对该产品正确分类而要求专利申请人提供的视图。使用状态参考图不能用于确定外观设计的保护范围,但是可以作为确定产品类别的因素。 变化状态产品的使用状态视图,应当作为确定产品外观设计保护范围的依据。 65、外观设计专利权请求保护色彩的,应当将请求保护的色彩作为确定外观设计专利权保护范围的要素之一,即在侵权判定中,应当将其所包含的形状、图案、色彩及其组合与被诉侵权产品相应的形状、图案、色彩及其组合进行综合对比。 66、外观设计专利权请求保护色彩的,专利权人应当提交由国务院专利行政部门出具或认可的相关证据,用以确定外观设计的保护范围。必要时,应当与国务院专利行政部门专利审查档案中的色彩进行核对。 67、对整体视觉效果不产生影响的产品的大小、材料、内部结构,应当排除在外观设计专利权保护范围之外。 68、相似外观设计专利权的保护范围由各个独立的外观设计分别确定。基本设计与其它相似设计均可以作为确定外观设计专利权保护范围的依据。 相似外观设计,是指对同一产品的多项相似外观设计提出一件外观设计专利申请并获得授权的外观设计专利。在多项相似外观设计中,应当指定一项作为基本设计。相似基本设计与某一相似外观设计之间具有相同或者相似的设计特征,并且二者之间的区别点在于局部细微变化、该类产品的惯常设计、设计单元重复排列或者仅色彩要素的变化等情形。 69、成套产品的整体外观设计与组成该成套产品的每一件外观设计均已显示在该外观设计专利文件的图片或者照片中的,其权利保护范围由组成该成套产品的每一件产品的外观设计或者该成套产品的整体外观设计确定。 成套产品设计,是指用于同一类别并且成套出售或使用的产品的两项以上外观设计,作 为一件外观设计申请提出并获得授权的外观设计专利。 四、外观设计专利权的侵权判定 70、在与外观设计产品相同或者相近种类产品上,采用与授权外观设计相同或者相近似外观设计的,应当认定被诉侵权外观设计落入外观设计专利的保护范围。 71、进行外观设计侵权判定,应当用授权公告中表示该外观设计的图片或者照片与被诉侵权外观设计或者体现被诉侵权外观设计的图片或者照片进行比较,而不应以专利权人提交的外观设计专利产品实物与被诉侵权外观设计进行比较。但是,该专利产品实物与表示在专利公告文件的图片或照片中的外观设计产品完全一致,或者与专利权人应国务院专利行政部门在专利申请程序中为更清楚地了解图片或照片中的内容而要求提交的样品或者模型完全一致,并且各方当事人均无异议的除外。 72、进行外观设计侵权判定,应当通过一般消费者的视觉进行直接观察对比,不应通过放大镜、显微镜等其他工具进行比较。但是,如果表示在图片或者照片中的产品外观设计在申请专利时是经过放大的,则在侵权比对时也应将被控侵权产品进行相应放大进行比对。 73、进行外观设计侵权判定,应当首先审查被诉侵权产品与外观设计产品是否属于相同或者相近种类产品。 74、应当根据外观设计产品的用途(使用目的、使用状态),认定产品种类是否相同或者相近。 确定产品的用途时,可以按照下列顺序参考相关因素综合确定:外观设计的简要说明、国际外观设计分类表、产品的功能以及产品销售、实际使用的情况等因素。 如果外观设计产品与被诉侵权外观设计产品的用途(使用目的、使用状态)没有共同性,则外观设计产品与被诉侵权产品不属于相同或者相近种类产品。 75、判定是否侵犯外观设计专利权,应当以是否相同或者相近似为标准,而不以是否构成一般消费者混淆、误认为标准。 76、应当以外观设计专利产品的一般消费者的知识水平和认知能力,判断外观设计是否相同或者近似,而不应以该外观设计专利所属技术领域的普通设计人员的观察能力为标准。 77、一般消费者,是一种假设的“人”,对其应当从知识水平和认知能力两方面进行界定。 一般消费者的知识水平是指,他通常对外观设计专利申请日之前相同种类或者相近种类产品的外观设计及其常用设计手法具有常识性的了解。 一般消费者的认知能力是指,他通常对外观设计产品之间在形状、图案以及色彩上的区别具有一定的分辨力,但不会注意到产品的形状、图案以及色彩的微小变化。 对外观设计产品的一般消费者的知识水平和认知能力作出具体界定时,应当针对具体的外观设计产品,并考虑申请日前该外观设计产品的设计发展过程。 78、判断外观设计是否相同或相近似时,不应以外观设计创作者的主观看法为准,而以一般消费者的视觉效果为准。 79、判断外观设计是否构成相同或相近似时以整体观察、综合判断为原则,即应当对授 权外观设计、被诉侵权设计可视部分的全部设计特征进行观察、对能够影响产品外观设计整体视觉效果的所有因素进行综合考虑后作出判断。 下列情形通常对外观设计的整体视觉效果更具有影响: (1)产品正常使用时容易被直接观察到的部位相对于其他部位; (2)外观设计区别于现有设计的设计特征相对于外观设计的其他设计特征。 80、被诉侵权设计与授权外观设计在整体视觉效果上无差异的,应当认定两者相同;在整体视觉效果上无实质性差异的,应当认定两者构成相近似。具体而言: (1)如果两者的形状、图案、色彩等整体上的视觉效果无差异,则应当认为两者构成相同; (2)如果两者的形状、图案、色彩等整体上的视觉效果不完全相同,但是没有明显差异的,则应当认为两者相近似;
