(英文版)模版甲方:乙方:20**年**月 外企劳动协议(英文版) LabourContract Employer: LegalRepresentative: Position:President Address:Postcode: Employee: Name:Gender: Address:Nationality: IDCardNo.: DateofBirth: EducationDegree: ThisContractissignedonamutualityvoluntarybasisbyandbetweenthefollowingEmployerandEmployeeinaccordancewiththeLabourLawofPeople'sRepublicofChina." 1.TermoftheContract: Thetermofthiscontractisfor_____yearsandshallcommenceon _____,_____,andshallcontinueuntil_____,_____,unlessearlierterminatedpursuanttothisContract.TheEmployeeshallundergoaprobationaryperiodof___months.2.JobDescripxion: TheEmployeragreestoemployMr./Ms.________(name)as________(jobtitle)in________Department,locatedin________(officelocationandcity). 3.RemunerationofLabour a.ThesalaryoftheEmployeeshallbemonthlypaidbytheEmployerinaccordancewithapplicablelawsandregulationsofP.R.C.ItshallbepaidbylegaltenderandnotlessthanthestandardminimumsalaryinTianjin. b.ThesalaryoftheEmployeeisRMB$______permonthintheprobationaryperiodandRMB$_____aftertheprobationaryperiod. c.Ifthedelayordefaultofsalarytakesplace,theEmployershallpaytheeconomiccompensationexcepxthesalaryitselfinaccordancewiththerelevantlawsandregulations. 4.WorkingHours&Rest&Vocation a.ThenormalworkinghoursoftheEmployeeshallbeeighthourseachday,excludingmealsandrestforanaverageoffivedaysperweek,foranaverageoffortyhoursperweek. b.TheEmployeeisentitledtoalllegalholidaysandotherpaidleavesofabsenceinaccordancewiththelaborlawsandregulationsofthePRCandthecompany'sworkrules. c.TheEmployermayextendworkinghoursduetotherequirementsofitsproductionorbusinessandshallbetheovertimecompensationaccordingtolaborlawsandregulations. 5.SocialSecurity&Welfare a.TheEmployerwillpayforallmandatorysocialsecurityprogramssuchpensioninsurance,unemploymentinsurance,medicalinsuranceoftheEmployeeaccordingtotherelevantgovernmentandcityregulations. b.DuringtheperiodoftheContract,theEmployee’swelfareshallbeimplementedinaccordancewiththelawsandrelevantregulationsofP.R.C. 6.WorkingProtection&WorkingConditions a.TheEmployershouldprovidetheEmployeewithoccupationalsafetyandhealthconditionsconformingtotheprovisionsoftheStateandnecessaryarticlesoflaborprotectiontoguaranteethesafetyandhealthduringtheworkingprocess. b.TheEmployershouldprovidetheEmployeewithsafetyeducationandtechniquetraining;TheEmployeetobeengagedinspecializedoperationsshouldreceivespecializedtrainingandacquirequalificationsforsuchspecialoperations. c.TheEmployeeshouldstrictlyabidebytherulesofsafeoperationintheprocessoftheirwork. 7.LabourDiscipline a.TheEmployermaydraftbylawsandemploymentmanualincludinglabourdisciplinesoftheCompany,Accordingtowhich,theEmployershallhavetherighttogiverewardsortakedisciplinaryactionstotheEmployee; b.TheEmployeeshallcomplywiththemanagementdirectionsoftheEmployerandobeythebylawsandlabourdisciplinesoftheEmployer. c.TheEmployeeshallundertaketheobligationtokeepandnottodisclosethetradesecretfortheEmployerduringtheperiodofthisContract;ThisobligationofconfidentialityshallsurvivetheterminationofthisContractforaperiodoftwo(2)years. 8.Termination,Modification,RenewandDischargeoftheContract a.TherelevantclausesoftheContractmaybemodifiedbytheparties: i.Thespecificclauseisrequiredtobemodifiedbythepartiesthroughconsultation; ii.Duetotheforcemajeure,theContractcannotbeexecuted; iii.TherelevantlawsandregulationshavebeenmodifiedorabolishedbythetimeofsigningtheContract. b.TheContractmaybeautomaticallyterminated: i)ThisContractisnotrenewedattheexpirationofthisContract; ii)TheEmployerislegallyannouncedtobebankrupxed,dismissed,orcanceled; iii)ThedeathoftheEmployeeoccurs; iv)Theforcemajeuretakesplace; v)TheconditionsofterminationagreedintheContractbythepartiesarise. c.TheContractmayberenewedattheexpirationthroughconsultationbythepartieswiththefulfillmentoftheprocedurewithin15daystotheexpiration; d.TheContractmaybedischargedthroughconsultationbythepartiesandpropercompensationarrangement; e.TheContractmaybedischargedbytheEmployerwithimmediateeffectandtheEmployeewillnotbecompensated: i.TheEmployeedoesnotmeetthejobrequirementsduringtheprobationaryperiod; ii.TheEmployeeseriouslyviolatesdisciplinesorbylawsoftheEmployer; iii.TheEmployeeseriouslyneglectshisduty,engagesinmalpracticeforselfishendsandbringssignificantlosstotheEmployer; iv.TheEmployeeisbeingpunishedbyphysicallabourforitsmisfeasance; v.TheEmployeeisbeingchargedwithcriminaloffences; f.TheContractmaybeterminatedbytheEmployerbygivingnoticeinwrittenform30(thirty)daysinadvance; i.TheEmployeefailsillorisinjuredto(otherthanduetowork)andaftercompletionofmedicaltreatment,isnotabletoperformhispreviousfunctionoranyotherfunctiontheEmployerassignstohim; ii.TheEmployeedoesnotshowsatisfactoryperformanceandaftertrainingandadjustingmeasuresisstillnotabletoperformsatisfactorily; iii.ThecircumstanceshavemateriallychangedfromthedatethisContractwassignedtotheextentthatitisimpossibletoexecutetheContractprovided,however,thatthepartiescannotreachanagreementtoamendthecontracttoreflectthechangedcircumstances. iv.TheEmployerisbeingconsolidatedinthelegalconsolidationperiodonthebrinkofbankrupxcyorthesituationofbusinessisseriouslyintrouble,undersuchcondition,itisrequiredtoreducetheemplouee.(inlegalprocedure) g.TheEmployeeshallnotbedismissed; i.TheContracthasneitherexpirednorconformedto8.d,8.e,8.f,8.g; ii.TheEmployeeisillwithoccupationaldiseaseorinjuredduetoworkandhasbeenauthenticatedfullyorpartlydisabledbytheLabourAuthenticationCommissioninBaodiCounty,Tianjin. iii.TheEmployeeisillorinjured(otherthanduetowork)andiswithintheperiodofmedicalleaveprovidedforbyapplicablePRClawandregulationsandCompanypolicy; iv.TheEmployeeiswomanwhoispregnant,onmaternityleave,ornursingababyunderoneyearofage;or iii.TheapplicablePRClawsandregulationsotherwiseprohibittheterminationofthisContract. h.TheContractmaybedichargedbytheEmployeebygivingnoticeinwrittenform30(thirty)daysinadvance.However,theEmployeemayinformtheEmployertodischargetheContractatrandomunderthefollowingoccasions: i.TheEmployeeisstillintheprobationaryperiod; ii.TheEmployerforcetheEmployeetoworkbyviolence,duressorillegalrestrictiontophysicalfreedom; iii.TheEmployerdoesnotpaytheremunerationoftheEmployeeinaccordancewiththerelevantclauseintheContract; iv.TheEmployerviolatestherelevantregulationsofStateorTianjinforitsterriblesafeandhealthcondition,whichisharmfultotheEmployee’shealth. I.TheContractcannotbeterminatedbytheEmployeebeforetheexpirationifnotconformingto8.d,8.h, j.TheEmployershallpaytheeconomiccompensationtotheEmployeriftheContractisterminatedconformingto8.d,8.f,8.h.i-8.h.iv.AdditionalfeeformedicalallowanceshouldbepaidtotheEmployeeiftheContractisterminatedconformingto8.f.i. 9.LiabilitiesforBreach a.Duetoeitherparty’sfault,ifbreachingtheContract,thatpartyshallundertakethebreachliabilityaccordingtotheextenttotheperformanceoftheContract;ifthepartiesbothbreachtheContract,theyshallundertakeitsseparateliabilityaccordingtotheconcretesituation. b.Duetoeitherparty’sfault,ifbreachingtheContracttodamagetheotherparty.ThedamageshouldbecompensatedbythefaultypartyinaccordancewiththerelevantlawsandregulationsofPRC. c.Duetotheforcemajeure,causingthenon-performanceorthedamagestoeitherparty,theotherpartymaynotundertakethebreachliability; c.TheEmployeewantstoresignandhasreceivedtrainingprovidedbytheEmployer,theEmployeeshallcompensateforthetrainingcost.Themethodofcompensationshouldbefixedaccordingtotherelevantcompanyregulationsasfollows: TheEmployeeshallcompensateRMB_______within___year(s)intheCompanyiftheContractisterminatedbytheEmployeeathiscause; TheEmployeeshallcompensateRMB_______within___year(s)intheCompanyiftheContractisterminatedbytheEmployeeathiscause; TheEmployeeshallcompensateRMB_______within___year(s)intheCompanyiftheContractisterminatedbytheEmployeeathiscause; 10.LaborDisputes WherealabordisputebetweenthepartiestakesplaceduringtheperformanceofthisContract,thepartiesconcernedmayseekforasettlementthroughconsultation;oreitherpartymayapplytothelabordisputemediationcommitteeoftheirunitformediation;ifthemediationfailsandoneofthepartiesrequestsforarbitration,thatpartymayapplytothelabordisputearbitrationcommitteeforarbitration.Eitherpartymayalsodirectlyapplytothelabordisputearbitrationcommitteeforarbitrationwithin60daysstartingfromthedateoftheoccurrenceofalabordispute.Ifoneofthepartiesisnotsatisfiedwiththeadjudicationofarbitration,thepartymaybringthecasetoapeople'scourtwithin15daysofthedateofreceivingtherulingofarbitration Employer:(officialstamp) Representative: Address: Employee: Address: 本次模版由票企查清算,版权归原作者所有,如有侵权可后台联系后台客服,我们将竭诚处理。 点赞在看关注转发,好运加倍HYPERLINK"https://www.muaaa.cn/"\l"/web/articles/1003766"阅读原文
