RegulationofGuangdongProvinceonthePaymentofWages(Adoptedatthe16thmeetingoftheStandingCommitteeofthe10thPeople'sCongressofGuangdongProvinceonJanuary19,2005)ChapterIGeneralProvisionsArticle1Forthepurposeofregulatingthepaymentofwages,safeguardingtherightsofemployeestogetremunerationsfortheirlabor,establishingaharmoniouslaborrelationshipandpromotingsocialstabilityandeconomicdevelopment,thisRegulationisformulatedinaccordancewiththeLaborLawofthePeople'sRepublicofChinaandtherelevantlawsandadministrativeregulations,andincombinationwiththeactualsituationofthisProvince.Article2ThisRegulationshallapplytoenterprises,privatenon-enterpriseentitiesandindividualeconomicorganizations(hereinafterreferredtojointlyasemployingentities)withinthejurisdictionofthisProvinceandtheemployeeswhohaveestablishedlaborrelationshiptherewith.Thestateorgans,publicinstitutionsandsocialorganizationswithinthejurisdictionofthisProvinceandtheemployeeswhohaveestablishedlaborrelationshiptherewithshallbegovernedbythisRegulationthroughanalogy.Article3TheProvincialPeople'sGovernmentshallformulateaminimumwagestandardpursuanttotherelevantprovisions,andthepeople'sgovernmentsat or abovethelevelofdistrictedcityshalldeterminetheminimumwagelevelsoftheirrespectivecitieswithintheminimumwagelevelsaspromulgatedbytheProvincialPeople'sGovernment.Thepeople'sgovernmentsat or abovethecountylevelshallregularlyannouncetheguidingwageandguidingwagelevelofthelabormarket,andprovideguidanceandservicestotheemployingentitiesandemployees.Article4Thewagesshallbepaidonschedule,infullamountandwithpriority.Whereanemployeeprovidesnormallaborwithinthestatutoryworkinghours or theworkinghoursasstipulatedinthelaborcontract,theemployingentityshalldeterminehiswagestandardnotlowerthanthelocalminimumwagelevel.Article5Thepeople'sgovernmentsatalllevelsshallestablishandimprovetheirrespectiveearly-warningmechanismsofwagepayment,creditsupervisorymechanismsandemergencyhandlingmechanisms.Article6Theadministrativedepartmentsoflaborandsocialsecurityofthepeople'sgovernmentsatalllevels(hereinafterreferredtoasthelaborandsecuritydepartment)shallberesponsiblefortheguidance,supervisionandinspectionofwagepaymentbyemployingentitieswithintheirrespectivejurisdictions.Thedepartmentsofindustryandcommerce,construction,customs,taxation,andthebanksshallhelpthelaborandsecuritydepartmentintherespectofsupervisionoverthepaymentofwageswithintheirrespectivefunctions.Laborunionsandwomen'sfederationsshalllawfullymaintaintherightsofemployeesforremunerationfortheirlabor.Anyentity or individualshallhavetherighttoreportanyillegalactrelatedtothepaymentofwages.ChapterIIPaymentofWagesArticle7Anemployingentityshallestablishitssystemontherulesofwagesaccordingtolaw,andmakeitknowntoalltheemployeesthereofinwrittenform.Therulesforpaymentofwagesshallcoverthefollowingmatters:(1)Waysfordistributionofwages,items,standardsandmethodsforthedeterminationandadjustmentthereof;(2)Periodanddateforthepaymentofwages;(3)Overtimewages,wagesforextraworkinghours,wagesforspecialcircumstances,andthepaymentmethodsthereof;(4)Wagestobewithheldanddeducted,andthewithholdinganddeductionmatters;and(5)Otherrelevantmatters.Anemployeeisentitledtoinquiretheemployingentityaboutthecontentsoftherulesonthepaymentofwages.Article8Anemployingentityshallstipulatethewagesfornormalworkinghourspaidtoemployeesinthelaborcontract,andthestipulatedwagesmaynotbelowerthantheminimumwagelevelofthatyearaspromulgatedbythelocalgovernment.Wherethereisnostipulation or definitestipulationinthisrespect,theaveragemonthlywagesoftheemployeesasproclaimedbythecountypeople'sgovernmentatthelocalitywheretheemployingentityisdomiciledshallbethewagesfornormalworkinghours;wherethewagesactuallypaidarehigherthantheaveragemonthlywagesofemployeesasproclaimedbythelocalgovernment,thewagesactuallypaidshallberegardedasthewagesfornormalworkinghoursasagreedonbytheemployees.Article9Anemployingentitymayconductcollectiveconsultationwiththelabor union oremployeerepresentativesthereofinregardtothepaymentofwages,andshallconcludeacollectiveagreementthereon.Article10Anemployingentityshallpaywagesincurrency,atthedeterminedcyclesforpayingwagesandinfullamount.Nodelinquency or skimpisallowed.Wherethewagesarepaidatthecycleofmonth,week,day or hour,theperiodforpayingwagesmaybedeterminedaccordingtothemonth,week,date or hour.Wherethesystemofpayingwagesbypieceworkisimplemented or thewagesarepaidforacertaintasktobeaccomplished,thecycleforpayingwagesmaybestipulatedaccordingtothenumberofpieceworkdone or theaccomplishedtasks,whileifthecycleforpayingwagesinexcessofonemonth,theemployingentityshallpaywagesonamonthlybasispursuanttothestipulations.Whereanannualpaymentsystemisimplemented or thewagesarepaidonthebasisoftheexaminationperiod,theemployingentityshallpaywagespermonthaccordingtothestipulations,andshallsettleandpaythemoffattheendoftheyear or attheexpiryoftheexaminationcycle.Article11Anemployingentityshallpaywagesdirectlytotheemployeehimself.Ifanemployeefailstodrawwagesduetoanyreason,hemayentrustanyothertodrawit,andapowerofattorneyshallbeprovided.Ifanemployingentityentrustsabanktopaywages,itshalldepositthefullwagesintotheaccountsofemployeesthemselvesatthestipulateddateforthepaymentofwages.Article12Anemployingentityshallpaywagestoitsemployeesatthestipulateddate.Inthecaseoflegalholidays or restdays,theemployingentityshallpaytheirwagesatthenearestworkingdayinadvance.Article13Whenanemployingentityterminates or dissolvesthelaborrelationshipwithanemployeeaccordingtolaw,itshallpayoffthewagesoftheemployeeonceandforallonthedaywhenthelaborrelationshipisterminated or dissolved.Article14Anemployingentitymaywithholdthefollowingfundsfromthewagesofemployeespursuanttotherelevantprovisions:(1)Individualincometaxesthatshouldbepaidbyemployees;(2)Varioussocialinsurancefeesandhousingreservesthatshouldbepaidbyemployeesthemselves;(3)Alimony,estoversandchildsupportpaymentthatshouldbewithheldasrequiredbytherulingsandverdictsofthepeople'scourt;or(4)Otherfeesthatmaybedeductedfromthewagesofemployeesasprescribedbylawsandregulations or asagreedonbybothparties.Article15Incaseanemployeeshallcompensateforthedirecteconomiclosseshehasincurredtotheemployingentityduetohisfault,theemployingentitymaydeductthecompensationsfromhiswages,butshallgiveawrittennoticeonthereasonsfordeductionandtheamounttobedeductedinadvance;otherwise,itmaynotdeductthewages.Andthemonthlywagesremainedafterthedeductionofcompensationsmaynotbelowerthanthelocalminimumwagestandard.Article16Anemployingentityshallcompileledgersforthepaymentofwagesonthebasisofthecyclesofpaymentofwages,andkeepthemforatleasttwoyears.Theledgersforthepaymentofwagesshallmainlyspecifythedateandcycleofpayment,thenamesofemployees,workinghours,theitemsandamountofwagespayable,theitemsandamountwithheldanddeducted,theamountofwagesactuallypaid,aswellasthevouchersissuedbythebankontheentrustedpaymentofwages or thesignaturesofemployees,etc.Article17Whenanemployingentitypayswages,itshallprovidelistsofwagestotheemployeesthemselves.Whenanemployingentityextendstheworkinghours or arrangesemployeestoworkonrestdays or legalholidays,itshallputcorrespondingwagesandremunerationsonthelistofwagesIftheemployingentityfailstodosoandcannotprovethepayment,itshallberegardedasafailuretopaycorrespondingwagesandremunerations.Theitemsandamountonthelistofwagesshallbeidenticalwiththeledgersforthepaymentofwages.Anemployeehastherighttoconsultandverifyhislistforpaymentofwages.Article18DailywagesshallbedeterminedpursuanttothemonthlywagesdeductedbytheaveragemonthlyworkingdaysasprescribedbytheState,whilehourlywagesshallbedeterminedpursuanttothedailywagesdeductedbytheaveragedailyworkinghours,whichmaynotbemorethan8hours.Article19Whereanemployeeenjoyssuchvacationsaslegalholidays,annualleave,leaveforgoinghometovisittheirfamilies,weddingleave,leaveforarrangingfuneral,maternityleave,nursingleave,andvacationforchildbirth,etc.,thisshallberegardedasnormallaborofferedbytheemployeeandtheemployingentityshallpaywagestohim.Article20Whenanemployingentityarrangesemployeestoworkovertime or extendstheirworkinghours,itshallpaytheovertimewagesandwagesfortheextendedworkinghourstotheemployeespursuanttothefollowingstandards:(1)Overtimewagesandremunerationsshallbepaidattherateof150%ofthedaily or hourlywagesoftheemployeesthemselvesfortheextendedworkinghoursinaworkingday;(2)Overtimewagesandremunerationsshallbepaidattherateof200%ofthedaily or hourlywagesoftheemployeesthemselvesincasetheemployeesworkattherestdayandtheemployingentityfailstoarrangefortheirrestatalatertime;or(3)Overtimewagesandremunerationsshallbepaidattherateof300%ofthedaily or hourlywagesoftheemployeesthemselvesincasetheemployeesworkatlegalholidays.Article21Wherethesystemofpayingwagesbypieceworkisimplemented,anemployingentityshallproperlydeterminetherationofpieceworkandtheunitpriceofpiecework,andmakethempublic.Thespecificrationofpieceworkshallbeonethatcanbecompletedwithinthelegalworkinghoursby70% or moreemployeesatthesamepostoftheentity.Incaseanemployingentityarrangesemployeestoworkbeyondthenormalworkinghoursaftertheycompletetherationedlabor,itshallpayovertimewagesandwagesfortheextendedworkinghourspursuanttoArticle20ofthisRegulation.Article22Wherethesystemofcomprehensivecalculationofworkinghoursisimplementeduponapprovalofthelaborandsecuritydepartment,thepartoftheactualworkinghoursofanemployeewhichexceedstheaccumulativestatutoryworkinghourswithintheperiodofcomprehensivecalculationperiodshallbeconsideredastheextendedworkinghours,andtheemployingentityshallpaywagespursuanttotheprescriptionsinItem(1)ofArticle20ofthisRegulation.Whereanemployingentityarrangesemployeestoworkinlegalholidays,theemployingentityshallpaywagespursuanttotheprescriptionsinItem(3)ofArticle20ofthisRegulation.Article23Incasethesystemofnon-regularworkinghoursisimplementeduponapprovalofthelaborandsecuritydepartment,theArticle20ofthisRegulationwillnotbeapplicable.Article24Incaseanemployeestopshisworkfortreatmentduetohisillness or non-work-relatedinjury,anemployingentityshallpaywagesforsickleaveinaccordancewiththestipulationsofthelaborcontract or thecollectivecontract or theprescriptionsoftheStateduringthemedicalperiodasprescribedbytheState.Andthesickleavewagespaidbytheemployingentityshallnotbelessthan80%ofthelocalminimumwagelevel.Wheretherearedifferentprescriptionsinanylaw or regulation,suchprescriptionsshallprevail.Article25Anemployingentitymaynotpaywagestoanemployeeduringhisprivateaffairsleave.Article26Whenanemployeeparticipatesinanyofthefollowingsocialactivitiesinaccordancewithlawduringthenormalworkinghours,theemployingentityshallpaywagestohimashehasofferednormallabor:(1)Lawfulexerciseoftherighttovote or therighttobeelected;(2)Lawfulexerciseoffunctionsasadeputytothepeople'scongress or memberofthepeople'spoliticalconsultativeconference;(3)Participationasadeputyinameetingheldbysuchorganizationsasthegovernment,party,tradeunion,communistyouthleague or women'sfederationattheleveloftownship(town) or higher;(4)Participationincourtproceedingsasapeople'sassessor;(5)Participationintheactivitiesofatrade union asanon-off-the-jobmemberofagrassrootscommitteeofthetradeunion;(6)Participationinthenegotiationforthecollectivecontractasarepresentativeofemployees; or (7)Anyothercircumstanceasprescribedbyanylaw or regulation.Article27Whereanemployeeissentencedbythepeople'scourt,andputundersurveillance or takenintocustodybutplacedonprobation, or sentencedtoafixedtermofimprisonmentbutonprobation,iftheemployeecontinuestonormallyworkfortheformerentityduringtheperiodsofparole,surveillanceoutsideprison, or waitingfortrialonbail,itshallpaywagestohim.Article28Incaseanemployeeissuspectedofcommittingacrimeandthusisputonjudicialcompulsorymeasures or takenintoadministrativecustody,andfailstoworkfortheentity,theemployingentitymaynotpaywagestohim.Article29Incasethedecisionofanemployingentityondischargeoflaborrelationshipshallberescindeduponaruling or isadjudicatedasvoid,theemployingentityshallpaythewagesfortheperiodofillegaldischargeoflaborrelationshiptotheemployee,andthewagestandardshallbethewagesfornormalaverageworkinghoursoftheemployeehimselfwithintheprevious12months;whileiftheemployingentityhasobtainedtheunemploymentinsurance,heshallreturnittotheinstitutionresponsibleforthesocialinsuranceinfullamount.Wherethereisanydisputeontheperiodasprescribedbytheprecedingparagraph,itcanbeadjudicatedbythelabordisputearbitrationcommittee or thepeople'scourt.Article30Ifapartnershipdefaultsinpaymentofwagesofitsemployees,thewagesshallbefirstpaidbyallthepropertiesofthepartnership;ifthepropertiesofthepartnershiparenotsufficientforthewages,eachpartnershallassumeunlimitedandjointliabilityforpayment.Article31Incasetheoperatorofanemployingentitythathasleasedtheworksite or plantanddefaultsinthepaymentofwagesandescapes,thelocalgovernmentandtherelevantdepartmentshalladopteffectivemeasuresandtimelyorganizetherelevantentitiesandpersonnelforhandlingtheaffairs,suchastheadvancedpaymentoftemporarylivingcostandtherecoveryofwages.Article32IncaseacontractorwhodoesnothavethequalificationofanemployingentityasprescribedbyArticle2ofthisRegulationdefaults or skimpsthewagesofemployees,theemployingentitythatprovidestheprojectshallpaythewagesinadvance,andthenrecoveritslossesagainstthecontractor.Article33Whereanentityundertakingtheproject(owner)failstoallocatefundsfor or settleforthepricesoftheprojectpursuanttothestipulationsinthecontract,andcausestheconstructionentity'sdefaultinthepaymentofwagesofemployees,thelaborandsecuritydepartmentmayorderittopaythewagesofemployeesinadvancewithintheamountofunsettledpricesfortheproject.Incasethesubcontractorofanengineeringprojectdefaults or deductsthewagesofemployees,thepartythatprovidedtheengineeringprojectshallpaythewagesofemployeeswithintheamountofunsettledpricesfortheproject.Theadvancedpaymentshallbeusedtooffsetthepricesoftheproject.Incasethepartythatprovidestheengineeringprojectillegallycontracts or subcontractstheproject, or illegallyallowsanyothertoundertaketheprojectinthenameofitsown,andcausesthedefaultinpaymentofwages,thewagesofemployeesshallbepaidinadvancebythepartythatprovidestheengineeringproject.Article34Incasethewagesofemployeesaredefaultedpriortothemerger or divisionofanemployingentity,thedefaultedwagesshallbepaidatthetimeofthemerger or division;iftheycannotbepaid,themerged or dividedemployingentityshallpaythedefaultedwages.Article35Incasetheshutdown or shutoutofanemployingentityiscausedbythefaultoftheemployeesthemselves,theemployingentityshallpaywagestotheemployeesastheyhaveofferednormallaborifitiswithinonepaymentcycle(themaximumperiodshallbe30days).Incaseitexceedsonepaymentcycle,wagesmaybepaidaccordingtotheworkofferedbytheemployeesonthebasisofthestandardnewlystipulatedbybothparties.Iftheemployingentitydoesnotarrangefortheemployeestowork,itshallpaylivingexpensestotheemployeesattherateof80%ofthelocalminimumwagestandard.Thelivingexpensesshallbepaiduntiltheenterpriseresumesitsoperation or production, or thelaborrelationshipisdissolved.Article36Incaseanemployingentitygoesbankrupt,isterminated or dissolved,thepropertiesthereofafterliquidationshallbeprimarilyusedforpayingwagesandsocialinsurancefeesitowedtotheemployees.ChapterIIISupervisionandInspectionArticle37Thepeople'governmentat or abovethecountylevelshallestablishanearly-warningsystemonthepaymentofwagesinaccordancewiththeactualsituationofitsownjurisdictiononthepaymentofwages.Thelaborandsecuritydepartmentmayexercisefocusedsurveillanceoverthoseemployingentitiesthathavedefaultedinthepaymentofwagesofemployeesfortwo or moremonths or foraccumulativelythree or moremonths, or maymakeitpublicifthecircumstanceisserious.Anemployingentitylistedintothefocusedsurveillanceoverthepaymentofwageshaspaidthedefaultedwagesofemployees,andnonewdefaulthasoccurredwithinsixmonths,thelaborandsecuritydepartmentshallremovethefocusedsurveillance,andannouncetheremovalthereofwithintheoriginallyannouncedscope.Article38Thepeople'governmentat or abovethecountylevelshallestablishanearly-warningsystemonthepaymentofwages.Incaseanycollectiveeventiscausedduetothedefault or skimpofwagesofemployees,thelaborandsecuritydepartmentshall,accordingtotheemergencyhandlingmechanism,handleittogetherwiththerelevantdepartment,whichshallgivetheircooperation.Article39Thelaborandsecuritydepartmentshallestablishandimprovethesupervisionandinspectionsystemofemployingentitiesonthepaymentofwages,regulatethesupervisionandinspectionprocedures,andexercisesurveillanceoverthepaymentofwagesbyemployingentities,andhandletheillegalacts,ifany.Whenthelaborandsecuritydepartmentinspectsthepaymentofwagesbyemployingentities,theemployingentitiesshallfaithfullyreporttheirrespectivesituations,providetherelevantmaterialsandcertificates,andmaynotresorttofraud,obstruction or refusal.Article40Thelaborandsecuritydepartmentshallestablishandimprovethesystemforreportingandcomplainingillegalactsrelatedtothepaymentofwages,setupmailboxesoftip-offandcomplaint,announcethephonenumbersfortip-offandcomplaint,provideconvenienceforemployeestotipoff or makecomplaints,andshallkeepitsecretsfortheinformer.Afterthelaborandsecuritydepartmentreceivesanyreport or complaint,itshalldecidewhethertoputitonfileandinformtheresulttotheinformer or complainingpersonwithinsevenworkingdays;andiftheinvestigationforanyillegalactisnecessaryafterthecaseisputonfile,itshallbeconcludedwithin60daysfromthedaywhenthecaseisputonfile.Wherethecircumstanceiscomplexandthetimeforhandlingofthecaseneedstobeextended,itshallbesubjecttotheapprovalofthelaborandsecuritydepartment,buttheextendedtimemaynotexceed30days.Article41Thelaborandsecuritydepartmentshallestablishandimprovethesystemoflaborlegalityandcreditarchivesofemployingentitiesincludingthepaymentofwages,promotetheappraisalsystemonthelaborlegalityandcredit, or maymakepublicthoseemployingentitiesthatseriouslydefault or skimpthewagesofemployeesatthemedia,jobcenters or placesofemployingentities,andreporttherelevantconditionstotherelevantdepartmentsandentities,suchasthedepartmentforindustryandcommerceandthebank.Article42Thepeople'governmentat or abovethecountylevelshallstrengthenitssupervisionandinspectionofthelawenforcementofthelaborandsecuritydepartmentsonthepaymentofwages.Ahigherlaborandsecuritydepartmentshallstrengthenitssupervisionandinspectionoflawenforcementofitssubordinatelaborandsecuritydepartments,andshallorderthemtomakecorrectionswithinthetimelimitifitfindsthatanysubordinatelaborandsecuritydepartmentdoesnotmakeanyact or makesanillegal or improperdisposaldecisionontheillegalactofanemployingentity.Article43Ifanemployingentityisunderanyofthefollowingcircumstances,theemployeehastherighttoreportandcomplainittothelaborandsecuritydepartment:(1)Default or deductionofwagesofemployees;(2)Wagespaidtoemployeesislowerthanthelocalminimumwagelevel;(3)Refusaltopay or failuretopayovertimewagestoemployeesfortheirovertimework or thetheirextensionofworkinghoursaccordingtolaw;(4)Anyotheractinviolationofthelawfulrightsandinterestsofemployeesforwagesandremunerations.Article44Inthecaseofanydisputeonthepaymentofwages,theemployingentityshallassumetheburdenofproof.Iftheemployingentityrefusestoprovide or failstoprovidewithinthetimelimittherelevantvouchersonthepaymentofwagesandotherevidenceandmaterials,thelaborandsecuritydepartment,thelabordisputearbitrationcommittee or thepeople'scourtmaymakearulingbasedontheamountofwagesandotherevidenceasprovidedbytheemployee.Ifboththeemployingentityandtheemployeefailtoproduceevidenceontheamountofwages,thelabordisputearbitrationcommittee or thepeople'scourtmaycalculateanddecideitbyreferringtotheaveragewagesofthesamepostinthesameentity or theaveragewagesoflocalon-the-jobemployeesandpursuanttotheprincipleofbeingfavorabletotheemployee.Article45Atrade union maysupervisetheemployingentityinrespectofitsobservanceoftherelevantlawsandregulationsonthepaymentofwages,andshallhavetherighttoasktheemployingentitytomakecorrectionsforanyillegalact or circulateanoticetothelaborandsecuritydepartment.Incasetheemployingentityrefusestomakecorrections or theoperatorescapes,thetrade union canrepresenttheemployeestorequestthelocallaborandsecuritydepartmenttohandleitinaccordancewithlaw,andiftheemployeefilesalaborarbitration or lawsuit
