Dvn group in the upper reaches of the jinsha River along the river continues to the East to South stream groups, layout along the city's main commercial, business, administrative, cultural and creative research and development in science and education function of modern service and port equipment manufacturing, liquor, and other features and modern industry. 2.5-2 spatial planning figure 2.6 in Yibin city, Central City urban development vision vision 林地林木权属证书换发新的《林权证》。故XX于04年6月9日以82年湛江市人民政府颁发的山权林权证的基础上给本案答辩人土相村“XX”、“XX”、“XX”等林地林权换发东林证字(2004)第01234号《林权证》(见证据2)，是对答辩人土相村这三块林地的再次确权。且该三块林地坐落位置都与答辩人土相村唇齿相依、紧密相连(见证据6)，土相村一直占有、使用、收益，从未荒废。并有XX村、XX村、XX村、XX村、及X新村村民何明超、XX村民XX、湛江市城市管理行政执法局XX分局XX等证人的证言(见证据7至证据14)均证实该三块林地属答辩人土相村所有、使用、收益。 (2)从被答辩人向法院提供的证据来看，被答辩人没有一张证据证实“XX”、“XX”、“XX”三块林地是其占有、使用、收益的事实情况，更谈不上自古以来一直是被答辩人经营管理，被答辩人经营什么、管理什么没有相应的事实依据。 从中华人民共和国成立至今，被答辩人无法出示人民政府曾经确认过这三块地是其使用的权源证据及相关证据。例如:(1)土地改革时期，人民政府依法颁发的土地证;(2)土地改革时期，《土地改革法》规定不发的林木、林地的土地清册;(3)六十年代初人民政府将劳力、土地、耕畜、农具固定给生产小队使用时确定的山林权属和经营范围的材料、文件;(4)人民政府作出的处理决定等相关证据。 被答辩人出示XX村民小组、XX村民小组、XX村民小组及相关人员出具的证明材料均不能证实“XX”、“XX”、“XX”三块林地历史以来是被答辩人使用，因为这些村民小组和相关证人所作出的intensive development. Dvn group in the upper reaches of the jinsha River along the river continues to the East to South stream groups, layout along the city's main commercial, business, administrative, cultural and creative research and development in science and education function of modern service and port equipment manufacturing, liquor, and other features and modern industry. 2.5-2 spatial planning figure 2.6 in Yibin city, Central City urban development vision vision 证明材料没有相关证据印证其证言的真实性;另外，这XX村民小组与被答辩人是同一祖宗，XX村民小组和被答辩人是同一姓氏，XX村民小组及相关的证人与答辩人土相村有矛盾冲突。依据《最高人民法院关于行政诉讼证据若干问题的规定》第71条第2款规定:下列证据不能单独作为定案依据:„„(二)与一方当事人有亲属关系或者其他密切关系的证人所作出对当事人有利的证言，或者与一方当事人有不利关系的证人所以作出的对该当事人不利的证言。„„”因此，这些证据不能作为本案的定案证据。 二、被答辩人调低村主张“几十年来，“XX”、“XX”、“XX”三块林地的权属问题在被答辩人与答辩人土相村之间一直存在争议。”没有任何法律依据。 1、从解放后至2007年4月之前未曾有任何村庄对答辩人土相村所有的“XX”、“XX”、“XX”三块林地提出争议。 (1)解放后的初级社、高级社、人民公社至1979年党的十一届三中全会的改革开放，答辩人土相村一直占有使用这三块地没有任何村庄对此提出过争议。 (2)从改革开放之后倒1982年，答辩人土相村申请湛江市人民政府核准颁发山权林权证，也没有任何村庄提出争议。 (3)从1982年答辩人土相村领取《山权林权证》至2004答辩人土相村申请XX政府换发《林权证》也没有任何存在提出过任何争议。就是在去年即2007年5月被答辩人才莫名奇妙地对答辩人历史占有使用的“XX”、“XX”、“XX”三块林地提出争议。被答辩人提供intensive development. Dvn group in the upper reaches of the jinsha River along the river continues to the East to South stream groups, layout along the city's main commercial, business, administrative, cultural and creative research and development in science and education function of modern service and port equipment manufacturing, liquor, and other features and modern industry. 2.5-2 spatial planning figure 2.6 in Yibin city, Central City urban development vision vision 的证据中称，其曾在90年12月向XX镇政府提出异议，但经XX镇党政办公室查证，没有记载及备案。可见，从解放后答辩人土相村占有使用“XX”、“XX”、“XX”三块林地至2007年4月份前未曾有任何的村庄提出争议。 2、如果说几十年来，“XX(旧称XX园)”、“XX(旧称X园)”、“XX(旧称落坎坑)”三块林地权属问题在被答辩人与答辩人之间存在争议，那么湛江市人民政府在1982年绝对不会给答辩人颁发《山权林权证》，XX政府在2004年也不会给答辩人换发《林权证》。 三、2004年XX给答辩人土相村的“XX”、“XX”、“XX”三块林地换发林权证，事实清楚，程序合法有效，依法应予维持。 1、XX及林业主管部门有权对本辖区内的林地林权进行核准登记和换发证。 (1)XX属县一级地方人民政府，行驶县一级人民政府的职能。根据《广东省林地林权登记换发证 工作方案 公交公司节能减排工作方案居民健康档案工作方案幼儿园传染病防治工作方案安全隐患排查治理工作方案创建卫生村工作方案 》第五点规定“林地林木登记换发证工作是县级以上地方人民政府和各级林业主管部门的一项法定职责”。可见，被答辩人在上诉中称XX没有发证的权利是没有任何根据的。 2XX给答辩人土相村“XX”、“XX”、“XX”等林地林权换发林权证的具体行政程序是合法的。 (1)湛江市XX于04年6月9日给本案答辩人土相村“XX”、“XX”、“XX”等林地林权换发东林证字(2004)第01234号《林权证》。是根据根据2002年省政府关于《广东省林地林权登记换发工intensive development. Dvn group in the upper reaches of the jinsha River along the river continues to the East to South stream groups, layout along the city's main commercial, business, administrative, cultural and creative research and development in science and education function of modern service and port equipment manufacturing, liquor, and other features and modern industry. 2.5-2 spatial planning figure 2.6 in Yibin city, Central City urban development vision vision 作方案》的规定的坚持政策稳定连续性的原则，为进一步稳定山林权属，以林业“三定”时期确定的权属为基础，对林地林木已经确权颁发过林地林木权属证书换发新的《林权证》。XX给答辩人换发的东林证字(2004)第01234号《林权证》正是在1982年湛江市人民政府颁发给答辩人的的山权林权证的基础上换发的。 (2)湛江市XX是根据《广东省林地林权登记换发工作方案》的规定及《XX林地林权登记处换发证操作办法》的规定，并按下列严格的具体程序给答辩人换发《林权证》: A、先由答辩人土相村向XX换发证工作组提出申请，填写《林权登记申请表》(草表)并提交答辩人原有的《湛江市山权林权证》等林地林权证的权源证据等材料，然后由XX换发证工作组审定。B、进行公榜。由试验区换发证工作组将《林权登记申请表》集中在村委会办公室张榜公布。C、实行现场审核(现场踏查)。由换发证工作组会同村委会干部及相邻权利人到现场核实面积，勾绘四至界线，由参加人员在《林权核查登记表》上签字认可。D、公示。由换发证工作组成XX同志\\(镇政府国土所)和XX同志(镇城建办)负责将公示内容张贴在相邻村庄的办公场所或村庄的中心位置，时间为30天。E、公示后由有关部门造册登记并审核验收及建档，在由乡镇政府审核批准及林业局审核批准，并由XX向答辩人土相村换发国家林业局规定的全国统一式样的《林权证》。 上述可见，XX给答辩人换发林权证的具体行政行为合法有效，依法应予维持。 intensive development. Dvn group in the upper reaches of the jinsha River along the river continues to the East to South stream groups, layout along the city's main commercial, business, administrative, cultural and creative research and development in science and education function of modern service and port equipment manufacturing, liquor, and other features and modern industry. 2.5-2 spatial planning figure 2.6 in Yibin city, Central City urban development vision vision 四、被答辩人在上诉中称:“《XX证明材料》、《XX与XX证明材料》、《XX镇政府办公室证明》均于2008年出据的证明书，不能作为行政机关作出具体行政行为时的证据。”其观点没有法律依据的。 (1)根据《行政诉讼法》第33条规定:“在诉讼过程中，被告不得自行向原告和证人收集证据。”该条规定的是被告不得“自行”收集证据，而且收集证据的对象是“原告和证人”。这意味着可以出现两种例外情况:一是特定情形下，经过法院的同意，被告可以收集;另一种情形是在诉讼过程中，被告行政机关可以要求除“原告和证人”之外的人，如作出具体行政行为的个人补充作出具体行政行为的证据。XX是答辩人换发林权证工作组成员，因此，其个人补充的证明材料可以作为答辩人作出具体行政行为的证据。 (2)根据《行政诉讼法解释》第28条第二款规定:“有下列情形之一的，被告经法院准许可以补充相关的证据:„„(二)原告或者第三人在诉讼过程中，提出了其在被告实施行政行为过程中没有提出的反驳理由或者证据的。„„”而被答辩人在XX岛试验区给答辩人实施换发证的具体行政行为过程中没有提出《关于XX村XX地争议的上述书》的证据。因此，XX岛试验区有理由可以补充相关的证据，即《XX镇政府办公室证明》。且被答辩人所提交的《关于调低村XX地争议的上述书》证据中没有镇政府的收件回执，足以证明被答辩人根本没有向XX镇政府提交任何关于本案土地争议的材料。 intensive development. Dvn group in the upper reaches of the jinsha River along the river continues to the East to South stream groups, layout along the city's main commercial, business, administrative, cultural and creative research and development in science and education function of modern service and port equipment manufacturing, liquor, and other features and modern industry. 2.5-2 spatial planning figure 2.6 in Yibin city, Central City urban development vision vision 五、被答辩人主张的撤销东林证字(2004)第01234号《林权证》已过法定时效，其请求依法应予驳回。 《最高人民法院关于执行<中华人民共和国行政诉讼法》若干问题的解释》(下称《行政诉讼法解释》)第四十一条:“行政机关作出具体行政行为时，未告知公民、法人或者其他组织诉权或者起诉期限的，起诉期限从公民、法人或者其他组织知道或者应当知道诉权或者起诉期限之日起计算，但从知道或者应当知道具体行政行为内容之日起最长不得超过2年。”根据该规定，行政机关作出具体行政行为时，未告知诉权或起诉期限的，应为两年。2004年东海岛试验区根据2002年省政府关于《广东省林地林权登记换发工作方案》的规定及《XX林地林权登记处换发证操作办法》的规定，在1982年湛江市人民政府颁发的山权林权证的基础上对答辩人土相村“XX(旧称XX园)”、“XX(旧称X园)”、“XX(旧称XX)”等林地换发《林权证》。在作出换发证的具体行政行为中，东海岛试验区依《XX林地林权登记处换发证操作办法》的规定，于2004年3月10日，由东海岛试验区换发证工作组成员XX\X将填写有“XX”、“XX”、“XX”林地所有权权利人为土相村的《林地林权登记公示表》粘贴于相邻各村，公告期为30天。因此，应视为被答辩人应当至2004年4月10日止知道到XX岛试验区作出的具体行政行为的内容。然而，被答辩人对XX岛试验区作出的具体行政行为不服，应以2006年4月10号之前向法院提起行政诉讼。但被答辩人2007年12月27日才向麻章区法院提起行政诉讼。已过法定的起诉期限，且无正当理由。因此根据《行政诉讼法intensive development.
