南京市城市道路设施管理条例（Nanjingcityroadfacilitiesmanagementregulations）Thestandingcommitteeofnanjingmunicipalpeople'scongress19941230(dateofpromulgation)19950401(implementationtime)Nanjingcityroadfacilitiesmanagementregulations(onSeptember29,1994,jiangsuprovince,nanjing11sessionofthetenthpeople'scongressstandingcommitteemeetingsetonDecember30,1994,jiangsuprovince,theeighthsessionofthe12thmeetingofthestandingcommitteeofthepeople'scongressforapprovaltotakeeffectonApril1,1995)ChapterIgeneralprovisionsChapteriioccupationmanagementChapteriiiminingmanagementChapterivmaintenancemanagementChaptervlegalresponsibilityChaptervisupplementaryprovisionsChapterIgeneralprovisionsArticle1inordertostrengthenthemanagementoftheurbanroadfacilities,givefullplaytoitsfunction,promotetheeconomicandsocialdevelopment,accordingtotherelevantlawsandregulations,combinedwiththeactual,theseregulationsareformulated.Article2theseregulationsshallapplytourbanroadfacilitieswithintheadministrativeregionofthismunicipality.ExceptforpublicSpacesinurbanroadfacilities.Urbanroadfacilitiesintheseregulationsmeansthecityroadplanningredlinewithinthescopeoftheroadway,sidewalks,isolationbelt,square,Bridges,tunnels,highways,pedestrianoverpass,undergroundpassageandaffiliatedmunicipalfacilities,etc.Article3themunicipalpublicadministrationbureauofnanjingmunicipalityistheadministrativedepartmentofthecity'surbanroadfacilitiesandisresponsiblefortheadministration,maintenanceandsupervisionofurbanroadfacilitiesinthismunicipality.Theadministrativedepartmentsofurbanroadfacilitiesinthedistrictsandcountiesshallberesponsibleforthemanagementandmaintenanceofurbanroadfacilitiesaccordingtotheprescribedscopeanddivisionoflabor.Thedepartmentsofconstruction,planning,publicsecurity,industrialandcommercialadministration,gardens,landandrespectivetheirofscopethewithinshall,capacitymunicipalfunctionsandresponsibilities,worktogetherwiththecompetentauthoritiestomanagetheurbanroadfacilities.Article4theconstruction,renovationandmaintenanceofurbanroadfacilitiesshallbeinaccordancewiththeoverallplanofthecity,reasonablelayoutandsupportingimplementation.Newconstruction,reconstructionandexpansionofurbanroadfacilitiesshouldstrictlyimplementconstructionproceduresandqualitystandards,adheretotheprinciplesofundergroundandpost-earth,andplanandcoordinatetheconstruction.Withinthreemonthsafterthecompletionoftheurbanroadfacilitiesproject,theconstructionunitshalldeclareacceptanceandtransfertotheadministrativedepartmentofurbanroadfacilitiesinaccordancewiththeprovisions.Thespecialroadsconnectedwithurbanroads,whichmeetthestandardsofurbanroads,canbetransferredtotheadministrativedepartmentofurbanroadfacilitiesformanagementandmaintenance.Article5anyunitandindividualshallhavetheobligationtoprotecttheurbanroadfacilitiesandshallhavetherighttoreportandprosecuteanyviolationsoftheseregulations.Unitsandindividualswhohavemadeoutstandingachievementsintheprotectionofurbanroadfacilitiesshallbecommendedorrewardedbytheadministrativedepartmentofurbanroadfacilities.ChapteriioccupationmanagementArticle6nounitorindividualshallarbitrarilyoccupytheurbanroadfacilities.Isreallynecessary,thetemporaryoccupationshallapplytothecompetentadministrativedepartmentforurbanroadfacilities,andwiththeapprovalofthepublicsecuritytrafficmanagementdepartmentforexaminationandapproval,gothroughtheformalitiesforexaminationandapprovalofappropriateurbanroadfacilities,payZhanDaoFei,theurbanroadoccupancylicence.Areaofurbanroadfacilitiesthecompetentadministrativedepartmentforreviewbythemunicipalurbanroadfacilitiesdesignatedbytheadministrativedepartmentoftheimportantsectionsandregulationstemporaryoccupationareaoftheurbanroadfacilities,shallbesubmittedtothemunicipaladministrativedepartmentofcityroadfacilitiesforapproval.Article7thefollowingareasarestrictlyprohibited:(1)thebridgedeckandthelocationthatisdangeroustotraffic;(2)busstation;(3)gatevalves,inspectionWells,rainwaterWells,welluseandoperationrangesofundergroundpipelines.Article8thefollowingconstructionprojectsduetotheneedofconstructionoftemporaryoccupationofurbanroadfacilities,constructionunitsandindividualsshallholdaconstructionprojectplanningpermit,applyfortodealwithformalitiesoftemporaryoccupyurbanroadfacilities:(1)construction,reconstructionorexpansionofmunicipalprojects;(2)buildingnew,rebuildingandexpandinghousesalongthestreet;(3)miningprojectsbeyondthescopeofexcavationapproval.Article9.Strictlycontroltheoccupationofurbanroadfacilitiestosetupvariousmarkets.Ifnecessary,itshallbesubmittedtothemunicipalpeople'sgovernmentforapprovalaftertheexaminationandapprovaloftheadministrativedepartmentofurbanroadfacilitiesandthepublicsecuritytrafficmanagementdepartment.Theurbanroadfacilitiesshallbeusedfortheestablishmentandoperationofkiosks,advertisements,signsandpavilions,andtheproceduresforthetemporaryoccupancyofurbanroadfacilitiesshallbedealtwith,andotherproceduresshallbedealtwith.Article10strictlycontroltheuseofurbanroadfacilitiestosetupvariousparkingSpaces.Ifthecityroadfacilitiesaretobeusedtosetupparkinglots,themeasuresforexaminationandapprovalandmanagementshallbeseparatelyprescribedbythemunicipalpeople'sgovernment.Article11strictlycontrolthetemporaryoccupationofpavements.Thetemporaryoccupationofpavementsshallnotbemorethanhalfofthewidthofthesidewalk,anditshallbemorethanonemeterwidetoensurethesafetyofpedestrians.Themaintenanceandmaintenanceofroadworksinurbanroadfacilitiesshallnotexceedtheroadsurfaceandthe1.5mwidesurfaceoftheroadbetweenthedesignatedsafeisland.Article12thetemporaryoccupyurbanroadfacilities,unitsandindividualsshall,inaccordancewiththeapprovedscopeandtime,shallnotalteroccupancy,expandingthescopeofthefootprint,andextendtheelapsedtime,arenotallowedtoberenttransfer.Duringtheperiodofoccupationduetotheneedforurbanconstruction,theoccupyingunitsandindividualsshallpromptlydismantleallkindsofbuildingsandfacilitiesthatoccupytheurbanroadfacilities.Article13nooccupationunitorindividualmaydamagetheurbanroadfacilities.Anyunitorindividualthatdamagestheurbanroadfacilitiesshallbeliableforcompensation.Thesitemustbekeptinafenceorpartitionandkeptclean.Donotprefabricatecementproducts,mixingmortarandrinsinggravelintheoccupationarea.Article14theexpirationoftemporaryoccupyurbanroadfacilities,takeuptheunitsandindividualsshallbeatthesceneoftheoccupancyperiodtoclear,submittedtothecompetentadministrativedepartmentforurbanroadfacilitiesandpublicsecuritytrafficmanagementdepartmenttoacceptance,handincityroadoccupancylicence.Article15ZhanDaoFeiinaccordancewiththestandardapprovedbyprovincefinance,commoditypricedepartment,administrativedepartmentbythemunicipalurbanroadfacilitiesunifiedcollectionandimplementfiscalrevenuestorage,usedinurbanroadfacilitiesmaintenance,maintenanceandmanagement.ChapteriiiminingmanagementArticle16theconstructionunitsandindividualsneedtoexcavateurbanroadfacilities,andrelateddrawingsshallholdaconstructionprojectplanningpermit,applytothecompetentadministrativedepartmentforurbanroadfacilities,gothroughtheformalitiesforexaminationandapprovalofurbanroadfacilities,mining,payrepairfees,andafterapprovalbythepublicsecuritytrafficmanagementdepartment,tothecompetentadministrativedepartmentforurbanroadfacilitiesforurbanroadmininglicense,beforeconstruction.Districturbanroadfacilitiesthecompetentadministrativedepartmentforreviewbythemunicipalurbanroadfacilitiesdesignatedbytheadministrativedepartmentoftheimportantsectionsandprescribedscopeofurbanroadfacilitiesofdigging,andacrosstheprimaryandsecondarytrunkroadexcavation,shallbesubmittedtothemunicipaladministrativedepartmentofcityroadfacilitiesforapproval.Toexcavateandrepairtherecoveryfeetoimplementthechargingstandardsetbytheadministrativedepartmentofprovincialconstruction.Article17theroadswithinfiveyearsofthenewconstructionorreconstructionofurbanroads,andtheconstructionofalargescaleconstructionroadwithinthreeyears,aswellastheroadofcementconcretemotorvehiclesshallnotbeexcavated.Iftheexcavationisindeedrequired,itshallbesubmittedtothemunicipalpeople'sgovernmentforapprovalaftertheexaminationandapprovaloftheadministrativedepartmentofurbanroadfacilitiesandthepublicsecuritytrafficmanagementdepartment,andshallbechargedfortherecoveryof1to3times.Article18electricpower,telecom,gas,water,drainage,streetlamps,etcundergroundpipelineburiedengineeringconstructionunit,shallbesubmittedtothecompetentadministrativedepartmentforconstruction,planning,urbanroadfacilitiesandpublicsecuritytrafficmanagementdepartmenttosubmittheannualimplementationplan.Themaintenanceandmaintenanceunitsofurbanroadfacilitiesshallsubmittheirmonthlymaintenanceplanstotheadministrativedepartmentsofurbanroadfacilitiesandthepublicsecuritytrafficmanagementdepartments.Theconstructionunitsofthehighrisebuildingsalongthestreetshallsubmittheplansforthecomprehensiveimplementationofpipelineprojectconstructiontotheadministrativedepartmentsofurbanroadfacilitiesandthepublicsecuritytrafficmanagementdepartments.Iftheundergroundpipelinefailstotakeemergencyrepair,itmayberepairedinadvance,buttheexaminationandapprovalproceduresfortheurbanroadfacilitiesshallbecompletedwithin24hours.Article19miningunitsandindividualsshall,inaccordancewiththescopeandtimeofapproval,makeconstructionworkandshallnotarbitrarilyexpandthescopeofexcavationandextendtheexcavationtime.Article20theapprovedexcavationworksshallnotobstructtrafficandshallcomplywiththefollowingprovisions:(1)undergroundpipelinesshallbeconstructedinthetopofthepipe,andtheconstructionshallnotbecoveredbythepipe.(2)toexcavatetheconstructionsite,setupsafetysignsandprotectivecontainmentfacilities,andkeepthesitecleanandtidy;(3)incaseofanyconflictbetweentheexcavationandotherundergroundfacilities,theconstructionshallbestoppedimmediatelyandshallbereportedtotherelevantdepartments;(4)thebackfillingearthworkshouldbecompactedinaccordancewiththeregulations,andthemain,secondarytrunkroadandtheroadcrossingroadtodigtrenchshallbereturnedwithfinestonematerialstoensurethequality;(5)theexcavationofasphaltconcretepavementofcementconcretepavementandmainandsecondaryhighwaysshallbecutwithmachinetoolsandgroovededges;(6)theexcavationandrestorationofthemainroadsurfaceshallbecompletedwithinfivedays,andtherestorationofotherroadsshallbecompletedwithinsevendays.Article21theexcavationiscompleted,shouldcleanupthesceneatthesametime,reporttothecompetentadministrativedepartmentforurbanroadfacilitiesandpublicsecuritytrafficmanagementdepartmenttoacceptance,handincityroadmininglicense.ChapterivmaintenancemanagementArticle22theurbanroadfacilitiesmaintenancemaintenanceunitsshall,inaccordancewiththenational,provincialroadbridgemaintenanceproceduresandtechnicalstandardsissuedbytheroutinemaintenance,toensuretheurbanroadfacilitiesingoodcondition.Article23thefollowingACTSareprohibitedwithinthelimitsofurbanroadfacilities:(1)todischargecorrosivesewageintotheroadsurfaceandtoconductvariousoperationsonpavementthatareharmfultotheroadsurface;(2)parkinganddrivingmotorvehiclesonthesidewalkwithoutauthorization;(3)testthebrakesonnon-designatedroadsectionswithoutauthorization;Takingupthebridgewithoutauthorization.Withinthescopeofsafetyprotectionofthebridge,nopipelineorexcavationshallbeallowed.Article24theneedbycaterpillarvehiclesonurbanroadfacilities,ChaoChongCheandotherbeneaththeroadmachinery,shallbesubmittedtotheurbanroadfacilitiesapplyadministrativedepartmentsandthepublicsecuritytrafficmanagementdepartment,afterapprovedandtakeprotectivemeasures,accordingtothespecifictimeandroute.Article25theresidentialdistrictconstruction,realestatedevelopmentneedsforurbanroadfacilities,theconstructionunitshallpayforthesameareaoftheroad,unabletomakeuptheroadarea,shallpaythecompensationtothecompetentadministrativedepartmentforurbanroadfacilities.Article26theroadsbuiltinthecity,shall,inaccordancewiththestandardbythetransportdepartmentofthecityroadandurbanconstructiondepartment,andhandedovertothecompetentadministrativedepartmentforurbanroadfacilitiesmaintenanceandmanagement.ChaptervlegalresponsibilityArticle27forviolationoftheseregulations,thecompetentdependingfacilitiesroadurbanfordepartmentadministrativeontheseriousness,shallbeorderedtoshutdown,ordereddeadlinetocorrect,confiscationofmachinesandtoolsthatengageinillegalactivities,finesandotherpenalties.Theadministrativedepartmentofurbanroadfacilitiesshallissueareceiptforconfiscationoffinesandconfiscationofillegalproceeds.Thefinesshallbehandedovertothefinancialdepartment.Article28violationoftheprovisionsofarticle7andarticle8,article9ofthesecondparagraphofarticle11,article12,thefirstparagraph(4)ofarticle23,orderedtomakecorrectionswithinatimelimitandtheunitcanbeafineofmorethan500yuanand3000yuan,fortheindividualtoafineofmorethan200yuanand1000yuan.Article29inviolationofthethirdparagraphofarticle13oftheseregulations,theprovisionsofarticle14ofthe,shallbeorderedtomakecorrectionswithinatimelimit,andtheunitcanbeafineofmorethan500yuanand2000yuan,fortheindividualtoafineofmorethan200yuanand500yuan.Article30aviolationoftheprovisionsofparagraph1ofarticle16paragraph2ofarticle23,shallbeorderedtoshutdownorconfiscationofmachinesandtoolsthatengageinillegalactivities,andimposeafinerangingfromminingandrepair1to3times.Article31whereaviolationoftheprovisionsofarticle19ofthefirst(1)ofarticle20,thefirstitem(3),thefirstitem(4),thefirstitem(5),theprovisionsofarticle21oforderedtomakecorrectionswithinatimelimitandunitcanbeafineofmorethan1000yuanand5000yuan,toindividualsafineofmorethan500yuanto2000yuan.Article32afineoflessthan500yuanshallbeimposedforviolationoftheprovisionsofparagraph(1),item(2),item(3)andarticle24ofarticle23oftheseregulations.Article33inviolationoftheprovisionsoftheseregulations,causingtheurbanroadfacilitiesdamaged,thecompetentadministrativedepartmentforurbanroadfacilitiesinadditiontothegivenadministrativepunishment,shallhavetherighttoorderthemtorepairorcompensateforthelosses.Article34.ThepublicsecurityorgansshallpunishthosewhodamageorstealurbanroadfacilitiesbythepublicsecurityorgansinaccordancewiththerelevantprovisionsoftheregulationsontheadministrationofpublicsecurityofthePeople'sRepublicofChina.Ifacrimeisconstituted,criminalresponsibilityshallbeinvestigatedinaccordancewiththelaw.Article35whereacityroadfacilitymanagerabuseshispower,neglectshisdutyorengagesinmalpracticesforpersonalgain,heshallbegivenanadministrativesanctionbyhisunitorthecompetentdepartmentatahigherlevel.Ifacrimeisconstituted,criminalresponsibilityshallbeinvestigatedinaccordancewiththelaw.Article36ifanypartyconcernedrefusestoaccepttheadministrativepunishmentdecision,inaccordancewiththeregulationsontheadministrativereconsiderationandtherelevantregulationsoftheadministrativeprocedurelawofthePeople'sRepublicofChinatoapplyforreviewortolodgeacomplaint.Ifapartyfailstoapplyforreconsiderationorbringasuitbeforeapeople'scourt,andfailstocarryoutthepunishmentdecision,theorganthatmadethedecisionshallapplytothepeople'scourtforcompulsoryexecution.ChaptervisupplementaryprovisionsArticle37theseregulationsshallbeinterpretedbythepeople'sgovernmentofnanjing.Article38theseregulationsshallcomeintoforceasofApril1,1995.Localregulations(categories)Y(logo)1(level)
