甘肃省公路管理条例 甘肃省人大常委会(颁布单位) 20110531(颁布时间) 20110801(实施时间) 甘肃省人民代表大会常务委员会公告第42号(文号) 甘肃省公路路政管理条例 第一章 总则 第二章 管理职责 第三章 路产管理 第四章 公路两侧建筑控制区管理 第五章 超限运输管理 第六章 执法监督 第七章 法律责任 第八章 附则 《甘肃省公路路政管理条例》已由甘肃省第十一届人民代表大会常务委员会第二十一次会议于2011年5月31日修订通过，现将修订后的《甘肃省公路路政管理条例》公布，自2011年8月1日起施行。 甘肃省人民代表大会常务委员会 2011年5月31日 第一章 总则 第一条 为了加强对公路的保护，提高公路管理水平，保障公路完好、安全和畅通，根据《中华人民共和国公路法》、《公路安全保护条例》等有关法律、法规，结合本省实际，制定本条例。 第二条 本省行政区域内国道、省道、县道、乡道、专用公路的公路路政管理，适用本条例。 本条例所称公路路政管理，是指为保障公路完好、安全和畅通，依法保护公路、公路用地及公路附属设施，管理公路两侧建筑控制区的行政行为。 《甘肃省高速公路管理条例》对高速公路路政管理另有规定的，从其规定。 第三条 公路路政管理实行统一管理、分级负责、综合治理的原则。 省人民政府交通运输主管部门主管全省公路路政管理工作。各级公路管理机构负责各自管辖路段的路政管理工作。专用公路的路政管理工作由专用单位负责。 各级公安、国土资源、规划、建设、林业、工商、质监等部门，依照各自职责，配合公路管理机构做好路政管理工作。 第四条 公路管理机构应当依法履行职责，做好公路保护工作，完善公路服务设施，提高公路服务和管理水平，维护公路经常处于良好的技术状态，保障公路完好、安全和畅通。 第五条 公路受国家保护，任何单位和个人不得破坏、损坏或者非法占用公路、公路用地及公路附属设施。 任何单位和个人都有爱护公路、公路用地及公路附属设施的义务，有权检举和控告破坏、损坏公路、公路用地、公路附属设施和影响公路安全的行为。 第二章 管理职责 第六条 公路管理机构的路政管理职责是: (一)宣传、贯彻公路路政管理的法律、法规; (二)管理和保护公路路产; (三)实施公路路政巡查，依法查处违反路政管理的违法行为; (四)维护公路养护、施工作业的正常秩序; require blasting construction area against adjacent building, slope affected, set the influence of blasting vibration monitoring device, and set up special full-time security staff observed at any time and make observations, area at any time to check on the job. 15.3.3 temporary power and lighting circuits (1) substations, power distribution rooms fortified Thunder, earth leakage protection, use zero system, but shall not be co-located on the same power supply system ground connection and zero connection; (2) the erection of lighting lines suspended height shall be in accordance with local requirements in the electricity sector; (3) construction site lighting line short-circuit protection, fixed and joint loads shall be according to the regulations of the local power sector; (4) portable power equipment, cables and other vehicles rolled leakage-proof; (5) electric drive wheel, wheel, flywheels and other exposed parts of protective devices. Presideix el director del projecte, cap adjunt projecte director adjunt, directors de (五)依法管理公路两侧建筑控制区，取缔违法建筑设施; (六)审批穿(跨)越公路修建设施的事项以及在公路两侧建筑控制区内埋(架)设管(杆)线的事项; (七)监督管理超过公路限载、限高、限长、限宽标准和超过载重质量的运输车辆(以下简称超限超载)及公路状况; (八)审批铁轮车、履带车和其他可能损害公路路面的机具上路行驶事项; (九)设置、维护建成公路的标志、标线; (十)负责在建公路的路政管理; (十一)法律、法规规定的其他职责。 第七条 省级公路管理机构负责许可以下事项: (一)涉及高速公路的路政许可事项; (二)跨省、市(州)的超限运输; (三)跨市(州)修建穿(跨)越公路的设施; (四)跨市(州)在公路建筑控制区内埋(架)设管(杆)线; (五)法律、法规规定的其他事项。 第八条 市(州)级公路管理机构或者省直属公路管理机构按照各自的管理范围许可以下事项: (一)在公路上设置立交、平交道口; (二)在辖区公路埋(架)设管(杆)线、修建穿(跨)越公路的设施; (三)跨县(市、区)的超限运输; (四)因国家建设确需利用、占用公路路产期限在30日以内的; (五)法律、法规规定的其他事项。 第九条 除第七条、第八条规定的情形外，其他相应的路政许可事项由县(市、区)公路管理机构或者省直属县(市、区)级公路管理机构按照各自的职责范围进行管理。 第十条 公路行道树的种植、养护、管理工作，由各级公路管理机构按照公路绿化工程技术标准统筹规划并组织实施，实行谁种植、谁管护、谁受益的原则。 第三章 路产管理 第十一条 公路管理机构应当按规定对既有公路路产进行调查核实，建立健全路产档案资料。新建公路竣工时，应当同时建立路产档案资料。 第十二条 在公路两侧边沟、截水沟、边坡、坡脚护坡道、隔离栏栅以外各不少于1米宽的土地，以及用于建设、养护公路和公路附属设施的其他土地为公路用地。 公路用地应当按照国家规定办理相关手续。 因公路改线而不再行驶车辆的旧公路，经县级以上人民政府批准，可调换公路建设用地或者改作其他公路附属设施的用地。 第十三条 在公路、公路用地范围内，禁止下列行为: (一)设置棚屋、维修、洗车、加水、加油场点和电杆、变压器及其他非公路设施; (二)打场晒粮、摆摊设点、违规设置广告牌; (三)进行集市贸易，举办物资交流会等商业性活动; (四)采矿、采石、取土、挖砂; (五)填埋、堵塞、损坏公路排水系统或者利用公路桥涵、排水沟等设施引水灌溉、排放污水、筑坝蓄水、设置闸门; (六)倾倒、堆积、抛撒、焚烧垃圾等; (七)盗窃、移动、损坏、涂改公路标志、标线及测桩、界桩、护栏、花草树木等公路附属设施; require blasting construction area against adjacent building, slope affected, set the influence of blasting vibration monitoring device, and set up special full-time security staff observed at any time and make observations, area at any time to check on the job. 15.3.3 temporary power and lighting circuits (1) substations, power distribution rooms fortified Thunder, earth leakage protection, use zero system, but shall not be co-located on the same power supply system ground connection and zero connection; (2) the erection of lighting lines suspended height shall be in accordance with local requirements in the electricity sector; (3) construction site lighting line short-circuit protection, fixed and joint loads shall be according to the regulations of the local power sector; (4) portable power equipment, cables and other vehicles rolled leakage-proof; (5) electric drive wheel, wheel, flywheels and other exposed parts of protective devices. Presideix el director del projecte, cap adjunt projecte director adjunt, directors de (八)铺设妨碍公路安全畅通的空中或者地下管线; (九)其他侵占、破坏、损坏、盗窃、迁移、污染公路路产的行为。 第十四条 在封闭收费公路上，禁止下列行为: (一)设置平交道口; (二)铁轮车、履带车、未封闭的垃圾车、拖拉机和非机动车辆等行驶; (三)冲闯站(卡)、拒绝缴费。 第十五条 在大、中型公路桥梁和渡口的周围200米，小型桥梁的周围50米，公路隧道上方和洞口外100米范围内，禁止下列行为: (一)采挖砂石、淘金、开矿、修筑堤坝，压缩或者拓宽河床、烧荒、刷坡、爆破、取土、伐木及其他类似行为; (二)倾倒垃圾、污物，堆放物品、停放装载危险品的车辆以及其他类似活动; (三)铺设输送易燃、易爆、易漏和有毒物品的管道及其他妨碍公路桥梁、渡口、隧道安全畅通的行为。 第十六条 禁止乱砍滥伐和损坏公路行道树;禁止利用公路行道树架设电线、悬挂各种标牌。 需要更新采伐公路行道树的，应当向公路管理机构提出申请，经批准方可更新采伐，并及时补栽;不能及时补栽的，应当缴纳补栽所需费用，由公路管理机构代为补栽。 第十七条 因修建铁路、机场、通信设施、水利工程、油气管线和进行其他建设工程需要占用、挖掘公路或者使公路改线的，建设单位应当事先征得公路管理机构同意;影响交通安全的，还须征得公安交通安全管理部门同意。 占用、利用、挖掘公路或者使公路改线的，建设单位应当按照不低于该段公路原有的技术标准予以修复、改建或者给予相应的经济补偿。 第十八条 修建穿(跨)越公路的各种桥梁、渡槽、管线、牌楼等设施，须经公路管理机构同意;影响交通安全的，还需征得公安交通安全管理部门同意。 第十九条 在公路上不得擅自增设交叉道口。确需设置的，须经公路管理机构批准，并应当符合国家规定的公路技术标准。 第二十条 除农业机械因当地田间作业需要在公路上短距离行驶外，铁轮车、履带车和其他可能损害公路路面的机具，不得在公路上行驶。确需通行的，须经公路管理机构同意，采取有效的保护措施，并按照公安交通安全管理部门指定的时间、路线行驶;对公路造成损坏的，应当按照损坏程度给予补偿。 第二十一条 运输散装货物车辆应当 规范 编程规范下载gsp规范下载钢格栅规范下载警徽规范下载建设厅规范下载 装载，采取防护措施，装载货物不得触地拖行、抛撒或者滴漏。 车辆需要在公路上进行临时检修等作业的，应当采取安全保护措施，不得损坏、污染公路。 任何单位和个人不得将公路作为检验机动车制动性能的试车场地。 第二十二条 通过公路渡口的一切车辆和人员，应当遵守公路渡口管理规定。 第二十三条 在公路施工和养护时，应当保障车辆通行，并设置明显的安全警示标志。如需中断交通或绕道通行的，须经公路管理机构和公安交通安全管理部门批准，采取保证车辆安全通行的措施，并发布通告。 施工单位施工作业完毕，应当及时清除公路上的障碍物，消除安全隐患。 第二十四条 未经省人民政府批准，任何单位和个人不得在公路上擅自设置检查及收费站(卡)。 经批准设立的站(卡)，应当按照规定期限、标准收费，禁止擅自延长收费期限，提高收费标准。 过往车辆通过批准设立的站(卡)，应当按规定缴纳通行费，接受相关检查。 第二十五条 公安交通安全管理部门在处理交通事故时，对涉及损坏公路路产的，应当通知require blasting construction area against adjacent building, slope affected, set the influence of blasting vibration monitoring device, and set up special full-time security staff observed at any time and make observations, area at any time to check on the job. 15.3.3 temporary power and lighting circuits (1) substations, power distribution rooms fortified Thunder, earth leakage protection, use zero system, but shall not be co-located on the same power supply system ground connection and zero connection; (2) the erection of lighting lines suspended height shall be in accordance with local requirements in the electricity sector; (3) construction site lighting line short-circuit protection, fixed and joint loads shall be according to the regulations of the local power sector; (4) portable power equipment, cables and other vehicles rolled leakage-proof; (5) electric drive wheel, wheel, flywheels and other exposed parts of protective devices. Presideix el director del projecte, cap adjunt projecte director adjunt, directors de 并配合公路管理机构及时调查取证，按有关规定做出赔偿处理。 第四章 公路两侧建筑控制区管理 第二十六条 公路两侧建筑控制区，是指公路用地外缘向外一定距离内，除公路防护、养护需要外，禁止修建建筑物和地面构筑物的范围。 建筑控制区的具体范围:国道不少于20米，省道不少于15米，县道不少于10米，乡道不少于5米。其中:高速公路、一级公路和封闭的二级公路不少于30米，立交桥、通道不少于50米。 第二十七条 在公路弯道内侧和平交道口附近修建建筑物，其距离必须依照国家相关规定满足行车视距或者改作立体交叉的需要。在建筑控制区以外修建的建筑物，不得在空中伸入控制区界限内，不得遮挡公路标志，妨碍安全视距。 第二十八条 在公路两侧建筑控制区内不得开山炸石、采矿、取土;不得填埋公路路基、边坡;矿井不得穿越公路。在公路两侧建筑控制区外实施上述行为的，不得危及公路安全。 第二十九条 新建、改建公路在建设期内，两侧建筑控制区由公路管理机构按照本条例第二十六条的规定进行管理。 第三十条 各级人民政府规划、城建、国土资源等有关部门，在编制城市、村镇规划，审批建设项目、征用土地时，涉及公路路政管理的，依照本条例第二十六条、第二十七条的规定办理。 第三十一条 在公路两侧建筑控制区内，设置各种广告牌、招商牌等非公路标志牌，应当经公路管理机构批准。 第三十二条 因公路建设或者交通安全等原因需要拆除建筑控制区内既有合法建筑物、地面构筑物的，应当依法给予补偿。对公路建设及交通安全无影响的，可以保留，但不得扩大占地面积和建筑面积。 第五章 超限运输管理 第三十三条 在公路上行驶的车辆的车货总质量、轴载质量及车货总长度、总宽度、总高度，不得超过国家规定的最高限值。 第三十四条 车辆因运输不可解体物品，确需超过规定最高限值行驶的，应当事先经公路管理机构批准。公路管理机构接到申请后，应当对拟经路线进行勘测，计算公路、桥梁承载能力，需要采取加固、改造措施的，可与申请人签订有关 协议 离婚协议模板下载合伙人协议 下载渠道分销协议免费下载敬业协议下载授课协议下载 ，制定通行与加固、改造 方案 气瓶 现场处置方案 .pdf气瓶 现场处置方案 .doc见习基地管理方案.doc关于群访事件的化解方案建筑工地扬尘治理专项方案下载 。公路加固、改造、护送以及修复损坏公路所需的费用，由申请人承担。 公路管理机构批准超限运输的，应当核发超限运输通行证;必要时，由公路管理机构监护其通行。 经批准的超限运输车辆应当按照指定的时间、路线、速度行驶，并悬挂明显标志。 第三十五条 经省人民政府批准，公路管理机构可以在公路上设置固定式超限运输 检测 工程第三方检测合同工程防雷检测合同植筋拉拔检测方案传感器技术课后答案检测机构通用要求培训 站(点)，对车辆的车货总质量、轴载质量及车货总长度、总宽度、总高度进行检测。 公路管理机构可以根据实际需要，依托固定式超限运输检测站(点)，设置流动式超限运输检测点。 第三十六条 公路路政管理人员检查超限运输车辆时，应当保证公路安全畅通。被检查人员应当配合接受检查，对拒不接受检查、堵塞超限运输检测站通行车道的，由公路管理机构强制拖离或扣留车辆，拖离费用由当事人承担。 第三十七条 对拉运可卸载物品的超限运输车辆，公路管理机构应当责令其在指定地点或不影响公路畅通的地点，自行卸载至符合轴载质量及其他限值，消除违法状态并接受处理后，方可上路行驶。对拉运不可解体物品的违法超限运输车辆，应当责令其立即停驶，按照第三十四条的规定补办相关手续并接受处理后，方可上路行驶。 第三十八条 各级公安交通安全管理部门应当依据其治理超限超载职责，与各级公路管理机require blasting construction area against adjacent building, slope affected, set the influence of blasting vibration monitoring device, and set up special full-time security staff observed at any time and make observations, area at any time to check on the job. 15.3.3 temporary power and lighting circuits (1) substations, power distribution rooms fortified Thunder, earth leakage protection, use zero system, but shall not be co-located on the same power supply system ground connection and zero connection; (2) the erection of lighting lines suspended height shall be in accordance with local requirements in the electricity sector; (3) construction site lighting line short-circuit protection, fixed and joint loads shall be according to the regulations of the local power sector; (4) portable power equipment, cables and other vehicles rolled leakage-proof; (5) electric drive wheel, wheel, flywheels and other exposed parts of protective devices. Presideix el director del projecte, cap adjunt projecte director adjunt, directors de 构建立健全路面执法协作和联合治理超限超载机制，配合维护治超检测站(点)的交通及治安秩序，加大路面执法力度，共同做好治理超限超载工作。 第六章 执法监督 第三十九条 交通运输主管部门应当加强对公路路政管理工作的监督指导，依法对各级公路管理机构执行法律、法规的情况进行监督检查。 第四十条 公路管理机构应当规范执法行为，设置便民设施，完善服务措施，提高办事效率和服务水平。 第四十一条 公路管理机构应当建立公路路政管理举报 制度 关于办公室下班关闭电源制度矿山事故隐患举报和奖励制度制度下载人事管理制度doc盘点制度下载 ，公开举报电话、通信地址、电子邮件信箱。 公路管理机构收到举报后，应当依法处理，对检举属实的举报单位和个人可予以奖励。 第四十二条 公路路政管理人员执行公务时，应当着标志服装，出示省人民政府统一制发的行政执法证件。 公路监督检查车辆应当按省交通运输主管部门的规定设置统一的标志和示警灯。 公路监督检查车辆在辖区收费公路执行公务时免费通行。 第四十三条 公路路政管理人员执行公务时，不得有下列行为: (一)无行政执法证件执法、越权执法; (二)擅自改变收费、罚款范围和标准; (三)收费、罚款不出具有效票据; (四)违规使用执法车辆、示警标志; (五)刁难、勒索行政相对人; (六)强制提供有偿服务; (七)其他违法行为。 第四十四条 公路路政管理人员履行管理职责时，有权向有关单位和个人了解情况，查阅、复制有关资料，相关单位和个人应当如实提供有关资料或者说明情况。 第七章 法律责任 第四十五条 违反本条例第十三条、第十四条第(一)项、第十五条、第二十一条规定的，公路管理机构应当责令其停止违法行为、限期改正，没收从事违法活动的工具。未造成公路路产损失的，可以处一千元以下罚款;已造成公路路产损失的，可以处一千元以上五千元以下罚款。 第四十六条 违反本条例第十四条第(二)、(三)项、第二十四条第三款规定影响公路畅通的车辆，由公路管理机构强制拖离现场，责令其补办有关手续，可以处二万元以下罚款，产生的相关费用由当事人承担。 第四十七条 违反本条例第十六条第一款规定乱砍滥伐和损坏公路行道树的，由公路管理机构责令补栽，没收非法所得，并处盗伐、损坏林木价值三倍以上五倍以下罚款;构成犯罪的，依法追究刑事责任。 第四十八条 有下列违法行为之一的，由公路管理机构责令停止违法行为，可以处二万元以下罚款: (一)违反本条例第十七条第一款规定，擅自占用、利用、挖掘公路或者使公路改线的; (二)违反本条例第十八条规定，未经同意修建桥梁、隧道、渡槽、牌楼等设施的; (三)违反本条例第十九条规定，未经批准或者未按照国家规定的公路技术标准增设交叉道口的; (四)违反本条例第二十条规定，铁轮车、履带车和其他损害路面的机具擅自在公路上行驶的; (五)违反本条例第二十八条规定，在公路两侧建筑控制区内开山炸石、采矿、取土，填埋require blasting construction area against adjacent building, slope affected, set the influence of blasting vibration monitoring device, and set up special full-time security staff observed at any time and make observations, area at any time to check on the job. 15.3.3 temporary power and lighting circuits (1) substations, power distribution rooms fortified Thunder, earth leakage protection, use zero system, but shall not be co-located on the same power supply system ground connection and zero connection; (2) the erection of lighting lines suspended height shall be in accordance with local requirements in the electricity sector; (3) construction site lighting line short-circuit protection, fixed and joint loads shall be according to the regulations of the local power sector; (4) portable power equipment, cables and other vehicles rolled leakage-proof; (5) electric drive wheel, wheel, flywheels and other exposed parts of protective devices.
