RightsandRequirementsofOracleProgramLicensesOracle程序许可权利与限制ItistheresponsibilityofOracle’sauthorizeddistributionPartnerspecifiedinthisProgramUseNotification(“PUN”)toensurethatanydistributionofOracleprogramsand/orprogramrelatedserviceofferingstoanenduser,includingyouastheidentifiedCustomerinthisPUN(the“enduser”),issubjecttoalegallybindingenduserlicenseagreementincorporatingtherequirementsbelowataminimum.本程序使用通知（“PUN”）文首所列Oracle授权分销商合作伙伴有义务保证：任何向最终用户（包括PUN种指明为客户的贵方，“最终用户”）分销Oracle程序及/或程序相关服务均应受制于有法律约束力的最终用户许可 协议 离婚协议模板下载合伙人协议 下载渠道分销协议免费下载敬业协议下载授课协议下载 ，该最终用户许可协议至少应包含以下要求：（1）Limittheuseoftheprogramsthataresubjecttotheenduserlicenseagreementtothelegalentitythatexecutedtheenduserlicenseagreement.使用程序应遵守最终用户许可协议的规定，且仅签署最终用户许可协议的法律实体有权使用程序。（2）Restricttheuseoftheprogramstotheinternalbusinessoperationsoftheusersubjecttothetermsoftheenduserlicenseagreement,includingthelicensedefinitionandrulessetforthintheorderandprogramdocumentation,andthePartnerOrderingPolicy.Theendusermayallowitsagentsandcontractors(including,withoutlimitation,outsourcer)tousetheprogramfortheenduser’sinternalbusinessoperationsubjecttothetermsofsuchagreement,providethatsuchenduserisresponsiblefortheagent’s,contractor’sandcontractor’scompliancewiththeenduserlicenseagreementinsuchuse.Forprogramsthatarespecificallydesignedtoallowtheenduser’scustomersandsupplierstointeractwiththeenduserinthefurtheranceoftheenduser’sinternalbusinessoperation,suchusemaybeallowedundertheenduserlicenseagreement.Oracle’slicensedefinitionsandrulesaresubjecttochange.仅限为最终用户的内部业务运营之目的的使用程序，且应受制于最终用户许可协议的约束，包括订购文件及程序说明书中列出的许可定义和规则，以及合作伙伴订购政策。最终用户可允许其代理和 合同 劳动合同范本免费下载装修合同范本免费下载租赁合同免费下载房屋买卖合同下载劳务合同范本下载 工（包括但不限于外包商）为最终用户内部业务运营之目的使用程序，但是用应遵守最终用户许可协议的约定，且最终用户应对该等代理、分包商及外包商任何违反最终用户许可协议的行为承担责任。对特别设计以使最终用户的客户和供应商可与最终用户进行互动以促进最终用户的内部业务运营的程序，最终用户许可协议项下可允许该等使用。Oracle的许可定义和规则可能会不时修改。（3）StatethatOracleoritslicensorretainsallownershipandintellectualpropertyrightstotheprograms.说明Oracle及其许可方保留程序的一切所有权和知识产权。（4）StatethatOracleprogramsmaycontainorrequiretheuseofthirdpartytechnologythatisprovidedwithsuchOracleprograms.Oraclemayprovidecertainnoticestotheenduserinprogramdocumentation,”readme”files,noticefilesortheinstallationdetailsinconnectionwithsuchthirdpartytechnology.Thirdpartytechnologywillbelicensedtotheendusereitherunderthetermsoftheuserlicenseagreement,orifspecifiedintheprogramdocumentation,“readme”files,noticefilesortheinstallationdetails,undertheseparatelicenseterms(“separateterms”)andnotunderthetermsoftheendoftheenduserlicenseagreement(separatelylicensedthirdpartytechnology”).Theenduser’srighttousesuchseparatelylicensedthirdpartytechnologyundertheseparatetermsarenotrestrictedinanymaybytheenduserlicenseagreement.However,forclarity,notwithstandingtheexistenceofanotice,thirdpartytechnologythatisnotseparatelylicensedthirdpartytechnologyshallbedeemedpartoftheOracleprogramsandislicensedtotheenduserunderthetermsoftheenduserlicenseagreement.IftheenduserispermittedundertheenduserlicenseagreementtodistributetheOracleprograms,theendusermustincludewiththedistributionallsuchnoticesandanyassociatedsourcecodeforseparatelylicensedthirdpartytechnologyasspecified,intheformandtotheextentsuchsourcecodeisprovidedbyOracle,andtheendmustdistributeseparatelylicensedthirdpartytechnologyunderseparateforterms(intheformandtheextentseparatetermsareprovidedbyOracle).Notwithstandingtheforegoing,enduser’srightstotheOracleprogramsaresolelylimitedtotherightsgrantedintheenduserlicenseagreement.说明Oracle程序可能包含或要求使用与该Oracle程序一并提供的第三方技术。Oracle可能在程序说明书、自述文件、通知或安装说明中向最终用户提供有关第三方技术的通知。第三方技术依据最终用户许可协议的条款向最终用户授予许可，或者如果在程序说明书、自述文件、通知或安装说明中予以规定，则将依据该等单独的许可条款（“单独条款”）而非最终用户许可协议条款授予最终用户许可（“单独许可的第三方技术”）。最终用户依照单独条款使用单独许可的第三方技术的权利不受最终用户许可协议的限制。然而，为明晰起见，即使有通知，但如第三方技术并非是单独许可的第三方技术，则其应被视为程序的一部分，并是根据最终用户许可协议的条款授予最终用户许可。如果最终用户根据最终用户许可协议而被允许分发程序，则最终用户必须在分发时包括所有有关单独许可的第三方技术的通知，并按照Oracle所提供的源代码的形式和范围，在分发时包括规定的单独许可的第三方技术的任何相关源代码，并且最终用户必须根据独立条款分发单独许可的第三方技术（按照Oracle提供的独立条款规定的形式和范围）。尽管有前述规定，最终用户对程序的权利仍仅限于最终用户许可协议授予的权利。
