Resolution Opposing the Georgia Annexation Plan
Whereas: It is the understanding of the County of Polk that there are locations in said county that might be under consideration of the Georgia Annexation Plan (GA HR1206, GA SR 822) which directs the formation of a Georgia-Tennessee Boundary Line Commission for the purpose of moving the Georgia State Boundary to a disputed position of the 35th parallel and
Whereas: It has been determined by the majority of Commissioners of the Polk County Legislative Body that any such boundary move in the areas of Polk County should not occur. This is based on public trust, economic impact(s) and the state of possession of such areas under the laws and regulations set forth by the Great State of Tennessee and
Whereas: The State of Georgia has failed to provide infrastructure, economic development, educational incentives, governmental controls/regulations or basic aid or assistance of such lands in Polk County, TENNESSEE and
Whereas: The State of Georgia has not made challenge to the Tennessee Election Commission or the Polk County Election Commission on votes cast in areas of Polk County that Georgia apparently feels it has claim to and furthermore has not challenged the County of Polk in any decisions that it has made in governing or funding improvements or services to these areas, all which have been done under the rules of Tennessee Law and
Whereas: The Legislative Body of Polk County, TENNESSEE does hereby believe that the actions taken by Georgia in GA HR1206 and GA SR 822 are selfish in their intent and for no other purpose than that of collecting free water from the Tennessee River and that any areas in question in Polk County, TENNESSEE are shown to be under the Possession and Control of Tennessee Law
NOW, therefore be it resolved by the County of Polk in Copperhill, TENNESSEE by the Polk County Commission meeting in regular session this Thursday, the 21st day of February, 2008 that Polk County request that TENNESSEE State Governor Phil Bredesen, TENNESSEE State Representative Eric
Watson and TENNESSEE State Senator Dewayne Bunch acknowledge that the areas in Polk County are lands that are in the Great State of Tennessee and not part of Georgia as provided by the currently recognized elections areas of said county on this date. The commission also request that since control of and care for such area is identified as being part of TENNESSEE, such area receive due protection from the state from annexation from Georgia or any other State that would try to take any property or other rights thereof.
This resolution shall take effect upon being adopted by simple majority of the county legislative body of Polk County, in the Great State of TENNESSEE, the public welfare requiring it.
