深圳市国家公务员管理办法 文号:深府令第14号 第一章 总则 第一条 为建立深圳市国家公务员(以下简称公务员) 制度 关于办公室下班关闭电源制度矿山事故隐患举报和奖励制度制度下载人事管理制度doc盘点制度下载 保证公务员队伍的优化、廉洁，形成高效的政府工作系统，根据《国家公务员暂行条例》，制定本办法。 第二条 本办法所称公务员是指深圳市各级国家行政机关中除工勤人员以外的工作人员。 第三条 公务员按本办法管理，但各级人民政府组成人员的产生和任免除外。 第四条 对公务员的管理，遵循民主、公开的原则，坚持德才兼备的用人标准。 第五条 公务员必须履行下列义务: (一)遵守宪法、法律和政纪; (二)为人民服务，联系群众，接受群众监督; (三)维护国家利益，维护政府的声誉; (四)依照国家的法律和政策执行公务; (五)忠于职守，完成本职工作任务; (六)服从领导，执行命令，保守国家秘密和工作秘密; (七)公正廉洁，实事求是; (八)宪法和法律规定的其他义务。 第六条 公务员享有下列权利: (一)获得履行职责所应有的权力和工作条件; (二)获得劳动报酬、享受保险和福利待遇; (三)参加政治理论、科学技术和业务知识培训; (四)对本单位或者上级国家行政机关及其领导人员的工作提出批评和建议; (五)非因法定事由和非经法定程序不被免职、降职、辞退或处分; (六)依据本办法提出申诉和控告; (七)依据本办法辞职; (八)宪法和法律规定的其他权利。 公务员依法执行公务，受法律保护。 第七条 公务员工资实行按劳分配原则以及职级工资制度和定期增资制度。 公务员的工资与本市国有企业相当人员平均工资水平大体持平。市人民政府根据国民经济的发展、生活费用价格指数的变动，有计划地调整公务员工资标准，不断提高公务员工资水平。 第八条 市人事 行政管理 学校行政管理制度幼儿园行政管理制度行政管理专业专科实习报告企业行政管理工作内容综合管理部行政管理手册 部门(以下简称市人事部门)是公务员管理的职能部门，负责拟定公务员 管理制度 档案管理制度下载食品安全管理制度下载三类维修管理制度下载财务管理制度免费下载安全设施管理制度下载 并组织实施;依据本办法对公务员进行综合管理;指导和监督市人民政府各部门和各区人民政府公务员管理工作;承办市人民政府对公务员管理的具体事项。 区人事行政管理部门(以下简称区人事部门)负责本区公务员的综合管理，承办区人民政府对公务员的具体管理事项。 intensive development. Dvn group in the upper reaches of the jinsha River along the river continues to the East to South stream groups, layout along the city's main commercial, business, administrative, cultural and creative research and development in science and education function of modern service and port equipment manufacturing, liquor, and other features and modern industry. 2.5-2 spatial planning figure 2.6 in Yibin city, Central City urban development vision vision 第二章 职位分类 第九条 行政机关在确定职能、机构、编制的基础上，进行职位设置和职位分析、评价，并根据职位的工作性质、难易程度、责任大小和所需资格条件等，制定职位说明书，规定每个职位的职责及任职条件，作为公务员录用、考核、晋升、交流、培训及工资待遇的依据。 第十条 公务员职务按行政领导职务和行政非领导职务两个序列设置。 行政领导职务依次为:市长，副市长，秘书长，局长、区长，副秘书长、副局长、副区长，处长、区局局长，副处长、区局副局长，科长，副科长。为为辅助行政首长工作，市、区人民政府及各所属部门可根据需要设市长助理、区长助理、局长助理。 行政非领导职务依次为:巡视员，助理巡视员，调研员，助理调研员，主任科员，副主任科员，科员，办事员。上列职务可冠以与其工作性质相符的称谓。 行政领导职务和副主任科员以上行政非领导职务，实行职数管理。 第十一条 公务员分为若干级别。公务员级别由任免机关根据其所任职务和所在职位的责任大小、工作难易程度以及公务员的工作实绩、工作经历确定。 第十二条 对从事专业技术工作的公务员，按规定条件，可申报参加全国统一资格考试，合格者可以取得相应的任职资格。 第十三条 各级人民政府工作部门因工作需要，增设、减少或者变更职位时，应当按照规定重新确定。 第三章 录 用 第十四条 本办法所称录用是指各级行政机关采用公开考试、按规定要求考核的方式，按照德才兼备的标准择优招录科级以下公务员。 第十五条 录用公务员应在编制限额内进行。市人民政府各部门和区人事部门应在每年年底将职位空缺和录用计划报送市人事部门核准，并按核准结果和录用规定招考公务员。 第十六条 录用公务员的主考机关为深圳市公务员考试委员会，批准机关为市人事部门。 第十七条 报考公务员，必须符合下列条件: (一)遵守宪法、法律和政纪，品德优良; (二)愿意履行公务员义务和遵守公务员纪律; (三)年龄在十八周岁以上、三十五周岁以下，具有与其将从事的工作所需的学历，但最低学历不得低于高中毕业;参加本办法第十八条所列乙种、丙种考试的，年龄可放宽到四十周岁以下; (四)身体健康; (五)符合市人事部门和用人单位规定的其他条件。 第十八条 录用公务员的考试方式分甲、乙、丙三种。 (一)甲种考试采用公开竞争的办法，适用于从应届毕业的大中专学生、研究生、企事业员工和社会其他人员中录用公务员; (二)乙种考试采用有限竞争的办法，适用于从本系统或在一定范围内录用公务员; (三)丙种考试采用个别选考的办法，适用于从特殊岗位的专门人才或转业军官中录用初级公务员。 intensive development. Dvn group in the upper reaches of the jinsha River along the river continues to the East to South stream groups, layout along the city's main commercial, business, administrative, cultural and creative research and development in science and education function of modern service and port equipment manufacturing, liquor, and other features and modern industry. 2.5-2 spatial planning figure 2.6 in Yibin city, Central City urban development vision vision 录用公务员一般应从本市人员中招考。确需从市外在职干部中录用的，采用乙种考试办法。 第十九条 甲种和乙种考试方法考录初级公务员应依照下列程序: (一)市人事部门发布考录公告并接受报名和进行资格审查; (二)统一进行笔试和面试; (三)用人单位对考核合格者进行考核和体格检查，提出拟录用名单并报市人事部门审批。 丙种考试方式考录公务员应依照下列程序: (一)用人单位考核; (二)市人事部门审核、面试或操作考试、录用审批。 第二十条 通过甲种考试方式录用的公务员，试用期为一年。试用期满，经考核合格的，转为正式公务员;不合格的，取消其录用资格。 第四章 考 核 第二十一条 对公务员考核应当贯彻客观、公正、民主、公开的原则，采取领导与群众相结合、定性与定量相结合、平时与定期相结合的方法。 第二十二条 市、区人事部门负责本级政府对公务员考核的日常管理。年度考核时政府各部门可设立考核委员会或者考核小组，负责本部门考核的监督，受理考核申诉。 第二十三条 依照公务员管理权限，对局级公务员的考核，采取民主评议的方式进行;对其他公务员的考核，由主管领导采取年度工作评价、鉴定的方法进行。 第二十四条 对公务员考核的内容包括德、能、勤、绩，重点考核实绩。 考核内容的具体评价、鉴定标准，由市人事部门制定。 第二十五条 对公务员的平时考核，由其主管领导按工作职责和要求定期作出评价、鉴定。 第二十六条 对公务员的年度考试以平时考核为依据，对公务员全年的德才表现、工作实绩进行综合评价、鉴定。其程序是: (一)被考核人向考核人作书面述职。其中担任行政领导职务的被考核人，应向其下属公务员公开本人的述职报告，并接受评议。 (二)考核人根据被考核人的平时表现、年度述职和评议意见，按鉴定准则要求写出考核评语，提出考核等级，征求被考核人意见。 (三)部门首长审定考核等级。 第二十七条 年度考核等级分为优秀、称职、不称职三等。 年度考核结果应 通知 关于发布提成方案的通知关于xx通知关于成立公司筹建组的通知关于红头文件的使用公开通知关于计发全勤奖的通知 被考核人，并存入被考核人档案，作为对公务员职务升降与调整、辞退、工资晋升、培训以及奖惩的依据。 第二十八条 市、区人民政府建立公务员考核奖励基金，每年由市、区财政列支。 第五章 奖 励 第二十九条 行政机关按照精神鼓励和物质鼓励相结合的原则，奖励表现突出、功绩显著的公务员。 第三十条 对公务员的奖励，分为嘉奖、记三等功、记二等功、记一等功和授予荣誉称号。 除市人民政府根据特别需要增设奖励项目外，本市的其他行政单位不得另设奖励项目。 intensive development. Dvn group in the upper reaches of the jinsha River along the river continues to the East to South stream groups, layout along the city's main commercial, business, administrative, cultural and creative research and development in science and education function of modern service and port equipment manufacturing, liquor, and other features and modern industry. 2.5-2 spatial planning figure 2.6 in Yibin city, Central City urban development vision vision 第三十一条 公务员有下列表现之一的，应给予奖励: (一)忠于职守，刻苦学习，勤奋工作，起模范作用的; (二)遵纪守法，廉洁奉公，作风正派，办事公道，事迹突出的; (三)在工作中有发明创造或者提出合理化建议，为国家取得显著经济效益和社会效益的; (四)爱护公共财产，节约国家资财有突出成绩的; (五)防止或者避免严重事故，使国家和人民群众利益免受或者减少损失的; (六)在抢险、救灾中表现突出的; (七)同违法违纪行为作斗争有功的; (八)在开创本单位工作新局同中作出重要贡献的; (九)在对外交往中，为国家赢得荣誉和利益的; (十)在其他方面取得突出成绩的。 第三十二条 奖励公务员的批准权限: (一)市人民政府各部门处级以下公务员和区人民政府部门科级以下公务员的嘉奖，由市、区人民政府各部门批准;区人民政府各部门处级公务员嘉奖，由区人民政府批准。 (二)处级以下公务员记三等功、二等功，由市人事部门批准。 (三)副局级以上公务员的奖励，由市人民政府批准。 (四)公务员记一等功，由市人民政府批准。 第三十三条 奖励公务员，一般应由所在单位或其上级行政领导提名或者民主推荐，按第三十二条规定申报批准;特殊情况下，上级机关也可以直接给予奖励。 授予公务员荣誉称号的，审批程序和奖励办法，按照国家规定办理。 第三十四条 受奖励的公务员，由授奖机关颁发奖励证书、奖章。授奖机关还可给予下列物质奖励: (一)被授予三等功以下奖励的公务员，发给一次性奖金(奖品); (二)被授予三等功两次的公务员，晋升一级工资; (三)被授予二等功以上的公务员，晋升一级工资，并发给奖金(奖品)。 第三十五条 发现奖励公务员所依据的事实严重失实，由批准机关撤销对受奖公务员的奖励决定，收回奖励证书、奖章及其他物质奖励。对弄虚作假骗取荣誉的，应当追究有关人员的责任。 第六章 纪 律 第三十六条 公务员必须严格遵守纪律，不得有下列行为: (一)组织或者参加旨在反对政府的罢工、集会、游行、示威、签名等活动，散布有损政府声誉的言论; (二)组织或者参加非法的社会团体; (三)玩忽职守，贻误工作; (四)对抗上级决定和命令; (五)不服从上级派遣; (六)压制批评，打击报复; (七)弄虚作假，欺骗领导和群众; (八)利用职权为自己和他人谋取私利; (九)经商、办企业以及参与其他营利性经营活动; (十)挥霍公款，浪费国家资财; intensive development. Dvn group in the upper reaches of the jinsha River along the river continues to the East to South stream groups, layout along the city's main commercial, business, administrative, cultural and creative research and development in science and education function of modern service and port equipment manufacturing, liquor, and other features and modern industry. 2.5-2 spatial planning figure 2.6 in Yibin city, Central City urban development vision vision (十一)滥用职权，侵犯群众利益，损害政府和人民群众的关系; (十二)泄露国家秘密和工作秘密; (十三)在外事活动中违反国家有关规定; (十四)参与或者支持色情、吸毒、迷信、赌博等活动; (十五)违反公务员职业道德和社会公德，造成不良影响; (十六)其他违法违纪行为。 对于在特殊部门和职位上任职的公务员，根据工作需要，可以制定相应的特殊纪律要求。 第三十七条 公务员有第三十六条所列违纪行为，尚未构成犯罪或者已构成犯罪但不追究刑事责任的，应当给予行政处分。违纪行为情节轻微，经过批评教育有改过表现的，可以免予行政处分。 第三十八条 行政处分分为:警告、记过、记大过、降级、撤职、开除。 第三十九条 公务员受开除处分的，不得被行政机关重新录用或聘用。受撤职处分的，视情节降职一级以上，另行安排职务，级别和工作相应降低。受降级处分的，降低一个级别，情节严重的，降低二至三个级别。 公务员受处分中涉及经济问题的，按国家有关规定处理。 公务员受处分期间不得晋职、晋级;受警告以外行政处分的，并不得晋升工资档次。 第四十条 处分公务员，必须依照法定程序，在规定的时限内做出处理决定。要根据本人所犯错误的事实、性质、情节、危害和后果，参照本人的一贯表现和对错误的认识程度，区别对待，做到事实清楚，证据确凿，处理恰当，手续完备。 第四十一条 给予公务员行政处分，依法分别由任免机关或者行政监察机关决定;其中给予开除处分的，应当报上级机关备案。 区人民政府各部门、镇人民政府开除公务员，必须报区人民政府批准。 第四十二条 对违纪公务员的处分程序: (一)所在部门调查核实当事人的违纪事实，提出处理意见; (二)按照作出行政处分决定的批准权限审批; (三)所在部门应在处分决定下达前将处分意见通过当事人，由当事人签署意见;当事人拒绝签署意见的，应当写明情况，并报由作出处分决定的机关，存入当事人档案; (四)向当事人下达处分决定并在适当范围内通报。 行政监察部门立案调查处分公务员的程序按《中华人民共和国行政监察条例》执行。 第四十三条 对有严重违纪行为、事实基本清楚、但尚有问题仍需查清暂不能作出处分决定，又不宜在现岗位继续工作或者不宜继续担任现职务的公务员，经任免机关批准，可以调整其工作岗位或暂停其公务活动。 第四十四条 公务员受处分期限分别为:警告处分半年;记过、记大过处分一年;降级、撤职处分二年。 处分期满并已改正错误，表现较好的，应予以解除处分。公务员在处分期内年度考核优秀或有特殊贡献的，可提前解除处分，但提前解除处分的期限，不得超过原处分期限的二分之一。 解除处分，应当由本人提出书面申请，经所在单位同意并经原作出处分机关批准。解除处分的决定应报送人事部门和行政监察部门备案。 intensive development. Dvn group in the upper reaches of the jinsha River along the river continues to the East to South stream groups, layout along the city's main commercial, business, administrative, cultural and creative research and development in science and education function of modern service and port equipment manufacturing, liquor, and other features and modern industry. 2.5-2 spatial planning figure 2.6 in Yibin city, Central City urban development vision vision 公务员被解除处分不能视为恢复原级别和职务，但晋升职务、级别和获得奖励等不受原处分的影响。 第七章 职务升降 第四十五条 公务员的职务晋升必须坚持德才兼备的原则，注重工作实绩。 晋升职务，必须在编制部门核定的职数限额内进行。 第四十六条 公务员晋升职务除应具备拟任职务所要求的政策水平、专业知识和工作能力外，应当符合下列条件: (一)连续三年考核称职; (二)符合任职回避规定; (三)身体健康; (四)具有所任职务所需的学历，其中晋升科级职务的，须具备高中毕业以上学历;晋升副处级以上职务的，须具备大专毕业以上学历; (五)晋升副科、副处、副局级职务的，须在下一级职务任职三年以上;晋升正科、正处、正局级职务的，须在下一级职务任职两年以上; (六)晋升副处级以上行政领导职务的，应当具有两年以上基层工作经历;其中晋升局级行政领导职务的，还应具有下一级两个以上工作岗位任职的经历; (七)晋升副处、正处、副局级行政领导职务的，年龄分别在四十五周岁、五十周岁、五十五周岁以下。 国家对公务员职务晋升另有规定的，从其规定。 第四十七条 公务员晋升前连续二年考核为优秀或者曾被市级以上人民政府授予荣誉称号的，在晋升职务时可适当放宽本办法第四十六条第四、五、七项所列晋升资格条件，担任命前应当报上一级任免机关批准。 第四十八条 公务员晋升职务应按规定的职务序列逐级晋升。因工作特殊需要，且德才特别优秀，并在晋升前连续三年考核为优秀，可越一级晋升，但任命前应当报上一级任免机关批准。 第四十九条 公务员晋升副科级以上行政领导职务和副处级以上行政非领导职务的，应当在其所在单位广泛征求意见。 第五十条 公务员有下列情况之一，不予晋升或者暂不予晋升职务: (一)正在受行政监察部门或者司法机关立案调查的; (二)受纪律处分尚未解除的; (三)正式申请辞职、退休或调离本工作单位，任免机关尚未作出决定的; (四)距离退休期限不足一年的; (五)因机构变化、人员调整等原因，上级人事部门明确决定暂不予晋升的; (六)有其他不予晋升或者暂不予晋升职务原因的。 第五十一条 公务员晋升副科级以上行政领导职务和副处级以上行政非领导职务，实行试用制。试用期为一年。 公务员试用期间享受试用职务待遇。试用期满鉴定合格的，继续任职;不合格的，实行试用制。试用期为一年。 第五十二条 市人民政府公务员晋升职务，按下列规定审批: (一)晋升副处级以下职务的，由市人民政府各部门任命; (二)晋升正处级职务的，由市人民政府各部门报市人事部门任命; (三)晋升局级非领导职务和非政府组成人员的局级领导职务的，由市人民政府任命。 intensive development.
