则规裁仲会员委裁仲州广 广州仲裁委员会仲裁规则 第一章 总则 第一条 广州仲裁委员会(以下简称本会)为保证公正、及时地仲裁案件，保护当事人的合法权益，根据《中华人民共和国仲裁法》及《中华人民共和国民事诉讼法》的有关规定制定本规则。 第二条 平等主体的自然人、法人和其他组织之间发生的 合同 劳动合同范本免费下载装修合同范本免费下载租赁合同免费下载房屋买卖合同下载劳务合同范本下载 纠纷和其他财产权益纠纷，可以依法向本会申请仲裁。 第三条 本会不受理因下列纠纷和争议提出的仲裁申请: (一)劳动争议; (二)农业集体经济组织内部的农业承包合同纠纷; (三)婚姻、收养、监护、抚养、继承纠纷; (四)依法应当由行政机关处理的行政争议。经仲裁庭审理后确认案件属于上 依法不予裁决。 述性质的， 第四条 当事人采用仲裁方式解决纠纷应当双方自愿，达成书面仲裁协议。没有仲裁协议，一方申请仲裁，另一方不愿仲裁的，本会不予受理。 第五条 仲裁根据事实，符合法律规定，公平合理地解决纠纷。 第六条 仲裁庭有权确认合同的效力。 第七条 仲裁依法独立进行，不受行政机关、社会团体和个人的干涉。 第八条 仲裁实行一裁终局制度。本会作出的裁决，具有法律效力，对各方当事人均有约束力。裁决作出后，当事人不得就同一时间发生的同一事实而提出的同一请求向人民法院提起诉讼，也不得再申请仲裁。 第九条 当事人协议将其争议提交本会仲裁的，即视为同意按照本规则进行仲裁。但当事人另行约定且经本会同意的，可从其约定。当事人知道或者应当知道本规则或仲裁协议中规定的任何条款未被遵守，应当在合理的时间内提出书面异议。没有提出书面异议或继续参加仲裁程序的视为放弃其提出异议的权利，并且不得以此作为不履行仲裁裁决的抗辩理由。 第十条 本会设立仲裁员名册，仲裁员由本会根据仲裁法规定的条件从具有专门知识和实践经验的人士中聘任。本会认为必要时可以设立特定专业的仲裁员名册。 Sichuan-Guizhou town axis-the axis on the North, in the town of "Yangtze River City" Center in Yibin city, South Union "in shunan bamboo-sea", "XING Wen Shi Hai" and other high level tourism resources in the domain of Yibin city. (4) the intensive and efficient: relying on the culture of the respective groups, industries, hub, ecological as well as the development of infrastructure, and fully tap the potential of the land, improve utilization efficiency 第十一条 本会主任履行仲裁法和本规则赋予的职责，副主任或者秘书长经主任授权可以履行主任的职责。 第二章 仲裁协议 第十二条 仲裁协议包括当事人在合同中订明的仲裁条款，或者以其他书面方式在纠纷发生前后达成的请求仲裁的协议。仲裁协议应具有下列内容: (一) 请求仲裁的意思 表 关于同志近三年现实表现材料材料类招标技术评分表图表与交易pdf视力表打印pdf用图表说话 pdf 示; (二) 仲裁事项; (三) 选定本会的意思表示。 第十三条 仲裁协议选定“广州市仲裁委员会”的，视为双方当事人一致同意由本会仲裁。当事人协议选定广州市仲裁机构的，或其他不会产生歧义，可以推断为本会的表述，均视为双方当事人一致同意由本会仲裁。 第十四条 没有仲裁协议，一方申请仲裁的，经本会告知，另一方也同意在本会仲裁的，应当补签仲裁协议或记录在案。仲裁协议中对仲裁事项或仲裁委员会约定不明确，一方当事人申请仲裁的，可以在本会或仲裁庭主持下，由双方当事人在签字的笔录中对仲裁事项或本会予以确认。 第十五条 仲裁协议独立存在，合同的变更、解除、被撤销、终止、未生效、无效或仲裁协议所附属的合同存在与否，不影响仲裁协议的效力。 第十六条 当事人可以对仲裁协议的效力或仲裁案件的管辖权提出异议。当事人对仲裁协议的效力或仲裁案件的管辖权有异议的，应当在首次开庭前提出;约定不开庭的，应当在首次提交答辩书时或在答辩期内提出。未在以上期限内对仲裁协议的效力提出异议的，视为承认该仲裁协议的效力或仲裁案件的管辖权。 第十七条 当事人对仲裁协议的效力有异议的，可以请求本会作出决定或者请求广州市中级人民法院作出裁定。一方请求仲本会作出决定，另一方请求人民法院作出裁定的，由人民法院裁定。向人民法院申请裁定的，当事人应当同时向本会或仲裁庭提交起诉状副本和法院的立案通知复印件。 第三章 申请和受理 第十八条 当事人申请仲裁应当符合下列条件: (一) 有仲裁协议; (二) 有具体的仲裁请求和事实、理由; (三) 属于本会的受理范围。 Sichuan-Guizhou town axis-the axis on the North, in the town of "Yangtze River City" Center in Yibin city, South Union "in shunan bamboo-sea", "XING Wen Shi Hai" and other high level tourism resources in the domain of Yibin city. (4) the intensive and efficient: relying on the culture of the respective groups, industries, hub, ecological as well as the development of infrastructure, and fully tap the potential of the land, improve utilization efficiency 第十九条 申请人提出仲裁申请，应当向本会递交仲裁协议、仲裁申请书及副本、身份证明以及与纠纷有关的证据材料;同时预缴仲裁费。 第二十条 仲裁申请书应当载明下列事项: (一)当事人的姓名、性别、年龄、民族、职业、工作单位和住所，法人或其他组织的名 称、住所和法定代表人或者主要负责人的姓名、职务; (二)仲裁请求和所依据的事实、理由; (三)证据、证据来源、证人姓名、住所及其简要说明。 第二十一条 本会自收到仲裁申请书之日起5日内，认为符合受理条件的，应当受理，并通知当事人;认为不符合受理条件的，应当通知申请人不予受理，并说明理由。本会收到申请书后，认为仲裁申请书不符合本规则第十九条和第二十条规定的，可以要求当事人限期补正;逾期不补正的，视为未申请。 第二十二条 本会决定受理仲裁申请后，应于5日内将立案通知书、仲裁规则、仲裁员名册和当事人、代理人仲裁须知送达申请人。并将立案通知书、仲裁规则、仲裁员名册、当事人、代理人仲裁须知和仲裁申请书副本送达被申请人。被申请人应当自收到仲裁申请书副本之日起15日内向本会提交答辩书。本会收到答辩书后，应当在5日内将答辩书副本送达申请人。被申请人未提交答辩书的，不影响仲裁程序的进行。 第二十三条 申请人可以放弃或者变更仲裁请求。被申请人可以承认或者反驳仲裁请求，有权根据同一仲裁协议提出反请求。当事人变更仲裁请求或提出反请求的，应当在收到受理通知之日起十五日内以书面形式提出，变更请求超出原请求部分或提出反请求的，应按规定交纳仲裁费。当事人逾期变更仲裁请求或提出反请求的，是否受理由仲裁庭决定。 第二十四条 仲裁庭应合并审理反请求。被申请人逾期提出的反请求，可以向本会另行申请。是否合并审理，由本会或者本会授权仲裁庭作出决定。 第二十五条 本会应当在受理被申请人的反请求申请书之日起5日内，将反请求申请书副本送达申请人。申请人应当自收到反请求申请书之日起15日内向本会提交书面答辩;未提交书面答辩的，不影响仲裁程序的进行。 第二十六条 当事人提交申请书、答辩书、反请求书和有关证明材料以及其他文书时，除向本会提交1份正本外，还应按照对方当事人人数和组成仲裁庭的仲裁员人数备具副本。 第二十七条 当事人提出仲裁申请或仲裁反请求，应当按照本会印发的《广州仲裁委员会仲裁收费办法》预缴仲裁费用。未按规定期限预缴仲裁费用的，视为撤回仲裁申请或仲裁反请求。 Sichuan-Guizhou town axis-the axis on the North, in the town of "Yangtze River City" Center in Yibin city, South Union "in shunan bamboo-sea", "XING Wen Shi Hai" and other high level tourism resources in the domain of Yibin city. (4) the intensive and efficient: relying on the culture of the respective groups, industries, hub, ecological as well as the development of infrastructure, and fully tap the potential of the land, improve utilization efficiency 第二十八条 受理仲裁申请后申请人撤回仲裁申请或当事人自行达成和解协议并撤回仲裁申请的，本会根据实际情况酌情退回部分预收的仲裁费。 第二十九条 当事人提交本会的书面文件，均应当面递交或以挂号函件邮递。其时效以当面递交时间或投递邮戳日期为准。 第三十条 一方当事人因另一方当事人的行为或者其他原因，可能使裁决不能执行或者难以执行的，可以申请财产保全。当事人申请财产保全的，本会应当自收到当事人财产保全申请书之日起5日内，将当事人的申请书提交人民法院。 第三十一条 当事人、法定代理人可以委托1至2名律师或其他代理人进行仲裁活动。当事人认为必要，经仲裁庭同意，可以适当增加代理人的人数。代理人人数超过2名的，应当向仲裁庭确定1名代理人作为主要发言人。 第三十二条 委托律师和其他代理人进行仲裁活动的，应向本会提交授权委托书及委托代理人的身份证明文件。授权委托书应当载明委托代理的事项和权限。委托代理的事项和权限变更或者解除的，当事人应当书面通知本会。已进行的仲裁程序不因此受到影响。 第四章 仲裁庭的组成 第三十三条 仲裁庭由3名仲裁员或者1名仲裁员组成。当事人可自行约定仲裁庭的组成人数，不约定则依本规则。仲裁庭由3名仲裁员组成的，设首席仲裁员。 第三十四条 由3名仲裁员组成仲裁庭的，当事人应当各自选定或者各自委托本会主任指定1名仲裁员。第3名仲裁员是首席仲裁员，由当事人共同选定或者共同委托本会主任指定。当事人一方为2人以上，应当共同选定或共同委托本会主任指定仲裁员。由1名仲裁员组成仲裁庭的，应当由当事人共同选定或者共同委托本会主任指定仲裁员。 第三十五条 当事人自收到受理通知书之日起15日(涉外仲裁案件45日)内没有约定仲裁庭的组成方式、选定仲裁员或选定不一致的，由本会主任指定。 第三十六条 本会自仲裁庭组成之日起5日内，将仲裁庭的组成情况书面通知当事人和仲裁员。 第三十七条 仲裁员有下列情形之一的，应当更换: (一) 因出差、出国不能承办仲裁案件的; (二) 因患病不能从事仲裁工作的; (三)其他不能履行职责的情形。 Sichuan-Guizhou town axis-the axis on the North, in the town of "Yangtze River City" Center in Yibin city, South Union "in shunan bamboo-sea", "XING Wen Shi Hai" and other high level tourism resources in the domain of Yibin city. (4) the intensive and efficient: relying on the culture of the respective groups, industries, hub, ecological as well as the development of infrastructure, and fully tap the potential of the land, improve utilization efficiency 第三十八条 仲裁员有下列情况之一的，必须回避，当事人也有权提出回避申请: (一)是本案当事人或者当事人、代理人的近亲属; (二)与本案有利害关系; (三)与本案当事人、代理人有其他关系，可能影响公正仲裁的; (四)私自会见当事人、代理人，或者接受当事人、代理人的请客送礼的。 第(三)款中的“其他关系”是指: 1.为本案事先提供过咨询的; 2.现任当事人法律 顾问或其他顾问，或曾担任当事人法律顾问或其他顾问该顾问关系结束未满两年的; 3.曾担 任当事人的代理人结案未满两年的; 4.与任何一方当事人、代理人在同一单位工作的; 5. 在本会同时审理的两宗案件中，各自互为案件的代理人和仲裁员的，后一案件被选定或指定成 为仲裁员的。 6.法律规定的其他关系。 第三十九条 办案秘书、翻译人员、鉴定人、勘验人的回避适用第三十七条的规定。 第四十条 当事人提出回避申请，应当在首次开庭前提出。回避事由在首次开庭后知道的，可以在审理终结前提出。当事人提出回避申请的，应当提供相关的证据材料。 第四十一条 仲裁员是否回避，由本会主任决定;本会主任担任仲裁员时是否回避，由本会委员会议决定。翻译人员、鉴定人、勘验人是否回避由本会主任决定。办案秘书是否回避，由本会秘书长决定。仲裁员应当回避而没有回避的，本会主任有权决定该仲裁员回避。 第四十二条 仲裁员不得私自会见当事人、代理人或以其他方式与当事人、代理人单独联系。仲裁庭认为确需会见当事人的，须由该案办案秘书陪同，且作笔录。仲裁员、办案秘书不得透露有关案件的情况。 第四十三条 仲裁员在履行职责时，有违反法律或本规则，影响裁决公正性、合法性的，本会主任可责令该仲裁员退出仲裁庭。 第四十四条 仲裁员在仲裁案件时有索贿受贿，徇私舞弊，枉法裁决行为的，本会应当将其除名，情节严重的，移交有关部门依法追究法律责任。 第四十五条 仲裁员因更换、回避、退出或者其他原因不能履行职责时，应当按照原选定或者指定该仲裁员的程序选定或指定替代的仲裁员。重新选定或指定替代的仲裁员后，原已进行的仲裁程序是否重新进行，由仲裁庭决定。 第五章 证据 Sichuan-Guizhou town axis-the axis on the North, in the town of "Yangtze River City" Center in Yibin city, South Union "in shunan bamboo-sea", "XING Wen Shi Hai" and other high level tourism resources in the domain of Yibin city. (4) the intensive and efficient: relying on the culture of the respective groups, industries, hub, ecological as well as the development of infrastructure, and fully tap the potential of the land, improve utilization efficiency 第四十六条 当事人对自己的主张，有责任提供证据。仲裁庭认为有必要收集的证据，可以自行收集。仲裁庭自行收集的证据，开庭审理的应当在庭上出示并听取双方当事人的意见;书面审理的应当送达双方当事人并收集其意见。 第四十七条 证据有下列几种: (一) 书证; (二) 物证; (三) 视听资料; (四) 证人证言; (五) 当事人的陈述; (六) 鉴定结论; (七) 勘验笔录; 以上证据须经查证属实，才能作为认定事实的根据。 第四十八条 书证应当提交原件。物证应当提交原物。提交原件或者原物确有困难的，可以提交复制品、照片、副本、节录本，但必须说明来源并与原件、原物核对或经鉴定无误。提交外文书证，应当附经有关部门认证的中文译本。 第四十九条 当事人应当在收到立案通知书、申请书副本或反请求申请书副本之日起15日内完成举证。涉外仲裁案件的当事人的举证期限为45日。逾期举证，应书面说明理由，是否采纳，由仲裁庭决定并告知当事人。 第五十条 当事人提交证据材料，应进行分类编订、标明页码、写明证明内容、提交的日期并盖章签名。 第五十一条 本会对申请人、被申请人提交的仲裁文书、证据实行交换，将仲裁文书、证据送达对方当事人。证据材料较多的案件，仲裁庭认为有必要的，可以于正式开庭前由首席仲裁员或由仲裁庭委托办案秘书在指定的时间召集双方当事人交换证据;必要时也可以进行庭前质证，确定双方没有争议的证据，对有争议的证据留待庭审时质证。 第五十二条 仲裁庭根据庭审需要，可要求当事人在一定期限内补交证据材料。负有举证责任的当事人应当按照要求的期限提供证据材料。当事人没有正当理由不能提供的，由该当事人承担举证不能的后果，仲裁庭应根据已有的证据认定案件事实并作出裁决。 第五十三条 一方当事人在庭审过程中才提交新的证据，另一方当事人同意的，仲裁庭可以在本次开庭中一并审理;另一方当事人表示不同意，本次开庭时不予审理新的证据，在完成证据交换后另行安排开庭审理。前款新的证据是指该证据是在举证期限届满后才获得或出现并经仲裁庭确认的证据。 Sichuan-Guizhou town axis-the axis on the North, in the town of "Yangtze River City" Center in Yibin city, South Union "in shunan bamboo-sea", "XING Wen Shi Hai" and other high level tourism resources in the domain of Yibin city.
