October 9, 2011 Chapter 1 General Provisions The first is to strengthen the Shenzhen Special Economic Zone (SEZ) sanitation management, build a clean, beautiful and civilized city, according to the basic principles of the relevant laws and administrative regulations, combined with the actual situation in the enactment of this ordinance. Second municipal administration departments of the people's Government of Shenzhen municipality are responsible for the city appearance and environmental sanitation management. City administrative departments and towns and subdistrict offices in each district are responsible for the city appearance and environmental sanitation management in accordance with their respective functions and responsibilities. City, district planning, land, environmental protection, construction, public security, business and other departments, in accordance with their respective functions, do a good job of city appearance and environmental sanitation management work. Third city and district administrative departments of Urban Administration (hereinafter referred to as the competent departments) can delegate part of their management functions to eligible organizations. The administrative penalty power of the competent department stipulated in these regulations can be exercised by the administrative comprehensive law enforcement agency authorized by the government. Fourth city and environmental sanitation management work area responsibility system, adhere to the combination of professional management and mass management, education and punishment combined principle. The fifth municipal and District People's governments should bring the city appearance and environmental sanitation into the national economic and social development plan, and promote the development of the city appearance and environmental sanitation. Article sixth the people's governments at all levels, departments, educational institutions and the media should strengthen publicity and education, appearance and environmental sanitation knowledge of public welfare advertising and public opinion, and constantly enhance the people's awareness of health and civilization, establish a good social morality. Seventh any unit and individual should maintain the city appearance and environmental sanitation, cherish the public facilities, and have the right to dissuade, criticize or report the violation of these regulations. Any unit or individual shall respect the work of the environmental sanitation personnel, maintain the personal safety of the environmental sanitation workers who are in normal operation according to law, and shall not impede the normal operation of the environmental sanitation workers. The competent authorities may employ the supervisor of the city appearance and environmental sanitation duties in the public, and assist them in doing publicity, education and rectification of illegal acts. The eighth competent authorities shall establish a reporting system for city appearance and environmental sanitation. Anyone who finds violations of this Ordinance may report to the competent authorities. The competent authorities should seriously investigate and deal with the report, and keep the informer confidential. If a reply is requested by an informer, a reply shall be made within ten days. The competent authorities should establish a reward system for the reporting of city appearance and environmental sanitation. If the report has been verified, the competent authorities shall give commendation or reward to the informants. The reporting incentives shall be formulated by the competent authorities. Ninth acts in violation of these regulations, the competent authorities can order the offender to make corrections or take remedial measures; refused to perform, can entrust the relevant units to carry out, on behalf of the executive cost borne by the violator. The eleventh administrative departments should establish the responsibility system for the management of the city appearance and environmental sanitation. Thirteenth administrative personnel of city appearance and environmental sanitation should be criticized, educated and ordered to make corrections; if the circumstances are serious, they shall be given administrative sanctions; if a crime is constituted, criminal liability shall be investigated according to law: (1) failing to perform duties and not to stop or punish illegal acts which should be stopped or punished according to law; (two) harboring or conniving at illegal persons; (three) the corruption and breach of privilege, damage the legitimate rights and interests of citizens, legal persons or other organizations. The second chapter is the management responsibility of the area Fourteenth city appearance and environmental sanitation management implementation area management responsibility system. The management responsibilities of the fifteenth districts of city appearance and environmental sanitation are divided according to the following principles: (1) districts, towns and subdistrict offices are divided according to administrative areas; (two) residential areas, industrial parks, tourist areas, storage areas, bonded zones, development zones and science parks are divided according to the scope of property management; (three) the authorities, groups, enterprises and institutions are divided according to the scope of use.
