Continue to deepen the reform of the cadre and personnel system, always adhere to correct direction of personnel, implement regulations on cadre selection 方需提前告知乙方。 3、乙方因故辞职或要求解除劳动关系的，由于学校门卫工作性质的特殊性，乙方需提前一个月向甲方提出申请，否则视为乙方违约，甲方有权拒绝支付当月工资。 4、一方违反本合同，给对方造成损失的，严格依照国家有关规定由违约方赔偿相关损失。 5、特殊时段、特殊情况时，甲方有义务积极配合和支持乙方工作，以确保乙方的人身和财产安全，否则乙方有权要求甲方予以相应的赔偿。 八、 合同的终止 具有下列情形之一，本合同应即终止: 1、本合同期限届满; 2、法律法规规定的其他终止情形 九、合同的解除 1、甲乙双方协商一致同意可以解除本合同。 2、乙方具有下列情形之一的，甲方可以解除本合同: (1) 在实际工作中被证明不符合录用条件的; (2)严重违反劳动纪律或甲方依法制定的规章制度的; (3)严重失职，营私舞弊，给甲方利益造成重大损害的; 3、具有下列情形之一的，甲方提前一个月以书面形式通知乙方，或者额外支付乙方一个月工资后，可以解除本合同。乙方患病或者非因工负伤的，医疗期满后不能从事原工作也不能从事由甲方另行安排的工作的; 4、乙方具有下列情形之一的，甲方不得依据前款的规定解除本合同; (1)、因工负伤并被劳动鉴定委员会确认丧失或部分丧失劳动能力的; (2)、患病或非因工负伤，在规定医疗期内的; mass line of the party construction of education system, improve scientific and systematization and standardization level of the party building. Continue to deepen the reform of the cadre and personnel system, always adhere to correct direction of personnel, implement regulations on cadre selection3 5、乙方提一个月以书面形式通知甲方可以解除本合同。但乙方担任重要职务或执行关键任务并经双方约定乙方不得解除本合同的除外。 6、具有下列情形之一的，乙方可以随时解除本合同: (1)、未按照劳动合同约定提供劳动保护或者劳动条件的; (2)、甲方以暴力、威胁或者非法限制人身自由的手段强迫劳动的; 十、本合同终止或解除，甲方应当在解除或者终止本合同时出具解除或者终止劳动合同的证明。 十一 、合同的续订 1、本合同期限届满后，经双方协商本合同可以续订。 2、续订的固定期限劳动合同，经双方协商同意可更改相关内容。 十二、经济补偿和违约责任 1、合同期内，有《劳动合同法》第四十六条规定的情形之一，甲方应当向乙方支付经济补偿。补偿办法按《劳动合同法》及国家和地方有关规定执行。 2、合同期内，乙方违约或提前解除本合同的，甲方有权要求乙方赔偿甲方因乙方违约所造成的损失。赔偿办法按每天实际享用的价值比例赔偿甲方。 十三、 劳动争议的处理 双方因履行本合同发生争议，可以向劳动争议调解委员会申请调解，或者在规定的期限内向有管辖权的劳动争议仲裁委员会书面申请仲裁。对仲裁裁决不服的，可以向人民法院起诉。 十四、本合同未尽事宜，按照国家有关规定执行。 十五、本合同双方签订后，一式两份，甲乙双方各执一份。 甲方(章)(法定代表人) 乙方(签章) (单位负责人)(签章) 20 14年 3 月 15 日 mass line of the party construction of education system, improve scientific and systematization and standardization level of the party building.
