摘 要 近年来伴随国家政治经济体制改革的全面深入和社会经济持续发展，我国国有资产流失和环境污染等事关国家和社会公共利益案件时有发生，但却无主体实施司法救助。基于这种状况，近年来，对民事公诉制度的借鉴和移植日益成为理论和实务界关注的热点问题，最高人民检察院也将民事公诉制度纳人到检察改革的总体规划中来。因此，研究民事公诉制度，不管是对理论界还实务界来说，不仅是必要的，也是必然的，具有极大的现实意义。本文将从民事公诉制度建立的理论基础与现实意义、检察机关提起民事公诉的依据与制度构建等方面进行简单的探讨。
