RealRightLawofthePeople'sRepublicofChina(AdoptedatthethsessionoftheTenthNationalPeople'sCongressonMarch,)PartIGeneralRulesChapterIBasicPrinciplesArticleInaccordancewiththeConstitutionLaw,thepresentLawisenactedwithaviewtomaintainingthebasiceconomicsystemofthestate,protectingthesocialistmarketeconomicorder,clearlydefiningtheattributionoftheres,bringingintoplaytheutilitiesoftheresandsafeguardingtherealrightoftherightholderArticleThecivilrelationshipsincurredfromtheattributionandutilizationoftheresshallbegovernedbythepresentLawTheterm"res"asmentionedinthepresentLawmeansrealtiesandchattelsWhereitisprescribedinanyprovisionthatcertainrightshallbetakenasanobjectofrealright,suchprovisionshallbeapplicableTheterm"realright"asmentionedinthepresentLawmeanstheexclusiverightofdirectcontroloveraspecificresenjoyedbytheholderinaccordancewithlaw,includingownership,usufractuaryrightandrealrightsforsecurityArticleIntheprimaryphaseofsocialism,thestateadherestothebasiceconomicsystemwiththepublicownershipplayingadominantroleanddiverseformsofownershipdevelopingsidebysideThepubliceconomyshallbeconsolidatedanddevelopedbythestate,andthedevelopmentofthenonpubliceconomyshallbeencouraged,supportedandguidedThesocialistmarketeconomysystemshallbepracticedbythestateaswellastheequallegalstatusanddevelopmentrightsofallmarketsubjectsshallbeprotectedArticleTherealrightofthestate,collective,individualoranyotherrightholdershallbeprotectedbylaw,andmaynotbedamagedbyanyentityorindividualArticleThevarietiesandcontentsofrealrightsshallbeprescribedbylawArticleThecreation,alteration,alienationorterminationoftherealrightofarealtyshallbesubjecttoregistrationinaccordancewithlawThecreationoralienationoftherealrightofachattelshallbedeliveredinaccordancewithlawArticleOneshall,whenacquiringorexercisingarealright,complywiththelaw,respectsocialmoralsandmaynotinfringeuponthepublicinterestsorthelawfulrightsandinterestsofanyotherpersonArticleIncasethereexistsanyotherspecialprovisioninrespectofrealrightinanyotherlaw,suchspecialprovisionshallprevailChapterIICreation,Alteration,AlienationandTerminationofRealRightSectionRealityRegistrationArticleUntilitisregisteredinaccordancewithlaw,thecreation,alteration,alienationorterminationoftherealrightofarealtyshallcomeintoeffectunlessitisotherwiseprescribedbyanylaw,itshallhavenoeffectifitisnotregisteredinaccordancewithlawAsregardstheownershipofthenaturalresourcesownedbythestateinaccordancewithlaw,theregistrationisnotrequiredArticleTheregistrationofarealtyshallbehandledbytheregistrationorganatthelocalityoftherealtyAuniformregistrationsystemoverrealtiesshallbepracticedbythestateThescope,organandmeasuresofuniformregistrationshallbespecifiedbytherelatedlawsandadministrativeregulationsArticleInlightofthedifferentregistrationitems,anapplicantshall,whenapplyingfortheregistrationofarealty,providetheownershipcertificateoftherealtyandsuchnecessarymaterialsasthelocationandareaoftherealtyArticleAregistrationorganshallperformthedutiesasfollows:()toexaminetheownershipcertificateandothernecessarymaterialsasprovidedbytheapplicant()toinquiretheapplicantabouttheregistrationitemsconcerned()toregistertherelateditemsinaccordancewiththefactsandinatimelymannerand()otherdutiesasprovidedforinanylaworadministrativeregulationIncasetherelatedsituationoftherealtyunderapplicationforregistrationneedsfurtherproving,theregistrationorganmayrequesttheapplicanttoprovidesupplementarymaterialsandconductonthespotinspectionwherenecessaryArticleNoregistrationorganmaycommitanyofthebehaviorsasfollows:()toaskforanevaluationofarealty()torepeatedlyregisterregistrationinthenameofannualinspectionor()otherbehaviorsconductedbeyonditsscopeofregistrationdutiesArticleAsregardsthecreation,alteration,alienationorterminationoftherealrightofarealty,itshallgointoeffectsincethedatewhenitisrecordedintherealtyregisterincasetheregistrationthereofisrequiredbylawArticleAsregardsacontractenteredintobytherelatedpartiesconcernedonthecreation,alteration,alienationorterminationoftherealrightofarealty,itshallgointoeffectupontheconclusionofthecontract,unlessitisotherwiseprescribedbyanylawandthevalidityofthecontractisnotaffected,whethertherealrighthasbeenregisteredornotArticleTherealtyregistershallbethebasisfordecidingtheownershipandcontentsofarealtyandshallbeunderthemanagementoftheregistrationorganArticleTherealtyownershipcertificateshallbetheevidencefortheholder'sownershipofarealtyTheitemsrecordedintherealtyownershipcertificateshallaccordwiththoserecordedintherealtyregisterunlessitisprovedthatthereisanythingwrongintherealtyregister,theonerecordedthereinshallprevailinthecaseofanyinconsistenceArticleAnyrightholderorinterestedpartymayfileanapplicationforconsultingorcopyingtheregistrationmaterials,andtheregistrationorganmaynotrejectArticleIncaseanyrightholderorinterestedpartyholdsthatthereisanythingwronginanyitemrecordedintherealtyregister,ithemayapplyforacorrectionoftheregistrationTheregistrationorganshallrevisetheregistrationaccordingly,incasetheholderrecordedintherealtyregisteragreestorevisetheregistrationinwrittenformorthereisevidencetoprovethattheregistrationiswrongTheinterestedpartymayapplyfordissidenceregistration,incasetheholderrecordedintherealtyregisterdoesnotagreetothealterationWheretheregistrationorgangrantsthedissidenceregistrationbuttheapplicantfailstolodgeanactionwithindaysasofthedateofdissidenceregistration,thedissidenceregistrationshallloseitseffectIncasethedissidenceregistrationisimproperandbringintodamagestotherightholder,theholdermayrequiretheapplicanttocompensatefordamagesArticleIncasetherelatedpartiesenteredintoapurchaseagreementonapremiseortherealrightofanyotherrealty,theymayapplyforadvancenoticeregistrationtotheregistrationorgansoastoensuretherealizationoftherealrightinthefutureWithouttheconsentoftheholderintheadvancenoticeregistration,anydisposaloftherealty,aftertheadvancenoticeregistration,maynotproduceeffectofrealrightIncasetheobligee'srightisterminatedaftertheadvancenoticeregistrationismade,ortheapplicationfortheregistrationoftherealtyisnotfiledwithinmonthsasofthedatewhenitcanberegistered,theadvancenoticeregistrationshallloseitseffectArticleIncaseanyrelatedpartyprovidesfalsematerialsforapplyingforregistrationandcausesdamagestoanyotherperson,itheshallassumetheliabilityforcompensationIncaseanyregistrationorgancausesdamagestoanyotherpersonbyvirtueofanymistakeinregistration,itshallassumetheliabilityforcompensationTheregistrationorganmay,aftermakingthecompensation,recovertheamountfromthepersonwhocausestheregistrationmistakeArticleRealtyregistrationfeesshallbechargedoneachpiece,andmaynotbechargedonthebasisofthesize,volumeorcertainproportionoftherealty'svalueTheconcretechargingratesshallbeformulatedbytherelateddepartmentsintheStateCouncilincollaborationwiththecompetentpricingdepartmentSectionChattelDeliveryArticleUnlessitisotherwiseprescribedbyanylaw,thecreationoralienationoftherealrightofachattelshallcomeintoeffectupondeliveryArticleThecreation,alteration,alienationorterminationoftherealrightofanyvessel,aircraftormotorvehicleandsoonmaynotchallengeanybonafidethirdpartyifitisnotregisteredArticleIncasetherightholderhaslegallypossessedthechattelpriortotheestablishmentoralienationofachattel'srealright,therealrightshallcomeintoeffectupontheeffectivenessofthelegalactArticleIncaseathirdpartyhaslegallypossessedthechattelpriortotheestablishmentoralienationofachattel'srealright,thepersonassumingtheobligationofdeliverymay,insteadofdelivery,alientherighttorequestthethirdpartytoreturntheoriginalobjectArticleIncasebothpartiesagreetoletthealienatorcontinuouslypossessthechattelwhentherealrightofachattelisalienated,therealrightshallgointoeffectupontheeffectivenessoftheagreementSectionOtherRulesArticleIncasethecreation,alteration,alienationorterminationofarealrightisresultedfromalegaldocumentofthepeople'scourtorarbitrationcommitteeorarequisitiondecisionofthepeople'sgovernment,etc,therealrightshallcomeintoeffectupontheeffectivenessofthelegaldocumentortherequisitiondecisionofthepeople'sgovernmentArticleIncaserealrightisacquiredthroughinheritanceorbequest,itshallgointoeffectasofthebeginningtimeoftheinheritanceorbequestArticleIncasearealrightiscreatedorterminatedasaresultofsuchfactualbehaviorsasthelegalconstructionorpremisedemolition,itshallcomeintoeffectupontheaccomplishmentofthefactualbehaviorArticleAsregardsarealrightofrealtyenjoyedaccordingtotheprovisionsofArticlesthroughofthepresentLaw,anydisposalthereofmaynotproduceeffectofrealrightuntilitisregisteredasrequiredbylawChapterIIIProtectionofRealRightArticleWherearealrightisdamaged,therightholdermaysettletheproblembymeansofconciliation,mediationorarbitration,etcArticleWhereanydisputeovertheownershiporcontentofrealrightarises,theinterestedpartiesmayrequiretheconfirmationoftherightArticleWherearealtyorchattelisunderanunauthorizedpossession,therightholdermayrequirethereturningoftheoriginalobjectArticleIncasearealrightisunderobstructionormaybeobstructed,therightholdermayrequiretheremovingoftheimpedimentortheterminationofthedangerArticleIncasearealtyorchattelisdamaged,therightholdermayrequiretherepairing,remaking,changingortherestorationoftheoriginalstateArticleIncasetheinfringementuponarealrightcauseslossestotherightholder,therightholdermayrequirethecompensationforthelossesortheassumingofanyothercivilliabilityArticleThewaysforprotectingrealrightasprescribedinthepresentLawmayapplyeitherindependentlyorjointlyinlightofthespecificsituationofaninjuryofrealrightInadditiontoassumingcivilliabilities,anyentityorindividualinfringinguponarealrightshallassumetheadministrativeliabilitieswhereitheviolatesanyprovisiononadministrativeregulationincaseanycrimeisestablished,itheshallassumethecriminalliabilitiesIIOwnershipChapterIVGeneralRulesArticleTheownerofarealtyorchattelisentitledtopossess,utilize,seekprofitsfromanddisposeoftherealtyorchattelinaccordancewithlawArticleTheownerofarealtyorchattelisentitledtoestablishausufructuaryrightorrealrightforsecurityovertherealtyorchattelTheholderofusufructuaryrightortheholderofrealrightforsecuritymay,whenexercisingtheright,notinjuretheowner‘srightsandinterestsArticleAsregardsarealtyorchattelthatisexclusivelyownedbythestateasprescribedbylaw,itsownershipmaynotbeacquiredbyanyentityorindividualArticleInordertomeetthedemandsofpublicinterests,itisallowedtorequisitionlandsownedcollectively,premisesownedbyentitiesandindividualsorotherrealtiesaccordingtothestatutorypowerlimitandproceduresWhenrequisitioninglandownedcollectively,itisrequiredto,inaccordancewithlawandinfullamount,paylandcompensationfees,placementsubsidies,compensationsfortheabovegroundfixturesofthelandsandseedlingsandotherfees,arrangeforsocialsecurityfeesforthefarmerswithlandrequisitioned,guaranteetheirlivelihoodandprotecttheirlawfulrightsandinterestsWhenrequisitioningthepremisesownedbyentitiesandindividualsorotherrealties,itisrequiredtocompensatefordemolishmentandrelocationinaccordancewithlawandprotectthelawfulrightsandinterestsoftheownersoftherequisitionedrealtieswhenrequisitioningtheindividuals'residentialhouses,itisrequiredtoguaranteethehousingconditionsoftheownersoftherequisitionedhousesThecompensationfeesforrequisitionandotherfeesmaynotbeembezzled,misappropriated,privatelyshared,detainedordelayedinthepaymentofbyanyentityorindividualArticleSpecialprotectionsareprovidedbythestateforfarmlands,theconversionoffarmlandsintoconstructionlandsisstrictlyrestrictedandtheaggregatequantityofconstructionlandsisundercontrolNoonemayrequisitionanylandownedcollectivelywithviolationofthestatutorypowerlimitandproceduresArticleFormeetingneedsofemergentdangersordisasters,itisallowedforonetousetherealtiesorchattelsownedbyentitiesandindividualsaccordingtothestatutorypowerlimitandproceduresSuchrealtiesorchattelsshall,aftertheemergentuse,bereturnedtotheownersIncaseanyrealtyorchattelownedbyanyentityorindividualisusedordamagedorlostafterbeingused,correspondingcompensationshallbemadeChapterVStateOwnership,CollectiveOwnershipandPrivateOwnershipArticleAsregardsthepropertiesthatshallbeownedbythestateasprovidedforbylaw,theyshallbeintheownershipofthestate,thatis,ownedbyallthepeopleTheStateCouncilshallexercisetheownershipofstateownedpropertiesonbehalfofthestateincasethereisanyotherwiseprovisioninanylaw,suchprovisionshallprevailArticleMineraldeposits,watersandseaareasshallbeintheownershipofthestateArticleUrbanlandsshallbeintheownershipofthestateAsregardslandsintheruralareasandsuburbanareasthatshallbeownedbythestateasprescribedbylaw,theyshallbeintheownershipofthestateArticleSuchnaturalresourcesasforests,mountains,grasslands,wastelandsandtidalflatsshallbeintheownershipofthestate,exceptforthosethatshallbeintheownershipofcollectiveasprovidedforbylawArticleAsregardsthewildliferesourcesthatshallbeownedbythestateasprovisionedbylaw,theyshallbeintheownershipofthestateArticleRadiofrequencyspectrumresourcesshallbeintheownershipofthestateArticleAsregardstheculturalrelicsthatshallbeownedbythestateasprovisionedbylaw,theyshallbeintheownershipofthestateArticleNationaldefenseassetsshallbeintheownershipofthestateAsregardssuchinfrastructuresasrailways,highways,electricpowerfacilities,telecommunicationfacilities,andpetrolandgaspipelinesthatshallbeownedbythestateasprovisionedbylaw,theyshallbeintheownershipofthestateArticleStateorganshavethepower,inaccordancewiththelawsandtherelevantprovisionsoftheStateCouncil,topossess,utilizeanddisposeofanyrealtyorchatteldirectlycontrolledbythemArticleThepublicinstitutionsheldbythestatehavethepowertopossess,utilize,aswellas,accordingtothelawsandtherelevantprovisionsoftheStateCouncil,seekprofitsfromanddisposeofanyrealtyorchatteldirectlycontrolledbythemArticleAsregardstheenterprisessetupwiththefundsinvestedinbythestate,theStateCouncilandthelocalpeople'sgovernmentsshallperformandenjoythecontributor'sdutiesaswellasrightsandinterestsonbehalfofthestateinaccordancewiththerelevantlawsandadministrativeregulationsArticleThestateownedpropertiesshallbeprotectedbylaw,andnoentityorindividualmayencroach,plunder,privatelydistribute,holdbackordamagethemArticleTheinstitutionsandworkingpersonnelthereofinchargeofperformingthedutiesofmanagingandsupervisingstateownedassetsshall,accordingtolaw,strengthenthemanagementandsupervisionofstateownedassetssoastopromotethevaluemaintenanceandappreciationpreventthelossesthereofincaseanyentityorindividualcausesanylossofstateownedassetsbymisusingauthorityorneglectingduty,itheshallassumelegalliabilitiesinaccordancewithlawIncaseanyentityorindividual,intheprocessofenterpriserestructuring,merger,divisionoraffiliatedtransactions,causeslossesofstateownedassetsbywayoftransferringatalowprice,conspiringtodistributethemsecretly,providingguaranteewiththemwithoutauthorizationoranyotherwaywithviolationoftheprovisionsonthemanagementofstateownedassets,itheshallassumelegalliabilitiesinaccordancewithlawArticleThecollectivelyownedrealtiesandchattelsshallcontain:()Lands,forests,mountains,grasslands,wastelandsandtidalflatsthatshallbeintheownershipofcollectiveasprovidedforbylaw()Buildings,productionfacilities,farmland,andwaterconservancyfacilitiesthatareintheownershipofcollective()Facilitiesforeducation,science,culture,sanitationandsports,etcthatareintheownershipofcollective()OtherrealtiesandchattelsthatareintheownershipofcollectiveArticleTherealtiesandchattelsthatareintheownershipofafarmers'collectiveshallbecollectivelyownedbyallthemembersofthiscollectiveThefollowingissuesshallbedeterminedbythemembersofthecollectiveaccordingtothestatutoryprocedures:()landcontractingplanandwhethertocontractoutalandtoanentityorindividualnotincludedinthecollective()adjustmentofthecontractedlandsamongtherightholdersofthecontractedmanagementofland()methodsforusinganddistributingsuchfeesaslandcompensationfees()thealterationofownershiporanyotherrelatedissueofanenterprisesetupwiththefundsinvestedinbythecollectiveand()otherissuesprovidedforbyanylawArticleAsregardsanycollectivelyownedland,forest,mountain,grassland,wastelandortidalflat,theownershipthereofshallbeexercisedaccordingtotheprovisionsasfollows:()Incaseitisownedbyafarmers'collectiveofavillage,acollectiveeconomicorganizationorthevillagers'committeeofthevillageshallexercisetheownershiponbehalfofthecollective()Incaseitisownedbytwofarmers'collectivesormore,allthecollectiveeconomicorganizationsorvillagers'groupsofthevillageshallexercisetheownershiponbehalfofthecollectiveand()Incaseitisownedbyafarmers'collectiveofatown,acollectiveeconomicorganizationofthetownshallexercisetheowne
