PREFACE
This Standard was prepared by the Joint Standards Australia/Standards New Zealand
Committee QR-012, Conformance Marking to Regulatory Requirements, to supersede
AS/NZS 4417.3:1996 on publication.
The objective of this Standard is to provide the basis for a uniform Australian/New Zealand
regulatory compliance marking scheme primarily for electrical and electronic products (which
may be extended to other classes of products in future).
This part of the Standard deals with electromagnetic compatibility regulatory requirements in
Australia and New Zealand.
AS/NZS 4417 is published in separate parts as follows:
Part 1: General rules for use of the mark
Part 2: Specific requirements for electrical safety regulatory applications
Part 3: Specific requirements for electromagnetic compatibility regulatory applications
Part 4: Specific requirements for radio apparatus regulatory applications
This revision updates aspects of the standard to make it more compatible with the current
EMC regulatory requirements in Australia and New Zealand. It also includes consequential
editorial changes.
The terms ‘normative’ and ‘informative’ have been used in this Standard to define the
application of the appendix to which they apply. A ‘normative’ appendix is an integral part of a
Standard, whereas an ‘informative’ appendix is only for information and guidance.

1 SCOPE
This Standard specifies the requirements that apply to the use of the Regulatory Compliance
Mark (RCM) on products to indicate compliance with electromagnetic compatibility regulations
in Australia and New Zealand. It is intended to be read in conjunction with AS/NZS 4417.1,
which specifies the RCM and sets out general rules for its use.

3 DEFINITIONS
For the purpose of this Standard, the definitions given in AS/NZS 4417.1 and those below
apply.

technical construction file
documentary material in English that includes a report produced by a competent body
assessing a device against the requirements of an applicable Standard, in which the report:
(a) Identifies the device assessed; and
(b) Identifies the applicable standard against which the device was assessed; and
(c) Includes a statement by the competent body stating that, in the opinion of the competent
body, the device complies with the applicable standard.
4 CONDITIONS FOR USE OF THE RCM FOR ELECTROMAGNETIC
COMPATIBILITY
4.1 General
The RCM is derived from the C-Tick mark, and its use to indicate EMC compliance is
accepted by ACMA and RSM (subject to the EMC compliance requirements of each country
being met). However, where a product is subject to electrical safety regulations but the
supplier does not wish to make a claim of compliance with electrical safety requirements (see
AS/NZS 4417.2) the C-Tick mark itself must be used for EMC, as the RCM indicates
compliance with all applicable regulatory requirements.
4.2 Basis of claim of compliance
4.2.1 Product specifications
The RCM may be used to indicate compliance with EMC regulations in relation to the
following:

(i) Declared articles, declared high risk articles and declared medium risk articles (see
AS/NZS 4417.2);
(ii) Non-declared articles (see AS/NZS 4417.2) for which the supplier has obtained a
certificate or a safety report (New Zealand);
(iii) Battery-powered or extra-low-voltage (ELV) products including solar-powered
products.
(b) Other products
(i) Internal combustion engine devices covered by ACMA’s Radiocommunications
Labelling (Electromagnetic Compatibility) Notice 2008;
(ii) Electric and internal combustion engine vehicles covered by ACMA’s
Radiocommunications Labelling (Electromagnetic Compatibility) Notice 2008.
4.2.2 Compliance with EMC regulations
Where the RCM is to be used to indicate compliance with EMC regulations, the supplier shall
ensure that all requirements specified in the Radiocommunications Labelling (Electromagnetic
Compatibility) Notice 2008 (Australia) or Radiocommunications (Compliance) Notice 2004 as
amended (New Zealand) as in force from time to time are met. The supplier shall—
(a) Establish satisfactory technical grounds for product compliance with an applicable EMC
Standard in the form of either—
(i) Compliance records (based on testing for compliance with the Standard) (Level of
conformity 1 products don’t necessarily need testing for C-Tick marking in New
Zealand); or
(ii) Preparation of a technical construction file (Australia only);
(b) Make a declaration that the product complies with EMC Standards;
(c) Label the product in accordance with AS/NZS 4417.1; and
(d) Advise ACMA or RSM as appropriate of the intention to use the RCM and the supplier
identification information that is proposed to be used, see Appendix B.
The RCM shall not be used where the supplier has not established compliance, even where
product compliance is voluntary or the product is subject to modified application of
regulations.
4.2.3 Supplier identification
Supplier identification will generally be by one of the methods prescribed in AS/NZS 4417.1.
Under some circumstances, such as ‘other equipment manufacturer’ (OEM) supplier
relationships, it may not be appropriate for the original manufacturer to be publicly identified
on products marketed under another supplier name. In these cases the OEM company,
responsible for product conformity, may be identified by a supplier code issued by ACMA or
RSM, rather than the trademark, company name or ACN (Australia) or GST number (New
Zealand) or Company number (New Zealand).
A pro-forma advice of the method of supplier identification and intention to use the RCM is
given in Appendix B. This advice will be acknowledged by ACMA or RSM as appropriate in
writing. The acknowledgment represents approval by ACMA and RSM for the supplier to use
the RCM to denote EMC compliance.
Acknowledgment by ACMA or RSM as appropriate is not an approval to use the RCM to
denote any other claim of conformity which falls under the scope of the RCM.
If there is any change to the details of the supplier from those given to ACMA or RSM as
appropriate in the pro-forma advice, these must be advised to ACMA or RSM as appropriate
within 21 days of the change.

4.2.4 Compliance records
Where compliance is demonstrated by testing, the compliance folder shall include, in addition
to the requirements set out in AS/NZS 4417.1, the information required in the
Radiocommunications Labelling (Electromagnetic Compatibility) Notice 2008 (Australia) or
Radiocommunications (Compliance) Notice 2004 as amended (New Zealand).
4.2.5 Technical construction file (Australia)
Details of the requirements for use of a technical construction file to support a claim of
compliance are given in the Radiocommunications Labelling (Electromagnetic Compatibility)
Notice 2008.
