抚养费纠纷案例 河南省郑州市高新技术产业开发区人民法院 民事判决书 (2010)开民初字第1238号 原告郭某某。 法定代理人贾随枝。 被告郭元平。 原告郭某某与被告郭元平抚养费纠纷一案，本院受理后，依法组成合议庭，公开开庭进行了审理。原告郭某某的法定代理人贾随枝、被告郭元平到庭参加诉讼。本案现已审理终结。 原告诉称，2008年12月17日，原告父母协议离婚，协议明确约定原告随母亲贾随枝生活，由其抚养，相关抚养费用由被告承担。但自原、被告离婚至今被告从未向原告支付抚养费。现原告及其母亲在村里均无耕地，无其他生活来源。为保护原告合法权益，故诉至法院，请求依法判令被告每月按时支付原告抚养费600元;诉讼费用由被告承担。 被告辩称，原告的基本信息及2008年12月20日签署的离婚协议均是真实的，原告及其母亲在村里也确实没有耕地。被告同意支付原告抚养费，具体按每月150元支付生活费，另每月支付50元其他费用，每月共支付金额200元;支付抚养费的时间从判决生效之日起至原告18周岁止。原告法定代理人贾随枝之前已经把被告的麦子，玉米等拉走许多，已经冲抵了原告的抚养费。 原告为支持其诉讼请求向本院提交如下证据:1.2008年12月20日离婚协议一份，证明原告抚养费支付时间应该从2008年12月20日起算，原告抚养费应由被告全部承担;2.离婚证一份，证明贾随枝与被告的关系;3.居民户口本一本，证明原告的出生日期。 上述证据被告郭元平均无异议。 经审查本院认为，原告提交的证据真实合法，与本案具有关联性，本院予以采信。 被告未提交证据。 本院依据认定的证据，确认如下事实:郭元平与贾随枝原系夫妻关系，婚后经贾随枝与被告郭元平协商抱养女孩一名，取名郭某某(2001年1月30日出生)，现就读于郑州经济技术开发区潮河办事处二郎庙村 小学 小学生如何制作手抄报课件柳垭小学关于三违自查自纠报告小学英语获奖优质说课课件小学足球课教案全集小学语文新课程标准测试题 四年级。2008年12月17日，贾随枝与被告郭元平感情不和双方在郑州经济技术开发区民政局协议离婚。2008年12月20日，贾随枝与被告郭元平就子女抚养及财产部分达成协议，约定:“一、子女分配，女儿一个，有女方抚养，抚养费有男方出;二、财产有男方所有;三、房产归男女双方一人一半;4、债务有男方还”。2010年3月31日，原告郭某某起诉至本院，请求判令被告郭元平支付原告生活费每月600元，从2008年12月20日起算至原告18周岁止;本案诉讼费用由被告承担。 另查明，原告郭某某与其母亲贾随枝在郑州经济技术开发区潮河办事处司庄村均无耕地。 本院认为:离婚后，一方抚养子女的，另一方应负担必要的生活费和教育费的一部或全部，负担费用的多少和期限的长短，由双方协商;协商不成时，由人民法院判决。关于子女生活费和教育费的协议或判决，不妨碍子女在必要时向父母任何一方提出超过协议或判决原定数额的合理要求。本案中，被告郭元平与贾随枝就原告抚养已达成协议，约定:原告随贾随枝生活，抚养费由被告承担。本院认为，该协议不违反国家法律和行政法规的强制性规定，urban area 2.5.2 Yibin city in Yibin city, according to resource and environment characteristics Urban population and urban spatial distribution, spatial distribution of industries, major infrastructure Corridor layout, combined with the future development trend of synthetic judgments, planning, urban spatial structure of urban system can be summarized as: "a pole along the two axes". Along the main traffic arteries to implement "point-axis development" mode key repeatedly, Shahe town, Xiao Zhen, Luo table Zhen, Luo town, love Mu Zhen and other towns as district development focuses on cities and towns, promote the development of district 以及郭某经济条件明显提高或改变的相关证据 原审法院认为，父母与子女间的关系，不因父母离婚而消除。离婚后，父母对于子女仍有抚养和教育的权利和义务。父母不履行抚养义务时，未 成年的或不能独立生活的子女，有要求父母给付抚育费的权利。虽然石某与费某在离婚调解书上商定，石某的抚养费由其父石某负担，但并不能就此免去费某作为母亲所应履行的法定的抚养义务。石某尚未 成年，不能独立生活，有要求父母给付抚育费的权利。故石某要求费某按月给付抚养费的请求，于法有据，应予支持。因石某未能提供相应证据证明费某目前的收入，故抚养费的数额由法院依据石某的实际需求及费某的经济状况酌情确定。据此，原审依据《中华人民共和国婚姻法》第三十六条、第三十七条之规定，判决:费某应自2010年2月起按月给付石某抚养费人民币250元，至石某18周岁止。 原审判决后，费某不服，向本院提起上诉称:上诉人与被上诉人父亲在离婚民事调解书中约定上诉人无需负担抚养费，现距该调解书作出只有一年多，原审判决没有查明被上诉人要求上诉人给付抚养费的必要性。故请求二审法院撤销原判，依法改判驳回被上诉人在原审中的诉讼请求。 被上诉人石某辩称:上诉人在与被上诉人父亲离婚前就把被上诉人全托在别人家里，现在仍然如此，这笔费用每月就要1000元，还有吃饭、教育、医疗等各项费用，现被上诉人读小学四年级，各种学习费用都有增加。故不同意上诉人的上诉要求，请求二审法院驳回上诉，维持原判。 本院经审理查明，原审法院认定的事实无误，本院予以确认。 本院认为，关于子女生活费和教育费的协议或判决，不妨碍子女在必要时向父母任何一方提出超过协议或判决原定数额的合理要求。上诉人费某与被上诉人父亲的离婚调解书中确定上诉人不负担被上诉人的抚养费，但现在被上诉人从成长需要及学习费用增加角度出发，请求上诉人负担抚养费，原审根据当事人实际情况确定上诉人现在应承担的抚养费金额并无不当。上诉人的上诉请求均缺乏事实依据和法律依据，本院难以支持。依照《中华人民共和国民事诉讼法》第一百五十三条第一款第(一)项之规定，判决如下: 驳回上诉，维持原判。 二审案件受理费人民币80元，由上诉人费某负担。 本判决为终审判决。 审 判 长 吕晓华 代理审判员 余 宇 代理审判员沈 珺 urban area 2.5.2 Yibin city in Yibin city, according to resource and environment characteristics Urban population and urban spatial distribution, spatial distribution of industries, major infrastructure Corridor layout, combined with the future development trend of synthetic judgments, planning, urban spatial structure of urban system can be summarized as: "a pole along the two axes".
