郑州市房屋租赁管理条例(RegulationsofZhengzhouMunicipalityontheadministrationofhouselease)郑州市房屋租赁管理条例(RegulationsofZhengzhouMunicipalityontheadministrationofhouselease)StandingCommitteeoftheEleventhPeople'sCongressofZhengzhouinAugust,ThethirtiethmeetingwasadoptedbytheNinthPeople'sCongressofHenanprovinceinNovember,ApprovalofthethirtyfirstmeetingoftheStandingCommitteeofthegeneralassemblyChapterIGeneralProvisionsArticleinordertostrengthenthemanagementofcityhousingrental,maintenanceHousingrentalhousingrentalmarketorder,protectthelegitimaterightsandinterestsofparties,accordingtothe"People'sRepublicofChinaCityrealestatemanagementlaw"andotherrelevantlawsandregulations,combinedwiththeactualsituationofthecity,theenactmentofthisordinanceTheterm"houselease"asmentionedintheseRegulationsreferstotheactofacitizen,alegalpersonorotherorganizationasalessor,whoownstheownershipofthehouseandrentsittothelessee,andthelesseepaystherenttothelessorofthesecondThirdofthefollowingactsareconsideredrentalhousing:()thesupplyofspaceorfacilitiesandequipmentwithinthepremisestoothersforuseonthespot(two)providinghousingfortheuseofothersinthenameofjointventureandshares,etc,withfixedincomeandnoresponsibilityforprofitandloss(three)providinghousingtoothersforthepurposeofsolvingtheproblemofsalary,welfareandotherformsofsalaryofemployeesintheformofothers'contribution(four)providinghousinginotherformsfortheuseofothersFourthinthecity(excludingstreets)withinthescopeofrentalhousing,theapplicationofthisordinanceTheseRegulationsshallnotapplytothepublichousingandlowrenthousingrentalofthegovernmentTheleaseofthefifthhousesfollowstheprincipleofvoluntariness,compensation,fairnessandgoodfaithSixthmunicipalpeople'sgovernment,therealestatemanagementdepartmentinchargeofthecity'shousingrentalmanagementCity,industryandcommerce,taxation,publicsecurity,price,finance,landandotherrelevantdepartmentsshall,withinthescopeoftheirrespectiveduties,doagoodjobinthemanagementofurbanhouseleasingThesecondchapterisregistrationmanagementSeventhhousingrentalregistrationsystemTheestablishment,alterationandterminationoftheleaserelationshipshallbefiledwiththemunicipalrealestateadministrativedepartmentwithinfifteendaysfromthedateofsigning,changingorterminatingtheleasecontract,andthefollowingmaterialsorcertificatesshallbeappliedtothemunicipalrealestateadministrationdepartmentforregistration:()theidentityorqualificationofthelessorandlessee(two)allcertificatesofownershiporotherlegaldocumentsofthehouse(three)leasecontract(four)therentalofcommonhousing,theneedtosubmitothercoownersagreedtoleasewrittenproof(five)therentaloftheentrustedhousing,theneedtosubmitaletterofauthorizationentrustedtotherentalofclientsclientsoutsidethecountry,therentalcertificatemustbenotarizedaccordingtolaw(six)othermaterialsorcertificatesprescribedbylaws,regulationsandregulationsMilitaryHousingleasingshallbehandledinaccordancewiththerelevantprovisionsofthearmy'srealestateleasemanagementEighthhousesunderanyofthefollowingcircumstancesshallnotbeleased:()withouttheownershipofthehouseortheownershipofthehousewithouttherightofmanagement(two)theownershipisdisputed(three)thejointownershipofthehousehasnotbeenagreedinwritingbytheothercoowners(four)dangeroushousingorothermajorsecurityrisks(five)thejudicialorgansoradministrativelawenforcementorgansdecideanddecideonthesealingupinaccordancewiththelaw(six)inaccordancewiththelawpromulgatedthehousingunitswithinthescopeoftheannouncement(seven)illegalconstructionortemporaryconstructionoveraperiodoftime(eight)otherhousesprohibitedbylaws,regulationsandregulationsNinthrealestatemanagementdepartmentshall,withintenworkingdaysfromthedateofapplicationforregistration,reviewandonsiteverification,complywiththeprovisionsofthisOrdinance,shallberegisteredandissuedhousingrentalpermitsdonotconformtotheprovisionsoftheregulations,shallnotberegistered,butshallbegivenawrittenreplypartyTenthhousingleaseisaneffectivecertificateofhousingleasemanagementWhereahouseisengagedinproductionorbusinessactivities,thehouseleasecertificateshallbethelawfulcertificateoftherighttousethepremisesRentalhousingforhousing,housingrentalcertificateshouldbeusedasoneofthepublicsecuritydepartmentsfortemporaryresidenceregistrationdocumentsEleventhlosthousinglease,shouldapplyforreplacementoftheoriginalregistrationauthorityItisstrictlyprohibitedtoforge,alter,lend,transferofhousingrentalpermitsTwelfthhousingrentalregistration,thepartiesshouldtruthfullydeclaretherent,shallnotresorttodeceitArticlethirteenth,oneofthefollowingcircumstances,therealestatemanagementdepartmentsshouldcanceltherecordregistration,housingleaserecovery:(I)falsedeclaration(two)thelossofthehouse(three)housingmajorsecurityrisks,itisnotsuitableforcontinuedrentalRealestatemanagementreviewinappropriate,wrongregistration,ItshouldbepromptlyrectifiedFourteenthforthepurposeofprofit,housingownershipwillbetransferredtotheuseofstateownedlandontheleaseofhousing,therentalshouldbeincludedinthelandrevenuetothestateThespecificmeasuresforthecollectionoflandproceedsshallbeimplementedinaccordancewiththeregulationsoftheMunicipalPeople'sgovernmentFifteenthlessorsrentalhousingshouldpaytaxesinaccordancewiththelawTaxleviedbythetaxauthorities,butalsobythetaxauthoritiescommissionedbytherealestatemanagementcollectionSixteenthrealestatemanagementdepartmentsshouldberegularlyorirregularlyrentalhousingsupervisionandinspectionRealestatemanagersinthehousingrentalsupervisionandinspection,shouldproducelawenforcementcertificates,housinglessorsandlesseesshouldbecoordinated,andtruthfullyproviderelevantinformation,shallnotbeconcealedorfraudThethirdchapteristheleasecontractArticleseventeenthrentalhousing,lessorsandlesseesshouldsignawrittenleasecontract,youcanuseaunifiedmodeltextTherealestatemanagementdepartmentshallprovidethelessorandlesseeaunifiedmodelofhousingleasecontractfreeofchargeEighteenthhousingleasecontractshouldhavethefollowingterms:()thenameanddomicileofthepartyconcerned(two)thelocation,size,decorationandfacilitiesofthehouse(three)leasingpurposes(four)leaseterm(five)rentandpaymentmethod(six)housingrepairresponsibility(seven)subleaseagreement(eight)conditionsformodificationandterminationofthecontract(nine)theliabilityforbreachofcontractandthewaytosettlethedispute(ten)othertermsagreeduponbythepartiesThenineteenthleaseofpublichousingasabusinesspremises,thelessorandthelesseeagreedinthecontractrentwassignificantlylowerthanthenormalmarketprice,thepricedepartmentsofcertificationoftherentaspayrentalhousingtaxbasisHousingrentalcertificationmaynotbechargedtotheleasepartyTwentiethhousingleaseexpires,theleasecontractterminatedWherethelesseeneedstocontinuethelease,itshallbesubmittedbeforetheexpirationoftheleaseandrenegotiatetheleasecontractwiththelessorAttheexpirationofthelease,thelesseeshallhavepriorityintheleaseunderthesameconditionsDuringthetwentyfirsttenancyperiod,theownerofthehousetransferstheownershipofthehouse,andshallnotifythelesseeinadvancethreemonthsinadvanceUnderthesameconditions,thelesseeshallhavetherightofpreemptivepurchaseIftheownershipistransferredtothenonlessee,thetransfereeshallcontinuetoundertaketheobligationsandenjoytherightsasstipulatedintheoriginalleasecontractWherethelessordiesduringtheleaseterm,theownerofthehousepropertyshallcontinuetoperformtheleasecontractWherethelesseedieswithinthetermofthelease,thepersonwhohaslivedtogetherwithhimmayleasethehouseinaccordancewiththeoriginalleasecontractDuringtheleaseterm,incaseofthechangeoftheinstitutionandtheannexation,thenewownerofthehouseshallcontinuetoperformtheleasecontractifthepartyconcernedfails,itshallbeimplementedinaccordancewiththerelevantlawsandregulationsWhentheownerofthetwentysecondhouserentsthemortgagedhouseorrentsthehouseformortgage,thelesseeshallnotifythelesseeinwritingandnotifythemortgageeoftheleaseThefourthchapteristherightsandobligationsofthepartiesThetwentythirdlessorshall,inaccordancewiththeleasecontract,providethelesseewiththehouseforrentcollectionWhenthelessorcollectstherent,heshallissuespecialnotesprintedbythetaxationdepartmentWherethelessordoesnotmakeabill,thelesseemayrefusetopaytherentTwentyfourthLessorsintheleaseperiod,itisnecessarytorecoverthehousinginadvance,shouldaskforconsentofthelesseeIfanylossismadetothelessee,heshallbeliableforcompensationTwentyfifthlessorsshouldbeinaccordancewiththeleasecontractresponsibility,responsiblefortheinspectionandmaintenanceofhousinganditsfacilities,toensurehousingsafetyIfthehouseisdamagedduetoimpropermaintenance,thelesseeshallbeliableforcompensationThelessorshallhavetherighttosupervisetheuseofthehousebythelessee,butshallnotdisturborhinderthenormalandrationaluseofthehousebythelesseeThelessortothelesseetheuseofrentalhousingtoinfluenceothersnormalproductionandlife,shouldbestoppedthelesseefoundillegalandcriminalactivitiesbythelease,itshallreporttothepublicsecuritydepartmentsinatimelymannerTwentysixthofthelessorintherentalperiodofrentalhousingrenovation,expansionorrenovation,andthelesseeshallhousingrenovation,expansionorrenovationoftherentandtenantlosscompensationandothermattersagreedtosignawrittenagreementshallbecarriedoutThelesseeshalltakegoodcareoftheleaseandmakereasonableuseoftheleasedpremisesaccordingtotheleasecontract,andmaynotalter,extend,decorateorchangetheuseofthehouseWherethelesseereallyneedstorebuild,expand,decorateorchangetheuseofthehouse,thelessorshallobtainthewrittenconsentofthelessorWhereapartyconcernedinahouseleaseneedstochangethestructureofahousewithinthetermofleaseduetothealteration,expansionorrenovationofthehouse,itshallbereportedtotherelevantdepartmentforapprovalThetwentyseventhlesseeshallpaytherenttothelessorinaccordancewiththeleasecontract,andshallhavetherighttorefusethelessortocollectotherfeesotherthanthenatureoftheleasestipulatedintheleasecontractDuringthetwentyeighthtermofthelease,thelesseeshallcontinuetoundertaketheobligationtopaytherentwithoutthelessee'ssuspensionoftheuseofthehousewithouttheconsentofthelessorUnlessotherwiseagreeduponbythepartiesTwentyninthhousingleaseexpires,thelesseeandtheLessoragreesornotarenewalagreementwithoutthelessorandthelesseefailstomoveout,inadditiontopaytherent,shallpayliquidateddamagesaccordingtothecontractthecontractagreement,payliquidateddamagestothelessoraccordingtotheoriginalfifteenpercentoftherenttorentmadelosses,shallbeartheliabilityforcompensationDuringthethirtiethrentalhousing,emergencysafety,thelesseecantakethenecessaryemergencymeasures,andimmediatelynotifythelessortonotifythelessorshouldbetimelymaintenancenottimelymaintenanceofthehousing,thelesseecanselfrepair,thecostbornebythelessorDuringthelease,thethirtyfirstlesseemaysubletpartoralloftheleasedhousetothirdpersonswiththeconsentofthelessorInfact,torentthehouse,sublessorsublesseeshallsignasubleasecontract,andhandletheregistrationformalitiesaccordingtotheprovisionsofarticleseventhofthisordinanceThirtysecondlessee,thelesseeusingrentalhousing,shallnotaffectthenormalproductionandlifeofothers,shallnotengageincriminalactivitiesThefifthchapter,legalresponsibilityArticlethirtythirdinviolationoftheprovisionsoftheseregulations,oneofthefollowingacts,thecityrealestatemanagementinaccordancewiththefollowingprovisionsofpunishment:Ifahouseisleasedorsubletwithoutregistration,itshallbeorderedtoresubmititwithinatimelimitiftheregistrationisnotmadeafterthetimelimitisoverdue,thelessorshallbeimposedafineofnotlessthanonepercentoftherent(two)inviolationoftheprovisionsstipulatedinarticleeighthoftherentalhousing,therentalinvalid,itshallbeorderedtomakecorrections,confiscatetheillegalincomeinviolationofarticle(a),(two),(four),(five)andifthecircumstancesareserious,punishablebyafineoftwotimestheillegalincome(three)inviolationoftheprovisionsoftheeleventhandsecondparagraphoftheseregulations,thehouseleasecertificateiscancelledandtheillegalgainsareconfiscatedThereisnoillegalincome,rentalhousingforhousing,onehundredyuanmorethanfivehundredyuanfinerentalhousingforoperating,morethanonethousandyuanandfivethousandyuanfine(four)inviolationoftheprovisionsoftheprovisionsofarticletwelfth,itshallbeorderedtocorrectifthecircumstancesareserious,punishablebyafineoftwotimesthetotalrentconcealedThirtyfourthinviolationoftheprovisionsofarticlefourteenthoftheregulations,nottopaylandrevenue,landtaxrevenueshallbeimposedifherefusestomakecorrections,punishablebynotpaylandrevenuepaymentsdoubledfinesIfthelessorfailstopaythelandincomeontime,theoverduefineofofthelandproceedsshallbechargedforeachdayoverdueThirtyfifthinviolationoftheprovisionsoftheprovisionsofarticlethirtysecond,thepublicsecurity,qualityandtechnicalsupervision,industryandcommerce,health,environmentalprotectionandotherdepartmentsshallbepunishedinaccordancewithrelevantregulationsconstituteacrime,shallbeinvestigatedforcriminalresponsibilityaccordingtolawThirtysixthrealestatemanagementdepartmentsandstaffduties,inthemanagementofrentalhousing,inbreachofprivilegefavoritism,bribery,bytherelevantorgansoftheresponsiblepersonnelshallbegivenadministrativesanctionsconstituteacrime,shallbeinvestigatedforcriminalresponsibilityaccordingtolawIflossesarecausedtotheparties,andthestatecompensationmeetstherequirementsofthestate,compensationshallbemadeThesixthchapteristhesupplementaryprovisionsThirtyseventhcounties(cities),thestreetsofthecityhousingrentalmanagement,withreferencetotheimplementationoftheseregulationsThesethirtyeighthregulationsshallcomeintoforceonJanuary,
