hattheirproductscomplywiththerequiredenergyconservationstandardsandtoratetheefficiencyoftheirproductsThesetestprocedureswouldalsobeusedduringenforcementrelatedtestingwhendeterminingwhetheragivenproductcomplieswiththerelevantstandardsToday’sfinalruleprovides,amongotherthings,anewactivemodeenergyconsumptiontestprocedureforbatterychargers,whichisnecessarytodevelopenergyconservationstandardsforbatterychargersasmandatedbytheEnergyIndependenceandSecurityActof(EISA)Today’srulealsoVerDateMar<>:May,JktPOFrmFmtSfmtE:FRFMJNRSGMJNRmstockstillonDSKVPTVNPRODwithRULESFederalRegisterVol,NoWednesday,June,RulesandRegulationsmodifiestheexistingprocedurefoundinappendixYtoCFRpart,subpartBInparticular,thetestprocedurethatDOEisadoptingtodayprovidesauniformmethodtotesttheenergyefficiencyofabatterycharger,whichisanecessaryprerequisitetothesettingofanyenergyconservationstandardfortheseproductsConsequently,DOEispromulgatingtoday’sruleinanticipationofthefinalrulethatwillsetstandardsforbatterychargersAdditionally,today’sruleintroducesotherchangestotheproceduresfoundinCFR,subpartB,appendixZ,whichcoverstheenergyefficiencytestingofanexternalpowersupplyInparticular,theruleamendsaspectsofthecurrentprocedurewhenmeasuringtheenergyconsumptionofaClassAexternalpowersupplyAClassAexternalpowersupplyisonethatis:designedtoconvertlinevoltageACinputintolowervoltageACorDCoutputabletoconverttoonlyACorDCoutputvoltageatatimesoldwith,orintendedtobeusedwith,aseparateenduseproductthatconstitutestheprimaryloadcontainedinaseparatephysicalenclosurefromtheenduseproductisconnectedtotheenduseproductviaaremovableorhardwiredmalefemaleelectricalconnection,cable,cord,orotherwiringandhasnameplateoutputpowerthatislessthanorequaltowattsSeeUSC()(C)Today’srulealsoaddsaproceduretofacilitatetestingofamultiplevoltageexternalpowersupplyThetestprocedurerequiresloadingthemultiplevoltageexternalpowersupplyatfiveseparateloadinglevelsandrequiresthatthesefiveoutputsbereportedindividuallyEPCAsetsforthgenerallyapplicablecriteriaandproceduresforDOE’sadoptionandamendmentofsuchtestproceduresSeegenerallyUSCAspartoftheserequirements,theproceduresmustbereasonablydesignedtomeasuretheenergyuse,energyefficiency,orannualoperatingcostduringaperiodthatisrepresentativeoftypicaluseandnotbe‘‘undulyburdensome’’(USC(b)())Inaddition,consistentwithUSC(b)()andExecutiveOrder,FR(Dec,),ifDOEdeterminesthatatestprocedureamendmentiswarranted,itmustpublishproposedtestproceduresandofferthepublicanopportunitytopresentoralandwrittencommentsonthem,withacommentperiodofnotlessthandaysFinally,inanyrulemakingtoamendatestprocedure,DOEmustdetermine‘‘towhatextenttheproposedtestprocedurewouldalterthemeasuredenergyefficiencyasdeterminedundertheexistingtestprocedure’’(USC(e)())IfDOEdeterminesthattheamendedtestprocedurewouldalterthemeasuredefficiencyofacoveredproduct,DOEmustamendtheapplicableenergyconservationstandardaccordingly(USC(e)())DOEdiscussesitsconsiderationoftheamendmentstothetestproceduresforbatterychargersandexternalpowersuppliesinthesectionthatfollowsDOEpublishedanoticeofproposedrulemaking(NOPR)onApril,(FR)inwhichitdiscussedinmoredetailmanyofthetestingissuesbroughtforwardintheframeworkdocumentandanaccompanyingpublicmeetingtodiscusstheapproachthatDOEplannedtouseinsettingenergyconservationstandardsforbatterychargersandexternalpowersuppliesSeeFR(June,)(discussingtheframeworkdocumentforbatterychargersandexternalpowersupplies)(ThepublicmeetingdiscussingtheframeworkdocumentwasheldonJuly,ThatmeetingalsoincludeddiscussionsrelatedtotestprocedureissuesArelatedmeetingtodiscussthepreliminaryanalysisDOEperformedinexaminingstandardsfortheseproductsalsogeneratedsomediscussionrelatedtotestprocedureissues)DOEheldapublicmeetingtodiscussitstestprocedureNOPRonMay,,whereitalsoreceivedcommentsontheproposalssetforthintheNOPR(hereafterreferredtoastheNOPRpublicmeeting)AdaycommentperiodasprescribedbyEPCAwasaffordedtointerestedpartiesBatterychargersandexternalpowersuppliesoperatesimilarlyinthattheybothtakeelectricityfromapowersource,usuallyfromawalloutlet,andconvertitintoaformthatcanbeusedeithertopoweranapplicationdirectlyortochargeandmaintaintheenergyinabatterySpecifically,theybothtakepoweratonevoltageandcurrenttype,typicallyvoltsalternatingcurrent(AC),andconvertittolowervoltagedirectcurrent(DC)powerBecausetheseproductsoperateinasimilarmanner,DOEisconsolidatingitsevaluationofpotentialenergyconservationstandardsforbatterychargersandexternalpowersuppliestogetherinasinglerulemakingproceedingAdditionaldetailsrelatedtotheauthorityandbackgroundofthisrulemakingcanbefoundinsectionIoftheNOPRFR,–IISummaryoftheFinalRuleToday’sfinalruledoestwokeythingsFirst,itadoptsnewtestproceduresfortheactivemodeofbatterychargersandallmodesofmultiplevoltageexternalpowersuppliesSecond,itmodifiesexistingpartsofthebatterychargerandexternalpowersupplytestprocedures(forexample,thedurationofthebatterychargerstandbyandoffmodetests)Indoingso,itamendsbothappendicesYandZinmultipleplacesFurthermore,althoughDOEisretainingthecurrentlanguageofcertainsectionsofappendicesYandZ,inse
