BRAZORIA COUNTY COMMISSIONERS’ COURT SPECIAL SESSION - AUGUST 26, 2003 VOLUME 45 PAGE 740 ORDER NO. 7 RE: INTERLOCAL AGREEMENT WITH THE CITY OF BRAZORIA CONCERNING THE PLANNING, ENGINEERING AND OBTAINING GRANTS FOR THE HISTORIC BRIDGE* Motion by Commissioner Payne, seconded by Commissioner Stanley that the following action be taken by the Court: Approve the Interlocal Agreement between the City of Brazoria and the County of Brazoria concerning the joint planning and engineering process, and seeking grants and awards for the historic bridge within the City of Brazoria. Further that the County Judge be authorized to sign said agreement on behalf of Brazoria County. Motion carried, all present voting aye. ORDER NO. 8 RE: INTERLOCAL AGREEMENT CONCERNING THE REGULATION OF SUBDIVISION PLATTING - TOWN OF QUINTANA* Motion by Commissioner Payne, seconded by Commissioner Stanley that the following action be taken by the Court: Approve the Interlocal Agreement Concerning the Regulation of Subdivision Platting with the Town of Quintana, Texas. Further that the County Judge be authorized to sign said agreement on behalf of Brazoria County. Motion carried, all present voting aye. ORDER NO. 9 RE: AMENDMENT TO SECTION (2) (h) OF THE GUIDELINES & CRITERIA ON TAX ABATEMENT Motion by Commissioner Payne, seconded by Commissioner Stanley that the following action be taken by the Court: 1. The Court approves amending Section (2) (h) of the Brazoria County “Guidelines and Criteria for Granting Tax Abatement” by adding the following subsection (8): (8) must not file with the Brazoria County Appraisal District a valuation or taxpayer protest during the abatement period or otherwise legally protest or challenge the valuation of the abated improvements of a manufacturing facility pursuant to an appraisal method that produces a valuation of improvements based on each improvement’s value as a separate item of personal property rather than the improvements’ value as integral fixtures of a producing manufacturing facility; and/or must not file with the Brazoria County Appraisal District a valuation or taxpayer protest during the abatement period or otherwise legally protest or challenge the valuation of the abated improvements of any facility at a valuation amount or by a valuation method that valuates the abated improvements at less than the value stated in the tax abatement application or in the tax abatement agreement (as the estimated value of abated improvements after the abatement agreement expires or at the end of the abatement agreement). The filing of such valuation protest or challenge BRAZORIA COUNTY COMMISSIONERS’ COURT SPECIAL SESSION - AUGUST 26, 2003 VOLUME 45 PAGE 741 shall cause the tax abatement agreement to be subject to termination and recapture of all previously abated taxes. 2. The Court approves and adopts this amendment effective this date, and the amendment shall be applicable to any pending tax abatement application or pending tax abatement agreement. Subject to final review of the Civil Division of the District Attorney’s office of Brazoria County. Motion carried, all present voting aye. ORDER NO. 16 RE: PERMISSION TO ADVERTISE FOR BIDS FOR ITB #03-65 ELEVATOR AT BRAZORIA COUNTY FACILITY IN FREEPORT Motion by Commissioner Payne, seconded by Commissioner Stanley that the following action be taken by the Court: That upon recommendation of the County Purchasing Agent, permission is requested to advertise for bids under the Competitive Bidding Procedure, for an elevator at the Brazoria County facility in Freeport. Further, that the Court allow the Purchasing Agent to award contract to the lowest and best bidder meeting specifications. Awarded Contract shall be subject to the review and approval of the District Attorney Civil Division. Further, that the County Judge be authorized to sign said Contract on behalf of Brazoria County. ORDER NO. 20 RE: APPROVE PROJECTS UNDER BLANKET INTERLOCAL AGREEMENTS FOR DIRECT ASSISTANCE TO CITIES AND TOWNS Motion by Commissioner Payne, seconded by Commissioner Stanley that the following action be taken by the Court: That pursuant to provisions of Ch. 251.012, Transportation Code, as amended by act of the State legislature on May 26, 1999, this Court hereby finds that the County will receive benefit as a result of the work on the streets or alleys listed below; and the following projects are approved to be completed as Road and Bridge Department schedules permit, and with all materials furnished by the cities, in accordance with Interlocal agreements approved by the Court and the applicable City Councils. Further, that the County Engineer is authorized to sign acceptance statements for the approved projects at the appropriate time and to authorize the work. ORDER NO. 21 RE: INTERLOCAL AGREEMENT WITH THE VELASCO DRAINAGE DISTRICT NO. 2 TO OVERLAY THE OYSTER CREEK EXTENSION LEVEE SOUTH FROM STRATTON RIDGE ROAD TO THE CURRY PROPERTY (PRECINCT 1) (NO. 03-0021)* Motion by Commissioner Payne, seconded by Commissioner Stanley that the following action be taken by the Court: That the Interlocal Agreement with the Velasco Drainage District No. 2 be approved to provide assistance in overlaying the Oyster Creek Extension Levee south from Stratton Ridge Road to the Curry Property within an easement belonging to the District, pursuant to Texas Transportation Code Sec. 251.015, and the Interlocal Cooperation Act, Tex. Gov. Code Sec. 791.001 et. Seq. Further, that under the terms of the Agreement, attached as Exhibit A, the County will supply equipment with operators to overlay the Oyster Creek Extension Levee south from Stratton Ridge Road to the Curry Property. The County Judge is authorized to sign the above-referenced Interlocal Agreement on behalf of the County. A certified copy of this order shall be forwarded to the County Engineer. BRAZORIA COUNTY COMMISSIONERS’ COURT SPECIAL SESSION - AUGUST 26, 2003 VOLUME 45 PAGE 746 ORDER NO. 22 RE: INTERLOCAL AGREEMENT WITH THE ANGLETON INDEPENDENT SCHOOL DISTRICT TO CONSTRUCT A NEW JOGGING TRACK AT SOUTHSIDE ELEMENTARY (PRECINCT 1) NO. 03-0022 Motion by Commissioner Payne, seconded by Commissioner Stanley that the following action be taken by the Court: That the Interlocal Agreement with the Angleton Independent School District be approved to furnish labor and equipment to construct a new jogging track at Southside Elementary, on property owned by the District, and with all materials to be furnished by the District, pursuant to Texas Transportation Code Sec. 251.015, and the Interlocal Cooperation Act, Tex. Gov. Code Sec. 791.001 et. Seq. Reimbursement shall be made to the County for personnel and equipment, if such costs exceed $5,000. Further, that under the terms of the Agreement, attached as Exhibit A, the County will supply equipment with operators to overlay the jogging track at Southside Elementary. BRAZORIA COUNTY COMMISSIONERS’ COURT SPECIAL SESSION - AUGUST 26, 2003 VOLUME 45 PAGE 750 ORDER NO. 27 RE: CONDITIONAL ACCEPTANCE OF ROAD - SILVERLAKE WAL-MART (PRECINCT 2)* Motion by Commissioner Payne, seconded by Commissioner Stanley that the following action be taken by the Court: Whereas additional right of way for County Road 94 was dedicated to Brazoria County by a deed recorded under Clerk’s File No. 02-020463 and to the public on the plat of Silverlake Wal-Mart, Abstract 304, approved by the City of Pearland and filed for record in volume 23, pages 97-98 of the Brazoria County plat records, and Whereas, improvements to a 985-foot long section of County Road 94 adjacent to said subdivision have now been constructed in accordance with the Brazoria County Subdivision Regulations, Therefore, said road improvements to County 94 shall be accepted conditional upon completion of a three-year period of maintenance at the expense of the owner, and said three-year period shall begin this date. Further, that a certified copy of this order be furnished to the County Engineer. Motion carried, all present voting aye. ORDER NO. 28 RE: APPROVE VARIANCE REQUEST FOR DIVISION OF BILLY DON TIDWELL TRACT IN ABSTRACT 22 (PRECINCT 1)* Motion by Commissioner Payne, seconded by Commissioner Stanley that the following action be taken by the Court: 1) The Court finds that: a) Stephen R. Flores and Billy Don Tidwell have a variance from subdivision regulations, by letter and drawing attached as Exhibits “ENG-A” and “ENG-B”, and b) The variance requested by Mr. Flores and Mr. Tidwell is for the sole purpose of changing the property line between tracts identified as tracts 11 and 12 out of Indian Acres, an unrecorded subdivision in Abstract 222, located on County Road 431, said tracts both being owned by Mr. Tidwell, and being identified on the Tax Rolls as tracts 14J25 and 14J24, and c) The proposed division is not an actual subdivision of land contemplated by 232.001 of the Texas Local Government Code, because no new tract is being created, and d) The change in the property line between said Tidwell tracts using a metes and bounds description to be prepared by a registered professional land surveyor is appropriate. 2) It is ordered, since the requirements of the Brazoria County Subdivision Regulations Article X (A)(2)(a) and (b) have been met, that a variance to the requirement for filing a plat of the division of said Tidwell tracts be granted. This variance is granted upon the following conditions: BRAZORIA COUNTY COMMISSIONERS’ COURT SPECIAL SESSION - AUGUST 26, 2003 VOLUME 45 PAGE 751 a) The applicant must present a letter from the Brazoria County Health Department stating they have no objection to the proposed division. b) The portions to be divided out of the Tidwell tracts may only be conveyed along with the adjoining tracts, and c) Any further division of any of the affected lots must conform to the Brazoria County Subdivision Regulations. 3) It is ordered that, upon receipt by the County Engineer of the aforesaid letter of approval from the Health Department, a certified copy of this order be recorded in the official records of Brazoria County at the expense of the applicant, and then delivered to the County Engineer. Further, that a certified copy of this order be furnished to the County Engineer. Motion carried, all present voting aye. AMOCO CHEMICAL COMPANY TAX ABATEMENT APPLICATION: ORDER GRANTING TAX ABATEMENT* Motion by Commissioner Payne, seconded by Commissioner Harris that the following action be taken by the Court: That the application for tax abatement of B.P. AMOCO CHEMICAL COMPANY be granted in accordance with the Guidelines and Criteria for Granting Tax Abatement in a Reinvestment Zone created in Brazoria County; that the subject location described in the attached application be designated a reinvestment zone for tax abatement purposes in accordance with the BRAZORIA COUNTY COMMISSIONERS’ COURT SPECIAL SESSION - AUGUST 26, 2003 VOLUME 45 PAGE 753 guidelines and criteria of Brazoria County and applicable law; that a variance be granted from the provisions of Section 2(b) and 2(g) of the Brazoria County Guidelines and Criteria for granting tax abatement to allow improvements constructed after the application date and prior to the tax abatement agreement date to qualify as improvements eligible for abatement; that the County Judge is authorized to execute a tax abatement agreement with B.P. AMOCO CHEMICAL COMPANY in accordance with the same guidelines an criteria; and further provided that such agreement shall contain a special provision that the agreement shall be terminated with recapture of taxes if a taxpayer valuation protest is filed by B.P. Amoco Chemical Company claiming a valuation of improvements based on an appraisal method appraising each improvement separately as personal property rather than the improvements’ value as integral fixtures of a producing manufacturing facility, or if a valuation protest is filed that valuates the abated improvements at less than the value stated in the tax abatement application or in the tax abatement agreement as the estimated value of abated improvements after the abatement agreement expires or at the end of the abatement agreement. The Court Finds that the health needs and requirements of the inmate population at the Brazoria County Detention Center can best be met by entering into an agreement with the University of Texas Medical Branch at Galveston to provide health care related services. 2. The Court approves the Interlocal Agreement to Provide Medical Services between the University of Texas Medical Branch at Galveston for an annual rate of $1,560,000 for a population not to exceed 750 and for an additional $4.00 per inmate for those above 750 for the year beginning October 1, 2003 and for an annual rate of $1,599,000 for a population not to exceed 750 and for an additional $4.00 per inmate for those above 750 for the year beginning October 1, 2004, payable monthly. 3. The Court finds that the proposed division of 46.6 acres by James and Barbara Dixon into four tracts to be owned by individuals who are within the third degree of affinity or consanguinity as defined by Texas Government Code Chapter 573 of the grantors constitutes a division excepted by Texas Local Government Code ?232.0015(e) except as to creating a tract described by Texas Local Government Code ?232.001 (a) (3). 2. The Court orders that a variance be granted authorizing the subdivision contingent on the following conditions: i. That all parties to the subdivision enter into a recordable covenant that runs with the tracts described that in the event a tract is sold to an individual who is not related to grantors within the third degree of affinity or consanguinity or is a direct descendant thereof than the tracts described shall be platted in conformance with the Brazoria County Subdivision Regulations; and ii. The Court finds that the County has previously entered into an Administrative Services Agreement with Blue Cross Blue Shield of Texas to manage a County self funded employee health benefits plan which pursuant to Section 5.01 of said agreement continues “in full force and effect from plan year to plan year” and which has not been terminated by either party to the agreement and that the conditions of said agreement should be renegotiated to reflect the administrative costs and experience of the County employee population. 2. BRAZORIA COUNTY COMMISSIONERS’ COURT SPECIAL SESSION - AUGUST 26, 2003 VOLUME 45 PAGE 766 ORDER NO. 60 RE: RESOLUTION FINDING AND DECLARING THE NEED FOR THE HOUSING AUTHORITY OF BRAZORIA COUNTY* Motion by Commissioner Payne, seconded by Commissioner Stanley that the following action be taken by the Court: Approve the Resolution finding and declaring the need for the Housing Authority of Brazoria County, Texas to function. (See Page 766A) Motion carried, all present voting aye. At 10:10 A.M. Judge Willy recessed this special session by Commissioners Court and at 10:22 A.M. entered into a Workshop with all members present to discuss the following: A.
