Excavation began only in the late 1980 of the 20th century research and engineering practice on comprehensive and in-depth, but with the development of China's construction, the city's high-rise buildings springing, which greatly promoted the development of theory and construction technology of deep Foundation pit engineering design, has also produced a large number of deep Foundation pit support 第十四条 机关、社会团体、企业事业组织应当做好本单位的计划生育工作。 实行机关、社会团体、企业事业组织法定代表人或者主要负责人计划生育工作责任制。 机关、社会团体、企业事业组织应当确定计划生育管理机构、配备专(兼)职工作人员，具体承担本单位的计划生育工作。 第十五条 计划生育协会应当组织群众开展计划生育自我管理、自我教育和自我服务活动，发挥会员在计划生育工作中的示范、宣传、服务和监督作用，协助政府实施人口与计划生育实施方案。 第十六条 各级人民政府应当将人口与计划生育经费纳入财政预算，并逐步提高经费投入的总体水平，人口与计划生育事业费应当不低于国家规定的标准。 各级人民政府应当对贫困地区的人口与计划生育工作予以重点扶持。 鼓励社会团体、企业事业组织和个人为人口与计划生育事业提供捐助。 任何单位和个人不得截留、克扣、挪用人口与计划生育经费。 第十七条 人口和计划生育、教育、科技、文化、卫生、民政、新闻出版、广播电视、司法行政等部门应当组织开展人口与计划生育宣传教育。 报纸、广播、电视等新闻媒体负有开展人口与计划生育社会公益性宣传的义务。 学校应当开展有关人口与计划生育的国情教育，并以符合受教育者特征的适当方式，有计划地开展生理卫生教育、青春期教育或者性健康教育。 第十八条 乡(镇)人民政府、街道办事处或者受其委托的企业事业组织、村民委员会、居民委员会可以与已婚育龄人员签订计划生育合同。 计划生育合同应当明确双方的权利、义务和违约责任，可以设定违约金。 计划生育合同的格式由省人口和计划生育行政部门制定。 第三章 生育调节 第十九条 公民有生育的权利，也有依法实行计划生育的义务，夫妻双方在实行计划生育中负有共同的责任。 第二十条 有下列情况之一的夫妻，可以申请再生育: (一)双方均为独生子女，只生育一个子女的; (二)双方均为少数民族，只生育一个子女的; (三)双方均为归国华侨，或者来本省定居不满6年的香港、澳门、台湾地区居民，只有一个子女在内地定居的; (四)再婚夫妻，再婚前生育子女合计不超过两个的，但不适用于复婚夫妻; (五)婚后不育，夫妻双方均满30周岁，依法收养一个子女的; (六)第一个子女为残疾儿，不能成长为正常劳动力，医学上认为可以再生育的; (七)夫妻一方为一级至六级的残疾军人，一级至五级的因公(工)致残人员，只生育一个子女的; (八)矿工井下作业连续5年以上，并继续从事井下工作，只生育一个女孩的; (九)农村夫妻一方是独生子女，只生育一个子女的; (十)男方到女方家落户且女方没有兄弟的农村夫妻，只生育一个子女的(仅适用女方姐妹中一人); (十一)农村夫妻只生育一个女孩的; (十二)大山区的乡，女方在农村，只生育一个女孩的。 村民委员会成建制转为居民委员会，其居民未享受城镇居民社会保障和福利待遇的，可以继续适用本条例中有关农民的规定;已经享受城镇居民社会保障和福利待遇的，三年内可以继续适用本条例中有关农民的规定;但国家工作人员除外。 第二十一条 符合本条例第二十条规定，但有下列情形之一的，不予批准再生育: authenticity, accuracy of the information. Excavation began only in the late 1980 of the 20th century research and engineering practice on comprehensive and in-depth, but with the development of China's construction, the city's high-rise buildings springing, which greatly promoted the development of theory and construction technology of deep Foundation pit engineering design, has also produced a large number of deep Foundation pit support (一)妊娠14周以上，违反《安徽省禁止非医学需要鉴定胎儿性别和选择性别终止妊娠的规定》终止妊娠的; (二)故意致婴儿死亡的; (三)自报婴儿死亡但没有证据证明的。 第二十二条 初次生育的夫妻，在孕期内应当到夫妻一方户籍所在地村民委员会或者居民委员会办理妊娠登记，免费领取生殖保健服务证，并于生育后45日内办理生育登记。村民委员会、居民委员会应当及时将妊娠登记和生育登记情况向乡(镇)人民政府或者街道办事处报告。 生殖保健服务证由省人口和计划生育行政部门统一印制，免费发放。 第二十三条 要求再生育子女的夫妻，应当向一方户籍所在地的乡(镇)人民政府、街道办事处提出申请，并附送双方所在村民委员会、居民委员会或者所在单位出具的证明。 乡(镇)人民政府、街道办事处应当自收到申请和证明材料之日起20日内(需要进行病残儿鉴定的除外)提出审核意见，并报县级人民政府人口和计划生育行政部门。县级人民政府人口和计划生育行政部门应当在20日内作出审批决定，符合条件的，签发生育证;不符合条件的，应当书面告知申请人。 村民委员会、居民委员会或者其他基层组织应当及时将生育证发放情况张榜公布，接受群众监督。 生育证由省人口和计划生育行政部门统一印制。 第二十四条 禁止下列生育行为: (一)未依法取得夫妻关系生育子女的; (二)不符合本条例第二十条的规定，再生育的 第二十五条 收养子女应当遵守《中华人民共和国收养法》等法律、法规。 禁止借收养、代养名义违反本条例规定生育子女。 禁止以送养、寄养方式违反本条例规定再生育子女。 第二十六条 实行以避孕为主的节育措施。 各级人民政府应当创造条件，保障公民选择安全、有效、适宜的避孕节育措施。计划生育技术服务人员应当向育龄夫妻介绍常用避孕方法及其作用机理、适应症、禁忌症、注意事项等，指导公民选择适合自身的避孕节育方法。 第二十七条 育龄夫妻应当自觉落实避孕节育措施，接受计划生育技术服务指导和避孕节育情况检查。提倡已生育子女的夫妻选择长效避孕措施。 预防和减少非意愿妊娠。对不符合本条例规定妊娠的，应当及时终止妊娠。 不得假冒他人或者组织他人冒名顶替参加孕情检查、计划生育手术、病残儿鉴定、手术并发症鉴定，不得使用虚假计划生育证明。 第二十八条 实行计划生育的育龄夫妻免费享受基本项目的计划生育技术服务。参加基本医疗保险、生育保险等社会保险的育龄夫妻，其基本项目的计划生育技术服务所需费用，由社会保险予以保障;未参加社会保险的，由财政承担。 基本项目的计划生育技术服务包括:发放避孕药具、孕情和环情监测、放置和取出宫内节育器、绝育术、终止妊娠术及技术常规规定的各项医学检查、计划生育手术并发症的诊治以及国家规定的其他基本项目。 第二十九条 禁止歧视、遗弃、虐待女婴。 禁止歧视、虐待生育女婴的妇女和不育的妇女。 禁止歧视违反本条例规定生育的子女。 第四章 计划生育技术服务 authenticity, accuracy of the information. Excavation began only in the late 1980 of the 20th century research and engineering practice on comprehensive and in-depth, but with the development of China's construction, the city's high-rise buildings springing, which greatly promoted the development of theory and construction technology of deep Foundation pit engineering design, has also produced a large number of deep Foundation pit support 第三十条 各级人民政府应当合理配置、综合利用卫生资源，建立健全由计划生育技术服务机构和从事计划生育技术服务的医疗、保健机构(以下简称从事计划生育技术服务的机构)组成的计划生育技术服务网络，并将其纳入区域卫生规划，配备专业技术人员，改善技术服务设施和条件，提高技术服务水平。 第三十一条 从事计划生育技术服务的机构应当在各自的职责范围内，针对育龄人群开展人口与计划生育宣传教育，对已婚育龄妇女开展孕情检查、随访服务工作，承担计划生育、生殖保健的咨询、指导和技术服务。 第三十二条 建立健全婚前保健、孕产期保健 制度 关于办公室下班关闭电源制度矿山事故隐患举报和奖励制度制度下载人事管理制度doc盘点制度下载 ，防止或者减少出生缺陷，提高出生婴儿健康水平。从事计划生育技术服务的机构，应当在各自的职责范围内，开展卫生指导、卫生咨询、医学检查、母婴保健指导、孕妇产妇保健、胎儿保健和新生儿保健等婚前保健和孕产期保健服务。 第三十三条 避孕节育手术及恢复生育手术，须由具备国务院《计划生育技术服务管理条例》规定条件的从事计划生育技术服务的机构和人员，在具备手术条件的情况下，严格按照手术操作规程施行，保证受术者的安全。 第三十四条 从事助产接生服务的机构或者人员，在提供助产接生服务时，发现产妇未领取生殖保健服务证或者生育证的，应当及时报告当地乡(镇)人民政府、街道办事处或者人口和计划生育行政部门。 为妊娠14周以上的妇女施行终止妊娠手术的，应当遵守《安徽省禁止非医学需要鉴定胎儿性别和选择性别终止妊娠的规定》。 第三十五条 计划生育技术事故、计划生育手术并发症、计划生育药具不良反应的申报、鉴定和处理，按照国家有关规定执行。 第三十六条 接受绝育手术后，符合再生育条件，要求再生育的，依照本条例规定申请领取生育证后，凭生育证施行恢复生育手术。恢复生育手术的费用，由受术者所在单位或者乡(镇)人民政府、街道办事处给予补助。 第三十七条 政府免费向已婚育龄人员提供的避孕药具，由计划生育技术服务机构、村民委员会、居民委员会或者机关、团体、企业事业组织的计划生育服务人员负责发放，人口和计划生育行政部门的药具管理机构负责发放管理和服务工作。任何组织和个人不得倒卖、变卖政府免费提供的避孕药具。 食品药品监督、工商行政管理部门按照各自的职责对避孕药具经营活动实施检查和监督。 第三十八条 鼓励和支持计划生育新技术、新药具的研究、应用和推广。 第五章 奖励与社会保障 第三十九条 男25周岁、女23周岁登记结婚为晚婚。已婚妇女满24周岁初次生育为晚育。 国家机关、社会团体、企业事业组织应当给予晚婚、晚育的职工以下奖励: (一)晚婚的初婚者，延长婚假20天; (二)晚育的初产妇，延长产假30天; (三)在产假期间申请领取独生子女父母光荣证的，延长产假30天，男方享受10天护理假;夫妻异地生活的，护理假为20天。 职工在前款规定的婚假、产假、护理假期间，享受其在职在岗的工资、奖金、福利待遇。 农民以及城市无用工单位的人员晚婚晚育的，由当地人民政府给予表彰、奖励。 第四十条 妇女妊娠、生育和哺乳期间，享受国家规定的特殊劳动保护。 第四十一条 终身只生育一个子女的夫妻，可以向户籍所在地的乡(镇)人民政府或者街道办事处申请，免费领取独生子女父母光荣证。在子女满16周岁前领取独生子女父母光荣证的，享受下列奖励和优待: (一)从领证之月起，每月发给不低于20元独生子女保健费，至独生子女满16周岁止。authenticity, accuracy of the information. Excavation began only in the late 1980 of the 20th century research and engineering practice on comprehensive and in-depth, but with the development of China's construction, the city's high-rise buildings springing, which greatly promoted the development of theory and construction technology of deep Foundation pit engineering design, has also produced a large number of deep Foundation pit support 所需经费，是国家机关、事业单位、国有企业职工的，由所在单位承担;其他人员由户籍所在地设区的市、县级人民政府承担。独生子女保健费的具体标准，由设区的市、县级人民政府根据本地实际情况确定，并报省人民政府人口和计划生育行政部门备案; (二)国家机关和事业单位职工退休时，提高5,的退休金;企业职工退休时，给予一次性补助，具体标准由所在地设区的市、县级人民政府确定。所需经费，是国家机关和事业单位、国有企业职工的，由所在单位承担;其他人员由户籍所在地设区的市、县级人民政府承担。国有企业改制、破产的，其退休职工计划生育奖励资金的发放依照国家和省人民政府有关规定执行; (三)在调整承包地、自留地、自留山，分配集体收益时，以家庭人口数量作为基本分配补助单位的，增加一人份额;以家庭作为基本分配补助单位的，户均增加30,以上份额; (四)分配土地补偿费、安置补助费和安排保障性住房、农村危旧房改造时，予以照顾; (五)当地人民政府规定的其他奖励和优待。 无子女的夫妻，依法只收养一个子女的，按照前款规定执行。 第四十二条 农村领取独生子女父母光荣证的家庭，除享受本条例第四十一条规定的奖励和优待外，还享受下列优待: (一)列为家庭经济发展的重点扶持对象，在资金、技术、培训、信息、劳务输出等方面予以支持、优惠; (二)组织劳务输出时优先照顾; (三)对贫困家庭，在扶贫贷款、以工代赈、扶贫项目和社会救济等方面给予优先照顾; (四)在推行新型农村合作医疗制度、农村住院分娩制度时，政府给予补贴; (五)当地人民政府规定的其他优待。 农村生育两个女孩并已落实绝育措施的计划生育家庭，可以享受前款规定的优待。 第四十三条 实行农村计划生育家庭奖励扶助制度。对只有一个子女或者两个女孩的农村计划生育家庭，按照国家和省有关规定发给奖励扶助金。 实行计划生育家庭特别扶助制度。对独生子女死亡或者伤残的计划生育家庭，按照国家和省有关规定发给特别扶助金。 第四十四条 职工凭节育手术证明，按规定休假，休假期间享受其在职在岗的工资、奖金、福利待遇。农民施行绝育手术的，当地人民政府应当给予适当奖励。 节育手术并发症患者在治疗期间，职工享受其在职在岗的工资、奖金、福利待遇;农民、无用工单位的城市居民因此导致生活困难的，或者治疗后仍不能正常从事劳动的，由当地人民政府给予补助。 第四十五条 终身无子女或者领取独生子女父母光荣证后子女死亡不再生育的职工，退休时按100%发给退休金或者给予一次性补助。一次性补助标准，由户籍所在地设区的市、县级人民政府确定。所需经费，由户籍所在地设区的市、县级人民政府承担。 第四十六条 对符合本条例第二十条的规定可以申请再生育夫妻，自愿只生育一个子女，并领取独生子女父母光荣证的，除享受本条例第四十一条、第四十二条、第四十三条、第四十四条、第四十五条规定的待遇和奖励外，由所在单位或者乡(镇)人民政府、街道办事处从计划生育经费中给予1000元以上2000元以下的一次性奖励。 第四十七条 建立健全基本养老制度。按照政府引导、农民自愿的原则，优先为农村生育两个女孩并采取绝育措施的夫妻和只生育一个女孩并领取独生子女父母光荣证的夫妻办理养老保险。 第六章 法律责任 第四十八条 不符合本条例规定生育的，县级人民政府人口和计划生育行政部门按照下列规定征收社会抚养费: authenticity, accuracy of the information.
