劳动合同-中英文版本 劳动合同 LABOUR CONTRACT 甲方Party A: 乙方Party B: 证件号ID/Passport No.: 法人代表Corporation representative: 联系方式Tel: 经济类型: 通讯地址Address: 通讯地址Postal Address: 根据《中华人民共和国劳动合同法》(以下简称《劳动合同法》)和国家、省市的有关规定, 遵循合法、公平、平等自愿,协商一致、诚实信用原则,订立本合同。 According to “LAW OF THE PEOPLE’S REPUBLIC OF CHINA ON EMPLOYMENT CONTRACTS”(hereinafter refererred to as “LABOUR LAW”) and national and local regulations, sign this contract based on complying with the principles of lawfulness, fairness, equality, free will, negotiated consensus and good faith. 一、合同的类型和期限 CONTRACT TYPE 第一条 本合同的类型为: 。期限为: 年,自 年 月 日至 年 月 日。 Article 1 This is a “fixed-term employment contract”, which period is 5 years, from July 1st 2013 to June 30th 2018. 二、试用期 PROBATION 第二条 本合同的试用期自 年 月 日至 年 月 日。 Article 2 The probationary period of this contract is from July 1st 2013 to December 31st 2013. 第三条 试用期on the first month, third month and the sixth month and assess Party B’s work during probation. 三、工作RESPONSIBILITIES AND LOCATION 第四条 乙方的工作乙方的工作地点为: Article 5 Party B’s working location: Shang Hai. 四、工作时间和休息休假 WORKING TIME 第六条 乙方所在岗位执行40小时工时制,具体为:每周工作5天(40小时),周六,周 日休息。 Article 6 Party B’s normal work days per week shall be five days from Monday to Friday and total be 40 hours. Party B has two days off every week. 第七条 甲方严格执行国家有关休息休假的规定,具体安排为: 乙方在为甲方工作满1年 后,甲方提供乙方带薪年休假10天。 Article 7 Party A shall meet regulations about rest and holiday stipulated by government strictly. Party A shall tell Party B the positions which will cause possible occupational disease and provide prevention measures. 第十五条 甲方为乙方提供必要的劳动条件以及安全卫生的工作环境,并依照企业生产经 营特点及有关规定向乙方发放劳防用品和防暑降温用品。 Article 15 Party A shall offer Party B the necessary occupational safety and health protection and working tools and provide labor protection treatment for Party B. 第十六条 甲方应根据自身特点有 计划 项目进度计划表范例计划下载计划下载计划下载课程教学计划下载 地对乙方进行政治思想、职业道德、业务技术、劳 动安全卫生及有关 规章制度 食品安全规章制度下载关于安全生产规章制度关于行政管理规章制度保证食品安全的规章制度范本关于公司规章制度 的教育和培训,提高乙方思想觉悟、职业道德水准和职业技能。 Article 16 Party A shall provide the training coursec about professional ethics, technical skill, safety and hygiene knowledge to develop Party B according to Party A’s business character. 乙方应认真参加甲方组织的各项必要的教育培训。 Party B shall take part in these trainings actively. 八、劳动合同的履行和变更 PERFORMANCE AND AMENDMENT OF EMPLOYMENT CONTRACTS 第十七条 甲方应当按照约定向乙方提供适当的工作场所、劳动条件和工作岗位,并按时 向乙方支付劳动报酬。乙方应当认真履行自己的劳动职责,并亲自完成本合同约定的工作任 务。 Article 17 Party A shall provide proper working space, condition and position. Party A shall pay the salary on time. Party B shall implement responsibilities seriously and accomplish the other tasks personally. 第十八条 甲、乙双方经协商一致,可以变更本合同的内容,并以书面形式确定。 Article 18 Party A and Party B may amend the provisions of this contract according to agreement after consultation. Amendments to this contract shall be made in writing. 九、劳动合同的解除 TERMINATION OF THIS CONTRACT 第一十九条 经甲、乙双方当事人协商一致,本合同可以解除。 Article 19 Party A and Party B may terminate this contract according to agreement after consultation. 第二十条 乙方提前三十日以书面形式通知甲方,可以解除本合同。乙方在试用期内提前 三日通知甲方,可以解除本合同。 Article 20 Party A may terminate this contract upon 30 days’ prior written notice to Party B. During probation period, Party A may terminate this contract by giving Party B three days’ prior notice. 第二十一条 甲方有下列情形之一的,乙方可以解除本合同: Article 21 Party B may terminate this contract if Party B: (一) 未按照本合同约定提供劳动保护或者劳动条件的; Fails to provide the labor protection or working conditions specified in this contract; (二) 未及时足额支付劳动报酬的; Fails to pay labor compensation in full and on time; (三) 未依法为乙方缴纳社会保险费的; Fails to pay the social insurance premiums to Party B; (四) 甲方的规章制度违反法律、法规的规定,损害乙方权益的; Has rules and regulations that violate laws or regulations, thereby harming the Party B’s rights and interests; (五)因《劳动合同法》第二十六条第一款规定的情形致使本合同无效的; Causes this contract to be invalid due to a circumstance specified in the first paragraph of Article 26 of “LABOUR LAW”; (六)法律、行政法规规定乙方可以解除本合同的其他情形。 Gives rise to another circumstance in which laws or administrative statutes permit Party B to terminate this contract. 甲方以暴力、威胁或者非法限制人身自由的手段强迫乙方劳动的,或者甲方违章指挥、强 令冒险作业危及乙方人身安全的,乙方可以立即解除本合同,不需事先告知甲方。 If Party A uses violence, threats or unlawful restriction of personal freedom to compel Party B to work, or if Party B is instructed in violation of rules and regulations or peremptorily ordered by Party A to perform dangerous operations which threaten personal safety, Party B may terminate this contract forthwith without giving prior notice to the Party A. 第二十二条 乙方有下列情形之一的,甲方可以解除本合同: Article 22 Party A may terminate this contract if Party B: (一)在试用期间被证明不符合录用条件的; Is proved during the probation period not to satisfy the conditions for employment; (二)严重违反甲方的规章制度的; Materially breaches the Party B’s rules and regulations; (三)严重失职,营私舞弊,给甲方造成重大损害的; Commits serious dereliction of duty or practices graft, causing substantial damage to Party A; (四)乙方同时与其他用人单位建立劳动关系,对完成甲方的工作任务造成严重影响,或 者经甲方提出,拒不改正的; Has additionally established an employment relationship with another Employer which materially affects the completion of Party B’s tasks with Party A, or Party B refuses to rectify the matter after the same is brought to Party B’s attention by Party A; (五)因《劳动合同法》第二十六条第一款第一项规定的情形致使本合同无效的; Causes this contract to be invalid due to the circumstance specified in item (1) of the first paragraph of Article 26 of “LABOUR LAW”; (六)被依法追究刑事责任的。 Has his criminal liability pursued in accordance with the law. 第二十三条 有下列情形之一的,甲方提前三十日以书面形式通知乙方或者额外支付乙方 一个月工资后,可以解除本合同: Article 23 Party A may terminate this contract by giving Party B 30 days’ prior written notice, or one month’s wage in lieu of notice, if: (一)乙方患病或者非因工负伤,在规定的医疗期满后不能从事原工作,也不能从事由甲 方另行安排的工作的; After the set period of medical care for an illness or non-work-related injury, Party B can engage neither in original work nor in other work arranged for Party B by Party A; (二)乙方不能胜任工作,经过培训或者调整工作岗位,仍不能胜任工作的; Party B is incompetent and remains incompetent after training or adjustment of Party B’s position; (三)本合同订立时所依据的客观情况发生重大变化,致使本合同无法履行,经甲、乙双 方方协商,未能就变更本合同内容达成 协议 离婚协议模板下载合伙人协议 下载渠道分销协议免费下载敬业协议下载授课协议下载 的。 A major change in the objective circumstances relied upon at the time of conclusion of this contract renders it unperformable and, after consultation, Party A and Party B are unable to reach agreement on amending this contract. 第二十四条 乙方有下列情形之一的,甲方不得依据第二十三条的约定解除本合同: Article 24 Party A may not terminate this contract pursuant to Article 23 if Party B: (一)乙方如从事接触职业病危害作业但未进行离岗前职业健康检查,或者乙方为疑似职 业病病人在诊断或者医学观察期间的; Is engaged in operations exposing Party A to occupational disease hazards and has not undergone a pre-departure occupational health check-up, or is suspected of having contracted an occupational disease and is being diagnosed or under medical observation; (二)在甲方工作期间患职业病或者因工负伤并被确认丧失或者部分丧失劳动能力的; Has been confirmed as having lost or partially lost his capacity to work due to an occupational disease contracted or a work-related injury sustained with Party A; (三)患病或者非因工负伤,在规定的医疗期If this contract expires and any of the circumstances specified in Article 24 hereof applies, the term of this contract shall be extended until the relevant circumstance ceases to exist, at which point the contract shall end. However, matters relating to the ending of this contract of Party B who has lost or partially lost capacity to work as specified in item (2) of Article 24 hereof shall be handled in accordance with state regulations on work-related injury insurance. 十一、经济补偿 SEVERANCE PAY 第二十七条 有下列情形之一的,甲方应当向乙方支付经济补偿: Article 27 In any of the following circumstances, Party A shall pay Party B severance pay: (一)乙方依照第二十一条约定解除本合同的; This contract is terminated by Party B pursuant to Article 21 hereof; (二)甲方依照第一十九条约定向乙方提出解除本合同并与乙方协商一致解除本合同的; This contract is terminated after such termination was proposed to Party B by Party A pursuant to Article 19 hereof and the parties reached agreement thereon after consultations; (三)甲方依照第二十三条约定解除本合同的; This contract is terminated by Party A pursuant to Article 23 hereof; (四)除甲方维持或者提高本合同约定条件续订合同,乙方不同意续订的情形外,依照第 二十五条第一项约定终止本合同的; This contract is terminated by Party A pursuant to the first paragraph of Article 25 hereof; (五)依照第二十五条第四项、第五项约定终止本合同的; This contract ends pursuant to item (4) or (5) of Article 25 hereof; (六)法律、行政法规规定的其他情形。 Other circumstances specified in laws or administrative statutes. 第二十九条 经济补偿按乙方在甲方工作的年限,每满一年支付一个月工资的标准向乙方 支付。六个月以上不满一年的,按一年计算;不满六个月的,向乙方支付半个月工资的经济 补偿。 Article 29 Party B shall be paid severance pay based on the number of years worked with Party A at the rate of one month’s wage for each full year worked. Any period of not less than six months but less than one year shall be counted as one year. The severance pay payable to Party B for any period of less than six months shall be one-half of his monthly wages. 如乙方月工资高于本市上年度职工月平均工资三倍的,向其支付经济补偿的标准按本市上 年度职工月平均工资三倍的数额支付,向其支付经济补偿的年限最高不超过十二年。 If the monthly wage of Party B is greater than three times the average monthly wage which published by the People’s Government at the level of municipality directly under the central government or municipality divided into districts of the area1 where Party A is located, the rate for the severance pay paid to Party B shall be three times the average monthly wage of Party B and shall be for not more than 12 years of work. 本条所称月工资是指乙方在本合同解除或者终止前十二个月的平均工资。 For the purposes of this Article, the term “monthly wage” means Party B’s average monthly wage for the 12 months prior to the termination or ending of this contract. 十二、保密条款 CONFIDENTIALITY 第三十条 乙方有保守公司秘密的义务,保密范围包括:经营信息,技术资料,其他经公 司确定应当保密的事项。 Article 30 Party B has obligation to keep company affairs confidential. The confidential affairs include: management information, information technology and other affairs that the company considers need to be confidential. The position requires a separate Confidentiality Agreement in addition to this Confidentiality Clause 第三十一条 在合同期限内,乙方因工作或利用甲方的物质技术条件、业务信息、工作场 所、人力资源等任何条件所完成的发明创造、作品、计算机软件、技术秘密或其他各类信息 和资料,均属于甲方技术成果,由甲方享有知识产权。 Article 31 During this contract period, Party B shall complete the work or the use of Party A’s material and technical conditions, business information ,workplace, human resources to get any invention and creation, works, computer software, technical secrets or other types of information and data, all belong to Party A as well as intellectual property rights. 第三十二条 未经甲方允许,乙方在任何时候均不得自行使用、公开或泄露上述公司秘密。 Article 32 At any time, Party B shall not use, issue or divulge above confidentiality affairs without Party A’s permission. 第三十三第 未经甲方允许,乙方在任职期间,不得以任何形 式为同行业竞争对手工作或提供帮助。 Article 33 Party B During this contract period, Party B shall not work or provide any help in any way for the competitors without Party A’s permission. 十三、违反合同的责任 LEGAL LIABILITY 第三十四条 甲方违反本合同约定的条件解除、终止本合同或由于甲方原因订立的无效合 同,给乙方造成损害的,应按损失程度承担赔偿责任。 Article 34 Party A violates the conditions stipulated in the contract, terminate this contract or because of an invalid contract party conclude, causing damage to Party B, shall bear the liability of compensation according to the extent of the loss. 第三十五条 乙方违反本合同约定的条件解除本合同或由于乙方原因订立的无效合同,或 者违反劳动合同中约定的保密义务,给用人单位造成损失的,应当承担赔偿责任。 Article 35 If Party B terminates this contract in violation of this contract or ineffective contract caused by Party B or breaches the confidentiality obligations or competition restrictions stipulated in this contract, and if such violation or breach causes Party A to suffer loss, Party B will be liable for damages. 十四、其他 OTHERS 第三十六条 本合同未尽事宜,或者有关劳动标准的The outstanding issues of this contract, or against the relevant provisions of the relevant labor standards, content, etc, implement the relevant provisions. 第三十七条 本合同一式两份,甲乙双方各执一份。经双方签字盖章后生效。 Article 37 Two copies of this contract, both parties hold one copy.
