第一章 总 则
本章共七条。《条例》总则具有方向性、原则性、统领性作用,对整个《条例》具有普遍约束力,是《条例》的核心。《条例》中其它章节的规定必须与总则的规定相符。本章中对立法依据、立法原则、适用范围、规范对象、管理主体及相关制度做出规定。
第一条 根据国务院《城市供水条例》等有关法律、法规的规定～结合本市实际～制定本条例。

市供水用水市场秩序发挥了重要作用。2012年,沈阳市第十四届人民代表大会常务委员第三十八次会议对《条例》进行了修订。
制定本条例的目的是为了加强沈阳市的城市供水、用水管理工作,更好地保证城市供水稳定,保障用水户的用水安全,保护供用水双方的合法权益,促进城市供水用水事业的良性、长期、可持续发展,使沈阳市的城市供水用水管理工作制度化、规范化、法制化,为沈阳市的经济发展、和谐社会建设提供法律保障。

《条例》在制定时,借鉴了外省市的立法经验,并结合我市实际情况,广泛征求了各方面的意见。
第二条 本条例所称城市供水～包括城市公共供水和自建设施供水。
本条例所称城市用水～是指城市的用水单位或者个人通过公共供水管道及其附属设施或者通过自行建设的取水设施用水。
【释义】本条是对规范对象,即城市供水、用水范围的规定。
城市供水,是指在水源地集中取水,统一净化处理和消毒后,经输水管网或容器送至用户的供水方式,包括城市公共供水和城市自建设施供水。
城市公共供水,是指政府授权特许经营的城市公共供水企业,负责经营管理集中的城市供水设施并向城市居民、工业、商业、建设、市政、环卫、绿化等单位供水。

自建设施供水,是指一个单位为满足本单位生产、生活用水需要,自建制水设施,向单位所属范围内的职工或生产设备供水。
城市供水不论由谁投资建设和采取何种经营管理模式,都属于本条例的规范对象。
第三条 在本市从事城市供水和用水的单位和个人～必须遵守本条例。
【释义】本条是关于适用范围的规定。
对本条的理解应掌握以下几个方面的问题,
一、本条例的空间效力。本条例的空间效力为我市行政管理区域。凡是在沈阳市内的供水、用水行为都应适用本条例。

三、本条例对人的效力。本条例的行为主体包括单位和个人。
第四条 市城乡建设主管部门负责城市供水、用水、节水监督管理工作。
市城市节约用水管理机构具体负责本市节约用水的管理工作。
市水行政主管部门和卫生、工商、城市管理行政执法等部门在各自职责范围内负责城市供水、用水中的监督管理工作。
区、县,市,有关主管部门按照职责分工～负责本行政区域内的供水、用水和节水监督管理工作。
【释义】本条是关于管理主体及职责划分的规定。

水行政主管部门、卫生管理部门、工商管理部门、城市管理行政执法等部门。
二、本条例对管理职责进行划分。市城乡建设主管部门负责供水、用水、节水监督管理工作,属综合层面的管理工作。在此基础上,对节水和供水、用水工作管理职责做进一步划分,分别由市城市节约用水管理机构和市水行政主管部门等相关部门负责管理。
第五条 城市供水依法实行特许经营制度。
【释义】本条是对供水行业实行特许经营制度的原则性规定。

4、行政许可是一种外部行政行为。行政许可是行政机关针对行政相对方的一种管理行为,是行政机关依法管理经济和社会事务的一种外部行为。行政机关审批其他行政机关或者其直接管理的事业单位的人事、财务、外事等事项的内部管理行为不属于行政许可。

第七条 对在城市供水、节水工作中作出显著成绩的单位和个人～给予奖励。
【释义】本条是对奖励原则的规定。

饮用水水源保护区是国家为保护水源洁净而划定的加以特殊保护、防止污染和破坏的一定区域。饮用水水源保护区可分为地表水源保护区和地下水源保护区。按照不同的水质标准和防护要求，饮用水水源保护区可分为一级保护区和二级保护区，必要时也可在二级保护区范围外设置准保护区。
《中华人民共和国水污染防治法》第二十条和《中华人民共和国水污染防治法实施细则》第三十二条对饮用水水源保护区提出了明确要求，各级人民政府及其环保部门应按照HJ/T 338《饮用水水源保护区划分技术规范》的要求划定饮用水水源保护区，并及时公布。环保部门和供水企业要积极配合，在水源保护区设置标识，按照《饮用水水源保护区污染防治管理规定》的要求加强管理，禁止一切危害水源水质的活动。

禁止向水域排放污水，已设置的排污口必须拆除; 不得设置与供水需要无关的码头，禁止停靠船舶; 禁止堆置和存放工业废渣、城市垃圾、粪便和其他废弃物;禁止设置油库;
禁止从事种植、放养禽畜，严格控制网箱养殖活动; 禁止可能污染水源的旅游活动和其他活动。
2、二级保护区内
不准新建、扩建向水体排放污染物的建设项目;
改建项目必须削减污染物排放量;
原有排污口必须削减污水排放量，保证保护区内水质满足规定的水质标准;
禁止设立装卸垃圾、粪便、油类和有毒物品的码头。
3、准保护区内
直接或间接向水域排放废水，必须符合国家及地方规定的废水排放标准。当排放总量不能保证保护区内水质满足规定的标准时，必须削减排污负荷。
第九条 严格限制城市自来水可供区域内的各种自备水源。在城市公共管网覆盖范围内～供水能力能够满足需要的～禁止新建自备水源～对原有的自备水源要提高水资源费征收额度～逐步减少许可取水量～直至完全取消。

超采区域是指在开采条件下,一定时间段内的地下水的开采量大于年或多年平均补给量,而破坏了地下水的采、补平衡的地段。
自备水源的建设及管理,应严格执行《辽宁省地下水资源保护条例》及《辽宁省禁止提取地下水规定》,辽宁省人民政府令第255号,的有关规定。对于没有取水许可的自备水源由水行政主管部门责令立即关闭,已办理取水许可,且在城市公共管网覆盖范围内,供水能力能够满足需要的自备水源,应根据文件规定逐步关闭。

三、占压、掩埋公共供水设施或者向公共供水设施倾倒垃圾杂物的行为,也严重危害着供水安全。由于阀门、消火栓设施被压埋,井室被充填,造成查找困难和无法操作,延误检修速度。尤其是消火栓被压埋后,直接影响到城市消防。

公共供水管网相连接的行为。任何单位和个人都无权擅自连接供水管道。因特殊情况自建设施供水管网与城市公共供水管网确需连接的,必须征得城市供水企业同意,报当地区,县,级以上建设行政主管部门和卫生行政主管部门批准,并在管道连接处采取必要的卫生防护措施后,纳入城市供水规划统一布局、统一管理。
五、其他危害城市公共供水的行为,比如野蛮施工造成供水管道断裂漏水、拆卸或偷盗供水设施设备、妨碍供水企业正常生产和经营、以及散布各类不实言论引发用水户恐慌乃至社会不安定因素等行为,都应当坚决禁止,并予以相应处罚。

四、利润是收入扣除成本费用及税金后的余额,利润是企业可持续发展的源泉。国家计委、建设部印发的《城市供水价格管理办法》第十一条中规定“供水企业合理盈利的平均水平应当是净资产利润率8%-10%。具体的利润水平由所在城市人民政府价格主管部门征求同级城市供水行政主管部门意见后,根据其不同的资金来源确定。,一,主要靠政府投资的,企业净资产利润率不得高于6%。,二,主要靠企业投资的,包括利用贷款、引进外资、发行债券或股票等方式筹资建设供水设施的供水价格,还贷期间净资产利润率不得高于12%。还贷期间结束后,供水价格应按本条规定的平均净资产利润率核定。”

供水时间、水费缴纳、供水设施维修以及其它权利义务签订《供水用水合同》。《供水用水合同》应当使用由城乡建设主管部门和工商行政管理部门共同制订的合同文本,并接受上述部门的监督。
二、非居民用户需使用临时用水的,由于临时用水管道的接水点需由市政供水管道引入,因此用户需向供水企业提出用水申请,由供水企业根据用户的申请、用户所处位置、建设规模、规划等相关资料,确定临时供水管道引入点。需要缴纳费用的,须按供水企业的规定交纳费用。
第二十七条 用户应当按月缴纳水费～城市供水企业应当按期查验水表～收缴水费。

本条例所称污水回用是指，将废水或污水经二级处理和深度处理后回用于生产系统或生活杂用，污水回用的范围很广，从工业上的重复利用水体的补给水到生活用水。污水回用既可以有效地节约和利用有限的水资源，又可以减少污水或废水的排放量，减轻水环境的污染，还可以缓解城市排水管道的超负荷现象，具有明显的社会效益、环境效益和经济效益。
本条例所称景观用水是指，城市园林建筑、公用绿地等用水。
市级政府及区(县)级人民政府都应当制定出当地行政区域内的节约用水规划，各有关行业主管部门应当制定本行业的节约用水年度计划。

第三十五条 对使用城市公共管网供水日用水量五立方米以上,含五立方米,的非居民用户、自建水源取水的用水单位～实行用水计划管理～并依据国家有关规定～核定用水计划指标。
任何单位和个人不得转让用水计划指标。
实行计划用水的单位应当建立节约用水管理制度～建立节约用水档案～并定期向城市节约用水管理机构提供用水情况的有关资料。

根据国家住建部《节水型企业评价导则》、辽宁省住建厅《关于加强水平衡测试工作的通知》和《沈阳市节约用水管理办法》的规定，应定期开展此项工作。

输入水量包括新水量、重复利用水量;输出水量包括排水量、耗水量和损漏水量。
凡纳入我市用水计划管理的单位均应按要求在规定时期内开展此项工作，以利于及时发现本单位供水用水系统内或用水管理上出现的问题，从而迅速消除隐患，避免或减少本单位的经济损失。
用水单位的水平衡测试工作由沈阳市城市节约用水管理办公室组织开展，工作内容包括单位用水现状的调查;整理绘制单位给、排水管网图;实地测试用水单元的用水参数值;编制单位水平衡测试及用水定额报告书;总结分析、评价现状，提出整改措施。该项工作结束后由沈阳市城市节约用水管理办公室按照验收标准组织审核验收，验收不合格单位限期整改直至合格。对无故不开展此项工作的单位要相应下调用水计划指标。
第四十条 城市供水企业应当对供水、用水设施、设备、器具进行维修、保养～减少水的漏失。

迁移、拆除、损毁保护标识的行为,给饮用水水源保护区的安全带来隐患,因此针对迁移、拆除、损毁保护标识的危害行为必须加以处罚,使水源保护区发挥保障安全供水的作用。
任何单位和个人擅自迁移、拆除、损毁保护标识的,应给予行政处罚。执法主体是各级城市管理行政执法部门。行政处罚的方式为责令改正及处以相应罚款。
第四十三条 违反本条例第十六条规定～未经城乡建设主管部门特许经营～从事城市供水业务的～由城市管理行政执法部门责令限期改正～没收违法所得,逾期不改的～处以五万元以上十万元以下罚款。

供水安全关乎国计民生,因此对从事城市供水行业的主体必须严格审批。本《条例》第十六条明确规定了“未依法登记和未取得经营特许,任何单位和个人不得从事城市供水。”该条款说明了从事城市供水必须具备的两个前提条件是依法登记和取得供水特许经营权,缺乏任何一个条件都将无法进入城市供水行业进行经营活动。负责管理登记的主管部门是工商行政主管部门,负责授予特许经营的部门是城乡建设主管部门。

一、承担责任的主体。责任主体为城市供水企业、供水设施的管理单位、建设单位。1、出现第一项中规定的水压不符合国家标准及第二、三、四、五项中规定的行为时,由城市供水企业承担法律责任。2、出现第六、七项中规定的行为,根据情况由城市供水企业、供水设施管理单位或建设单位承担法律责任。
二、承担法律责任方式。由于本条承担责任的主体为单位,因此本条实行双罚制,既可由城市管理行政执法部门对违反《条例》的单位进行行政处罚,又可由单位或上级机关对负有直接责任人员给予行政处分。但行政处分属于行政机关内部针对责任人失职行为采取的处罚,不属于行政处罚。

单位或者上级机关对责任人依法给予行政处分,造成严重后果～构成犯罪的～依法追究刑事责任。
【释义】本条是对未采取防污措施及瞒报、谎报、阻碍他他报告的行为承担法律责任的规定。
《条例》第二十条明确规定排污单位或个人排放污物造成或可能造成供水污染的,应采取应急措施停止污染行为,并向相关政府职能部门和供水企业报告,不得瞒报、谎报、阻碍他人报告。有违法行为的,承担法律责任。
法律责任的方式,第一种对责任人由其所在单位或上级机关给予行政处分,责任主体是个人。第二种对造成严重后果,构成犯罪的依法追究刑事责任,责任主体是单位和个人。

【释义】本条是对妨害保障供水,安全供水,改建、拆除、迁移公共供水设施行为应承担法律责任的规定。
违法本《条例》第二十三条第二、四项和第二十四条的行为主要为擅自损毁、改建、拆除、迁移、启闭公共供水设施和擅自连接供水管线的行为。这些行为严重妨害保障供水、安全供水,并对供水企业或供水设施管理单位造成经济损失。因此,责任主体除应承担行政、刑事责任外,还应承担民事责任,对受害方给予经济赔偿。

第四十九条 违反本条例第三十七条、第三十九条、第四十条、第四十一条第三款规定～有下列行为之一的～由城乡建设主管部门视情节给予处理:

用水计划指标，同时追缴当月用水量十至二十倍的加价水费。
本条第三款是对不按规定进行水平衡测试的单位进行的处罚。
本条第四款对因为使用《城市房屋便器水箱应用监督管理办法》(建设部17号令)的不合理用水器具以及用水器具未能及时维修而导致的浪费用水行为的处理做出了规定。一经发现有上述行为之一的，城市节约用水管理办公室责令浪费用水单位在三日内改正其浪费用水行为，同时追缴浪费用水单位浪费用水部位当月用水量十至二十倍的加价水费。
本条第五款主要针对营业性洗车业户未安装循环用水设施及使用长流水造成浪费用水的行为处罚做出了规定。一旦发现营业性洗车业户未安装循环用水设施或有循环用水设施未使用的情况，应按长流水冲洗车辆进行处理;同时，对餐饮行业、基建工地长流水浪费用水情况的处理进行了规范。在责令浪费用水的单位限三日内整改的同时，对浪费用水量要进行十至二十倍加价水费的追缴。

,二,供水企业可采取的制止违法行为的措施是滞留违法行为使用的工具和设备,滞留工具和设备就及时制止了违法行为。滞留工具和设备后及时向城市管理行政执法部门报告,由城市管理行政执法部门执行处罚,
