乌鲁木齐市房屋租赁管理暂行办法(InterimMeasuresfortheadministrationofhousingleaseinUrumqi)乌鲁木齐市房屋租赁管理暂行办法(InterimMeasuresfortheadministrationofhousingleaseinUrumqi)InterimMeasuresfortheadministrationofhousingleaseinUrumqiInterimMeasuresfortheadministrationofhousingleaseinUrumqi(adoptedattheeighteenthexecutivemeetingoftheUrumqiMunicipalPeople'sGovernmentonSeptember,,promulgatedbyDecreeNoninetyeighthoftheUrumqiMunicipalPeople'sGovernmentonNovember,,andeffectiveasofthedateofpromulgation)Articleinordertostrengthenthehousingleasemanagement,regulatethehousingrentalbehavior,promotethehealthydevelopmentofthehousingrentalmarket,accordingtothe"People'sRepublicofChinaCityrealestatemanagementlaw"andrelevantlawsandregulations,withtheactualcity,theenactmentofthisapproachSecond,thecityadministrativeareasofhousingleaseanditsmanagementactivitiesapplytothesemeasuresThesemeasuresarenotapplicabletothepublichousingandlowrenthousingleasedbythegovernmentThirdofthehousingusedinthesemeasures,includinghousing,industrialandcommercialuse,officespace,warehousesandotheruseHouseleaseistheactthattheLessorprovideshishousetothelessee,andthelesseepaystherentorothereconomicbenefitstothelessorFourth,thecityrentalhousingmanagementadheretotheunifiedleadership,territorialmanagement,hierarchicalresponsibility,coordinationand"whorents,whoisresponsible,whobenefits,whoisresponsible"principleFifthMunicipalPeople'sgovernmenthousingleasemanagementdepartmentresponsibleforthecity'shousingrentalmanagementDistrict(county)people'sgovernmenthousingleasemanagementdepartmentisresponsibleforthedistrict(county)housingrentalmanagementDepartmentsofpublicsecurity,taxation,industryandcommerce,familyplanning,planning,construction,administrationandcomprehensivelawenforcementshall,withinthescopeoftheirrespectivefunctionsandresponsibilities,doagoodjobinthemanagementofleaseofhousesSixthcity,district(county)setuptherentalhousingmanagementworkleadinggroup,theleadinggroupofficearelocatedinthecity,district(county)comprehensivemanagementofficeCity,district(county)comprehensivemanagementofficeinaccordancewiththepresentmeasuresrespectivelyperformthecityanddistrict(county)people'sgovernmenthousingleasemanagementofrentalhousingmanagementresponsibilitiesTheseventhdistrict(county)rentalhousingmanagementworkleadinggroupofficespecificallyresponsiblefororganizingandcoordinating,guidingthedistrict(county)ofeachdepartment,officeofthestreets(township)managementsystemandmeasuresfortheimplementationofrentalhousingTheeighthdistrict(county)housingleasemanagementaccordingtotheprinciplesofconveniencecanbeentrustedtostreetoffices(township)rentalhousingmanagementcenterfortheareawithinthescopeofthecontractofrentalhousingregistrationmaterialsreceivingetcAccordingtotheactualmanagementneeds,theSubdistrictOffice(township,town)rentalhousingmanagementcenterinthecommunity(Village)responsibleforthemanagementofhousingrentalmanagementatthegrassrootslevelNinthofanyunitandindividualshallmakeuseofrentalhousingtoengageincriminalactivities,damagethepublicinterestsofthesocietyfoundthattheuseofrentalhousingforillegalactivities,damagethepublicinterests,itshallpromptlyreporttotherelevantdepartmentsTenth,thecityinaccordancewiththeprincipleofunifiedplanning,resourcesharing,theestablishmentofhousingleaseintegratedmanagementinformationsystemplatformforhousingrentalinformationdynamicmanagementManagementanduseofhousingrentalinformationdepartmentsandtheirstaff,housingleaseinformationshouldbekeptconfidentialandsafeguardthelegitimaterightsandinterestsofthepartiesEleventhhousesunderanyofthefollowingcircumstancesshallnotbeleased:()failingtoobtainthecertificateofpropertyrightorotherlawfulownershipofhousing(two)ajudicialorganoranadministrativeorganshall,inaccordancewiththelaw,decideordecidetosealuporotherwiserestricttherighttoleaseahouse(three)thecommonhousinghasnotbeenagreedbytheCOowner(four)theownershipisdisputed(five)itbelongstoillegalconstruction(six)notinconformitywiththebuildingandfiresafetystandards(seven)changetheuseofhousing,accordingtolawshouldbeapprovedbytherelevantdepartmentswithoutapproval(eight)othercircumstancesprohibitedbylawsandregulationsTwelfthrentalhousing,leasepercapitaconstructionareamaynotbelessthansquaremeters,orpercapitauseofspacemaynotbelessthansquaremetersThirteenthhousingrentalpartiesshouldsignawrittenleaseagreementinaccordancewiththelawHousingleasecontractshouldhavethefollowingmaincontents:()thenameofthepartyconcerned,theidentitydocumentnumberorthenameofthepartyconcerned(two)theaddressofthepartyconcerned(three)thelocationandareaofrentalhousing(four)housinguse(five)leaseterm(six)theamountofrentandthemodeofdelivery(seven)othertermsagreeduponbythepartiesRentalhousing,housingleasecontractshouldbeclearabouttheactualnumberofresidentsFourteenthhousingrentalregistrationsystemforthecityFifteenthhousinglessorsorsubtenantshouldsign,change,lifttheleasecontractwithindaysfromthedateofthehousingtothecommunity(Village)rentalhousingmanagementstationtosubmitregistrationmaterialsSixteenthhousinglessorsorsubtenanthousingregistrationfortherecord,shouldsubmitthefollowingmaterials:()certificateofownershipofthehouseorotherlawfulsources(two)housingleasecontract(three)theidentitydocumentorthesubjectqualificationcertificateofthepartyconcerned(four)theactualnumberofresidencepersonnelandidentitydocumentsoftherentalhousing(five)rentalhousingentrustedescrowhousing,theneedtosubmitescrowescrowauthorizedrentalproofIftheclientisoutsidetheterritory,thecertificatetoauthorizetheleaseshallbenotarizedinaccordancewiththelaw(six)tosubletahouse,itisnecessarytosubmitawrittenopinionthattheLessoragreestosubletthepremises(seven)torentacommonhouse,itisnecessarytosubmitproofthatothercoownersagreetorentit(eight)rentalhousingwithinthescopeoffarmers'homestead,theneedtosubmitproofofresidentiallanduseArticleseventeenthlessororsubleaseinaccordancewiththeprovisionsofarticlesixteenthofthesubmittedmaterialstocomplete,thecommunity(Village)rentalhousingmanagementstationshouldbewithinworkingdaysfromthedateofreceivingtheapplication,inspectedtherentalhousing,theformationofawritteninvestigationreportAmongthem,thisapproachdoesnotbelongtotheprovisionsofarticleeleventhprohibittherentalhousing,rentalhousinginaccordancewiththeprovisionsofarticletwelfthtotheconditionsandcriteria,bythedistrict(county)housingleasemanagementtoberegistereddoesnotcomplywiththeconditionsandstandards,theregistrationfiling,andwritteninformedreasonsTableeighteenthhousestorentorsubletthehousingrentalregistrationmaterialsareincompleteorinconsistentwiththeprovisionsofthecommunity(Village)rentalhousingmanagementstationshouldallbesupplementedonceinformedonthespotNineteenthdistrict(county)housingrentalmanagementdepartmentsshouldapplyforregistrationwithindaysfromthedateoftheformalities,thehousingrentalinformationwrittentothetaxauthoritiesatthesamelevelTwentiethrealestateintermediaryservicestoprovidehousingrentalbrokerageservices,housinglessorsshouldbeinformedinaccordancewiththeprovisionsoftheproceduresforhousingrentalregistrationTwentyfirstrentalhousingpartiesshouldacceptthemanagementoftherelevantdepartments,withgoodhousingsafety,publicsecurity,familyplanning,taxcollectionandotherworkTwentysecondhousinglessorsshouldfulfillthefollowingobligations:()housingshallnotberentedtopeoplewhoarelegallyvalid(two)thehousecannotbechangedwithoutauthorization(three)intimeforhousingleaseregistrationprocedures(four)accordingtotheprovisionsofthelocationofthepolicestationtosignpublicsecurityresponsibilityguarantee(five)toregisterthelessee'sname,identitydocumenttypeandnumberinatimelyandaccuratemanner(six)tourgethenoncityresidenceofthelesseetothehousewherethepolicestationfortemporaryresidenceregistration,assistStreetoffices(township)rentalhousingmanagementcenterorcommunity(Village)rentalhousingmanagementstationtocollecttenantinformation(seven)carryoutsecuritycheckonrentalhousing,anddetectandeliminatehiddendangers(eight)inaccordancewiththelawwithintheprescribedperiod,payhousingrentaltaxesandfees(nine)thelesseefoundnomarriagecertificateorbirthcertificateofservicepregnancyorbirth,reporttotheadministrativedepartmentinchargeoffamilyplanninginatimelymanner(ten)whencollectingrents,theinvoicesissuedbythetaxauthoritiesshallbeprinteduniformly(eleven)theentrustedagentshall,inwriting,reportthecommunity(Village)rentalhousingmanagementstationintheplacewherethehousingislocatedThetrusteeshallfulfiltheobligationsofthelessor(twelve)otherobligationsthatshallbefulfilledaccordingtolawThelesseeofthetwentythirdhouseshallperformthefollowingobligations:()totruthfullyexplainthenumberofpeopletorentandtoprovidelegalandvalididentificationdocumentsformyselfandotherpersonsinresidence(two)fillintheregistrationformoftherentalpersonnelandacceptthemanagementoftherelevantdepartments(three)thelesseewhoisnotaregisteredpermanentresidenceofthecityshall,inaccordancewiththerelevantprovisions,registerwiththelocalpolicestationfortemporaryresidenceregistration(four)foundthattherentalhousingsecurityrisks,promptlynotifythelessortobeeliminated(five)tofulfiltheobligationsoffamilyplanning,andMarriedChildbearingAgepersonnelshouldconsciouslyaccepttheguidanceoftechnicalservicesforfamilyplanning(six)thestructureanduseofthehousecannotbealteredwithoutauthorization(seven)cooperatewiththelessorforsecuritycheck(eight)otherobligationsthatshallbefulfilledaccordingtolawTwentyfourthrentalhousingmanagementofficeoftheleadinggroupshallregularlyorganizepublicsecurity,planning,construction,realestate,business,familyplanning,taxationandotherdepartmentsofadministrativelawenforcementinspectionofrentalhousing,rentalhousingandthepublicsecurity,firehazardandillegalbehaviorTwentyfifthpublicsecurity,planning,construction,realestate,commerce,planning,taxandadministrativelawenforcementdepartmentsshallimplementthesupervisionresponsibilityofinspectionofthehousingrentalmanagementfoundillegalbehaviordoesnotbelongtothedepartmentinvestigatedinlawenforcement,itshallpromptlyinformtherelevantadministrativeorganstoinvestigate,andinformtherentalhousingmanagementgroupofficeatthesametimeTwentysixthtaxadministrationdepartmentsmay,inaccordancewithstateregulations,entrusttherelevantunitstolevytherelevanttaxesontheleaseofhouses,andtheestablishment,alterationandterminationoftheentrustedrelationshipshallbemadepublictothepublicinatimelymannerInthecourseoftheentrustment,therentstipulatedintheleasecontractofthehouseisobviouslylowerthanthatofthesimilarhousingmarket,andtheentrustedunitshallreportittothetaxauthoritiesinatimelymanner,whichshallbehandledbythetaxauthoritiesinaccordancewiththelawTwentyseventhpublicsecurityorgansresponsibleforrentalhousingpublicsecuritymanagement,community(Village)rentalhousingmanagementstation,shouldcooperatewiththepublicsecurityorganstodothiscommunity(Village)rentalhousingpublicsecuritymanagementCommunity(Village)rentalhousingmanagementstationfoundlesseeorotherpersonsbelongingtostaywithoutlawfulvalididentitydocuments,withoutproperoccupationpersonnel,ortheillegalorcriminalsuspects,shouldreporttothepublicsecurityorgansordepartmentsimmediately,whilethesituationwasreportedtothestreetoffices(township)rentalhousingmanagementcenterTwentyeighthapublicsecurityorganortherelevantdepartmenttothecommunity(Village)rentalhousingmanagementstationreport,shouldbeimmediatelytotherelevantinformationshallbechecked,andtheverification,promptlyinformthecommunity(Village)rentalhousingmanagementstationTwentyninthlessorsortheirentrustedhousingmanagers,lessees,lesseesrefusedorhinderedtherentalhousingmanagementstafftoperformtheirdutiesaccordingtolaw,thepublicsecuritypolicestationshouldbeassistedinaccordancewiththelawThirtiethunits,propertyservicesenterprisesshouldassistStreetoffices(township,town)rentalhousingmanagementcenter,community(Village)rentalhousingmanagementstationtofulfillitsmanagementresponsibilitiesArticlethirtyfirstinviolationoftheprovisionsofthesemeasures,housinglessorsorlessorsdonotperformregistrationobligations,therentalhousingmanagementdepartmentsconfiscatedillegalincome,andmaybepunishablebyafineofoftheillegalincomeThirtysecondinviolationoftheregulations,thelessorleasedhousingorrentalhousingwillnotproviderent,subletorthathousingdoesnotcomplywiththeprovisionsofarticletwelfthtostandardrental,leased,therentalhousingmanagementdepartmentshallorderrectification,inadditiontotimestheillegalincomeshallbeimposed,butthemaximummorethanyuanThirtythirdinviolationoftheprovisionsoftheleasebythelesseeresponsiblehousingconstructionareapercapitaareaorusenotinaccordancewiththeprovisionsofarticletwelfthofthestandardway,bythehousingrentalmanagementdepartmentshallorderrectification,overduerefusetocorrect,Bepunishedaccordingtothefollowingprovisions:()ifthelesseeisacitizen,heshallbefinedyuan(two)wherethelesseeisalegalpersonorotherorganization,afineofyuanshallbeimposedThirtyfourthhousinglessorsinoneofthefollowingcircumstances,thepublicsecuritydepartmentsshallbepunishedaccordingtolaw:()rentinghousestopersonswithoutlawfulandvalididentitydocumentsorfailingtoregisterthenameofthelesseeandthetypeandnumberoftheidentitydocumentsaccordingtoregulations(two)thelesseeshallnotreporttothepublicsecurityorganifheknowinglyusestheleasedhouseforcriminalactivities(three)thelessorfailstosignthepublicsecurityresponsibilityguaranteewiththepublicsecurityorganandrentsthehouse(four)astherentalhousingdoesnotmeettherequirementsoffirecontrolandpublicsecurity,criminalandpublicsecuritycasesanddisasteraccidentsarecausedThirtyfifthhousinglessorsintheprescribedperioddidnotapplyfortaxreturns,anddonotpayorpaylesstaxesshouldbepaidbythetaxadministrationdepartmentsinaccordancewiththelawpunishmentThirtysixth,inviolationofthesemeasuresshouldbesubjecttoadministrativepenaltiesforotheracts,therelevantadministrativeorgansshallbepunishedaccordingtolawArticlethirtyseventhrefusesorhindersadministrativelawenforcementofficerstoperformofficialdutiesaccordingtolaw,thepublicsecurityorgansshallbepunishedaccordingtolawifacrimeisconstituted,criminalresponsibilityshallbeinvestigatedaccordingtolawThirtyeighthrentalhousingmanagementdepartments,publicsecurityorgans,thetaxdepartmentandotherrelateddepartmentsstaffdonotperformmanagementduties,breachofprivilege,corruption,administrativesanctionsshallbegivenbytheirunitsorhigherauthoritiesconstituteacrime,shallbeinvestigatedforcriminalresponsibilityArticlethirtyninththeseMeasuresshallbeeffectiveasofthedateofpromulgation
