广东省公路条例（Guangdong province highway regulations） 广东省公路条例(Guangdong province highway regulations) Standing Committee of the people's Congress of Guangdong province (promulgated by units) 20030111 (time of promulgation) 20030301 (time of implementation) 20090101 (failure time) No. 155th of the Standing Committee of Guangdong Provincial People's Congress Highway regulations of the Guangdong (adopted at the thirty-ninth meeting of the Standing Committee of the Ninth People's Congress of Guangdong province in January 11, 2003) Chapter I General Provisions The second chapter is highway planning The third chapter highway construction and maintenance The fourth chapter highway management The fifth chapter is toll highway The sixth chapter, legal responsibility The seventh chapter is the supplementary provisions Chapter I General Provisions Article 1 in order to strengthen highway construction, maintenance and management, to promote the development of highway industry, according to the "People's Republic of China Highway Law" (hereinafter referred to as the highway law) and other relevant laws and regulations, combined with the actual situation of this province, the enactment of this ordinance. Article second these Regulations shall be applicable to the planning, construction, maintenance, operation, use and management of highways (including roads, bridges, highways, tunnels and road ferries) within the administrative area of this province. Article third the transportation departments of the provincial people's Government in charge of the province's highway work, responsible for organizing the implementation of these regulations and supervise the implementation; the transportation departments of the people's governments at or above the county level in accordance with the provisions of the provincial people's Government in charge of the administrative area of the highway. Provinces, cities and counties highway management institutions, municipal and county local highway management institutions (hereinafter referred to as highway management institutions) exercise the administrative responsibilities of the highways under their jurisdiction. The people's governments of townships, nationality townships and towns are responsible for the construction and maintenance of villages and towns roads within their respective administrative areas. Fourth the people's governments at various levels, planning, construction, land, industry and commerce, public security and other departments shall, within the scope of their respective functions, assist the competent departments of transportation and highway administration in doing well the construction and management of highways. The second chapter is highway planning The preparation and examination and approval of the Fifth Highway plans shall be carried out in accordance with the highway law. Highway Planning outside the main line of the national highway or national highway shall be subject to the overall plan of the state highway, and shall be formulated and approved in accordance with the relevant provincial highway planning provisions. If the road passes through the town planning area, the route selection and positioning of the crossing section shall be coordinated with the local town planning, and the opinions of the planning department of the local people's Government shall be solicited. The third chapter highway construction and maintenance In the eighth highway construction, laws and regulations concerning environmental protection and soil and water conservation shall be carried out by the state in accordance with the procedures for basic construction as prescribed by the state and the relevant provisions of the province. The highway construction project shall be in accordance with the relevant laws and regulations on the implementation of the provisions of legal person responsibility system, bidding system, project supervision system, contract management system, market access management system and project quality supervision and management system. The use of land for the construction of the ninth highway shall be handled in accordance with the relevant laws and regulations. Highway construction land compensation fees, resettlement fees, ground attachments and young crops compensation fee standards, in accordance with the relevant provisions of the people's Government of the province, responsible for project specific implementation by the local people's government, and shall apply for land clearance. The people's governments at all levels shall, in accordance with the relevant provisions of the timely and full payment of the compensation fees shall not be withheld, or for other purposes.
