徐淑华经济法no劳动法习题(XuShuhuaeconomiclawNOlaborlawexercises)徐淑华经济法no劳动法习题(XuShuhuaeconomiclawNOlaborlawexercises)ThesecondchapteristhelaborcontractlegalsystemInformationWhenalaboradministrativedepartmentofacityconductsroutineinspectiononacompany,itfindsthatthefollowingproblemsexistinacompany:()inFebruary,,acompanysignedalaborcontractwithWang,inthenameofworkcertificatedepositinthenameofWang,yuan,hasnotyetreturnedwangPutquestionsto:accordingtothemainpointsofthesubject(),thefollowingstatementsdonotconformtotheregulationsAthelaboradministrativedepartmentshallorderacompanytorefundthedepositofyuantoWangpersonallyBlaboradministrativedepartmentshallimposeafineofmorethanyuanandlessthanyuanagainstacompanyClaboradministrativedepartmentshallimposeafineofmorethanyuanandlessthanyuanagainstacompanyDacompanyshallbeliablefordamagescausedbytheunlawfulactofacompany()ZhangstartedworkinacompanysinceApril,,andthemonthlysalarywasyuanItwasnotuntilJuly,thatacompanysignedawrittenlaborcontractwithzhangPutquestionsto:accordingtothemainpointsofthesubject(),thefollowingstatementsareinconformitywiththeprovisionsAsinceApril,,acompanyhasestablishedlaborrelationswithZhangBacompanyshallconcludeawrittenlaborcontractwithZhanginMay,InApril,CcompanyshouldpayyuansalarytoZhang,andpayyuansalarytoZhangandZhanginMayandJunerespectivelyDinJulyst,whenthecompanyawrittennoticeofthelaborcontractifZhang,Zhangwithacompanytosignawrittenlaborcontract,acompanyshallnotifyZhangtoterminatethelaborrelationship,acompanydoesnotneedtopayeconomiccompensationtoZhang()sunbegantoworkinacompanysinceJanuary,,andthemonthlysalarywasyuanUntilJanuary,,acompanyhasnotsignedawrittenlaborcontractwithsunmouInJanuary,,sunrequestedanonfixedtermlaborcontractwithacompany,whichwasrejectedbyacompanyPutquestionsto:accordingtothemainpointsofthesubject(),thefollowingstatementsareinconformitywiththeprovisionsAasacompanysinceJanuary,andhasSohnconcludealaborcontractwithoutafixedterm,acompanyshallimmediatelySohnandconcludeawrittenlaborcontractInJanuaryB,acompanyshouldpayyuansalarytoSohnCfromFebruarytoDecember,acompanyshouldpayyuanmonthlywagestoSohnInJanuaryD,acompanyshouldpayyuansalarytoSohn()inAugust,,acompanyandZhou'slaborcontractexpired,hasbeeninacompanyforconsecutiveyears,Zhouproposedanonfixedtermlaborcontractwithacompany,wasrejectedbyacompanyPutquestionsto:accordingtothemainpointsofthesubject(),thefollowingstatementsdonotconformtotheregulationsAasacompanyhasbeenworkingcontinuouslyforyearsinacompany,inadditiontoZhou'sownproposalforafixedtermlaborcontract,acompanyshouldconcludeanonfixedtermlaborcontractwithZhouThestartingtimeofBcontinuousworkforyearsshouldbecalculatedfromthedateofemploymentoftheemployer,excludingtheworkingyearsbeforetheimplementationofthelaborcontractlawThestartingtimeofthecontinuousworkofCforyearsshallbecalculatedfromthedateofemploymentoftheemployer,includingtheworkingyearsbeforetheimplementationofthelaborcontractlawDinadditiontotheoriginalemployerhaspaideconomiccompensationtotheemployee,workersotherthanforpersonalreasonsfromtheoriginalemployerwasassignedtothenewemployerwork,workersintheoriginalemployerworkforyearscombinedwiththenewemployer()inSeptember,,theyearlaborcontractexpiresbetweenacompanyandcaoPutforwardbycao,Becauseoftheirownandacompanyhasmadeconsecutivefixedtermlaborcontract(thecontractdatewasSeptember,,September,),andhavenobadperformance,duringtheperformanceofthecontractsothatacompanyshallconcludeanonfixedtermlaborcontractwithyourselfPutquestionsto:accordingtothemainpointsofthesubject(),thefollowingstatementsarewrongAacompanyshouldconcludeanonfixedtermlaborcontractwithCaoBacompanymaynotenterintoanonfixedtermlaborcontractwithCaoCthenumberofconsecutivefixedtermlaborcontractsshallbecalculatedstartingaftertheimplementationofthelaborcontractlawinJanuary,andrenewingthefixedtermlaborcontractDthenumberofsuccessivefixedtermlaborcontracts,includingthefixedtermlaborcontractsignedbytheemployeeandtheemployerbeforetheimplementationofthelaborcontractlawInformationanswerCanalysisemployerinordertoguaranteethenameorothercollectionofpropertytothelaborer,thelaboradministrativedepartmentshallorderthereturnofthelaborer,andyuanperpersontomorethanyuanofthefollowingstandardsimposepenaltiesonemployersdamagetotheworker,itshallbeartheliabilityforcompensationInformationanswerABCanalysis():Aoptionsthatestablishthelaborrelationshipwiththeemployersincethe"LaborDay",theestablishmentoflaborrelationsandlaborcontractisindependentoftime():Boptionforlaborrelationshiphasbeenestablished,withoutawrittenlaborcontract,awrittenlaborcontractwithinmonthsshallbethedateofemployment()withtheoptionC:selfemploymentfromtheemployerwithinmonthsofnotlessthanyearsandthelaborerconcludeawrittenlaborcontract,timesthesalary,paytotheemployeeshallbemonthlywhichtheemployertotheemployee,themonthlypaymentofwagestimesstartingtimeasofthedateofemploymentformonths,daysbeforethedeadlineforawrittenlaborcontract()withselfemploymentfromtheemployerwithinmonthsoflessthanyearsfailstoconcludeawrittenemploymentcontractwithanemployeedoesnotIfawrittenlaborcontractissignedwiththeemployingunit,theemployershallnotifytheworkerinwritingoftheterminationofthelaborrelationshipandpaytheeconomiccompensationInformationanswerABCDanalysiswithselfemploymentfromtheemployerwithinyearsdidnotenterintoawrittenlaborcontractworkers,timesadaybeforethepaymentofwagesshallbethedateofemploymentwithinmonthsofthenextdaytothefullyearstotheemployeepermonth,andasthedayfromthedateofemploymentforyearshasbeenwiththelaborcontractwithoutafixedtermlaborcontract,itshallimmediatelyandshallconcludeawrittenlaborcontractInformationanswerBanalysis()optionA:workersoveryearsofworkintheemployercontinuously,theemployeeproposesoragreestoreneworconcludealaborcontract,unlesstheemployeeproposestoconcludeafixedtermlaborcontract,shallconcludeanonfixedtermlaborcontract()theoptionBC:overyearsofcontinuousworkstarttimeandtheemployershallcalculatethedateofemployment,including"workexperiencebeforetheimplementationoflaborcontractlaw"()theoptionD:workersotherthanforpersonalreasonsfromtheoriginalemployerwasassignedtothenewemployerwork,workersintheoriginalemployerworkforthenewyearscombinedwithpeopletheunitofworkexperienceHowever,theoriginalemployerhaspaideconomiccompensationtotheemployee,thenewemployerterminatesthelaborcontractinaccordancewiththelawtoliftcalculationandpaymentofeconomiccompensationworkexperience,nolongercalculateworkersintheoriginalemployerworkinglifeInformationanswerADanalysisthenumberofsuccessivefixedtermlaborcontractsshallbecalculatedstartingfromtheimplementationofthefixedlaborcontractaftertheimplementationofthelaborcontractlawinJanuary,Inthisquestion,thefixedtermlaborcontractbetweenCaoandacompanyforconsecutiveyearsoccurredbeforeJanuary,,AccordingtoCao,theproposalofacompanytoconcludeanunfixedtermlaborcontractisuntenableInformationInApril,alaboradministrativedepartmentofacitycarriedoutroutineinspectionofacompany,andfoundthatthefollowingproblemsexistedinacompany:()Zhanghadyearsofwork,andputforwarddaysofvacation,andacompanythoughtthatZhang'srequestforsickleavehadbeenaccumulatedfordaysin,andrefusedZhang'srequestPutquestionsto:accordingtothemainpointsofthesubject(),thefollowingstatementsdonotconformtotheregulationsAZhangenjoysdaysofpaidannualleaveBZhangenjoysthesamesalaryincomeasduringthenormalworkingperiodduringhisannualvacationCdidnotenjoytheyear'svacationinwhenZhangaskedforsickleaveformorethanmonthsDcouldstillenjoytheannualvacationinwhenZhangaskedforsickleaveformonthsPutquestionsto:accordingtothemainpointsofthesubject(),thefollowingstatementsareinconformitywiththeprovisionsAacompanyarrangesWangtoworkinthelegalholidayday,shouldaccordingtothelaborcontractstipulatedWangonedayorhourwagesstandardpaysWang'swagesBacompanyarrangesWangtoworkinthelegalholidayday,shouldaccordingtothelaborcontractstipulatedWangonedayorhourwagesstandardpaysWang'swagesCifacompanydoesnotpayovertimetoWang,thelaboradministrativedepartmentshallorderacompanytopayovertime,failstopay,thecompanyorderedofthesumpayablelessthanstandardtoWangpluspaycompensationDifacompanydoesnotpayovertimetoWang,thelaboradministrativedepartmentshallorderacompanytopayovertime,failstopay,thecompanyorderedofthesumpayablelessthanstandardtoWangpluspaycompensationPutquestionsto:accordingtothemainpointsofthesubject(),thefollowingstatementsareinconformitywiththeprovisionsThetermofAlaborcontractshallbeyears,andtheprobationperiodshallnotexceedmonthsBprobationaryperiodisnotincludedinthelaborcontractperiodCsunintheprobationperiodofmonthlywagesshallnotbelessthanyuanDintheprobationperiod,suchassunsickornonworkrelatedinjury,acompanytoSohnexplainedthereason,youcanterminatethelaborcontract()inJanuary,,acompanyinvestedthousandyuantosendZhaotoparticipateintechnicaltrainingabroadformonths,thetwosidesagreedonayearserviceperiodInNovember,,ZhaofoundthatacompanydidnotpaysocialinsurancepremiumsaccordingtolawZhaonotifiedacompanytoterminatethelaborcontractAcompanytoZhaonotcompletedtheagreedperiodofservice,askedZhaopaycompensationPutquestionsto:accordingtothemainpointsofthesubject(),thefollowingstatementsareinconformitywiththeprovisionsThelaborcontractlawoftheAprohibitsemployersfromsigningtheliabilityforbreachofcontractinthelaborcontractserviceperiodandothermattersotherthantheprohibitionofbusinessstrifeBifacompanyunilaterallyclaimstohaveinvestedtrainingforZhao,butcannotprovidethecorrespondingpaymentvoucher,becauseofitslackofevidence,cannotaskZhaotoassumetheresponsibilityforbreachofcontractCifZhaoseriouslyviolatestherulesandregulationsofacompany,acompanycanterminatethelaborrelationshipwithZhao,butithasnorighttoaskZhaotopayliquidateddamagesDifacompanyfailstopaysocialinsurancepremiumsforZhao,therighttonotifythecompanytoterminatethelaborcontractatanytime,acompanyhasnorighttoaskZhaotopayliquidateddamages()inJune,,theactualworkinglifeofyears,inacompanyhasworkedforyearsYang,pleasetakealongvacationYang'smonthlysalaryofyuan,sickleaveperiod,acompanytoYangpaidsickleavewageisyuan,thelocalminimumwagestandardisyuanAugust,,AfixedtermlaborcontractconcludedbetweenacompanyandYangyearsagoexpires,andacompanyproposestoterminatethelaborcontractPutquestionsto:accordingtothemainpointsofthesubject(),thefollowingstatementsareinconformitywiththeprovisionsAYangintherighttoenjoythemedicaltreatmentperiodformonthsBYang'ssalaryinthemedicalperiodshouldnotbelowerthanthelocalminimumwagestandardCinthemedicalperiod,acompanymaynotterminatethelaborcontractwithYangAftertheexpirationofDmedicaltreatment,suchasYangcannotengageintheoriginalwork,acompanycanterminatethelaborcontractwithYangInformationanswerCanalysis()optionA:atotalstaffoveryearsandlessthanyears,theannualleavedays()theoptionB:workersenjoythesameduringnormalworkingwageduringannualleave():theCDoptionhasaccumulativelyworkedforyearswithyearsofworkersPleaseleaveaccumulatedmorethanmonths,notentitledtoannualleaveInthiscase,Zhang,whohasworkedforyearsin,hasnotreceivedmonthsofsickleave,andcanenjoydays'annualleave()inOctober,,acompanyarrangedWang(daywagestandardisyuan)overtime,Wangrequestedacompanytopayyuanovertime,wasacompanyrefusedInformationanswerBCanalysis()optionAB:employerstoarrangelaborersinthe"legalholidays"work,thewagespaidtotheemployeesinaccordancewiththeprovisionsofthelabourcontractisnotlessthantheemployeedayorhoursalarystandard()CDoptions:theemployerarrangesovertimewithoutovertimepay,bylabortheadministrativedepartmentshallbeorderedtopayovertime,failstopay,theemployershallbeorderedtoofthesumpayablelessthanstandardpayanextracompensationtotheworker()inApril,,acompanysignedayearlaborcontractwithsunThetwosidesagreedaprobationperiod,andthefullmoonsalarywasyuanduringtheprobationperiodTheminimummonthlywageforacompanyisyuanInformationanswerAanalysis()optionA:thetermofthelaborcontractformorethanyearsandlessthanyears,theprobationperiodshallnotexceedmonths()theoptionB:probationperiodincludedinthelaborcontract()theoptionC:workersnotlessthanthelowestwageunitsofthesamepostorthelaborcontractofthewageswagesduringprobation,andshallnotbelowerthantheminimumwageoftheemployer,inthiscase,Sohnduringtheprobationperiodthemonthlywageofnotlessthanyuan()theoptionD:duringtheprobationperiod,theemployeeissickornonworkrelatedinjury,butnotintheoriginal"workinacertainperiodofmedicaltreatment,butalsocanbearrangedbytheemployingunitengagedintheworkofthe"circumstances,theemployermayterminatethelaborcontract,butitshallmakeanexplanationInformationanswerABDanalysis()optionC:workersduetoamajorfault(aseriousviolationoftherulesandregulationsoftheemployer)bytheemployertoterminatethelaborrelationship,theemployerstillhastherighttodemandthepaymentofliquidateddamages()Doptions:theemployerfailstopaysocialinsurancepremiumsforworkerstheworkerscan"inform"theemployertoterminatethelaborcontractdoesnotbelongtotheviolationoftheagreedperiodofservice,theemployershallnotrequireworkerstopayliquidateddamagesInformationanswerACanalysis()optionA:theactualworkinglifeofyears,yearsofworkinthisunitforyearsfollowingthemedicaltreatmentforaperiodofmonths()theoptionB:intheperiodofmedicaltreatmentforsickpayordiseasereliefcanbelowerthanthelocalminimumwagepayment,butnotlowerthanthelowesttheminimumwageof():Coptionmaynotterminatethelaborcontractperiodofmedicaltreatment,suchasmedicaltreatmentperiodincaseoftheexpirationofthecontract,thecontractmustextendtothemedicalstaffduringthisperiodexpires,stillenjoytheperiodofmedicaltreatment()D:aftermedicaltreatmentoptions,Notintheoriginalwork,onlyinthe"workerscannotengageintheworkarrangedbytheemployerunderthecircumstances,theemployermayterminatethelaborcontract,andtheemployershallpayeconomiccompensationtoworkers
