深圳经济特区职业技能鉴定条例(RegulationsofShenzhenSpecialEconomicZoneonAppraisalofvocationalskills)深圳经济特区职业技能鉴定条例(RegulationsofShenzhenSpecialEconomicZoneonAppraisalofvocationalskills)StandingCommitteeoftheShenzhenMunicipalPeople'sCongress(promulgatedbyunits)(timeofpromulgation)(timeofimplementation)(failuretime)RegulationsofShenzhenSpecialEconomicZoneonAppraisalofvocationalskills(adoptedatthethirteenthmeetingoftheStandingCommitteeofthesecondpeople'sCongressofShenzheninFebruary,andpromulgatedonFebruary,andeffectiveasofSeptember,)ChapterIGeneralProvisionsThesecondchaptermanagementorganizationThethirdchapteristheappraisalinstitutionThefourthchapteristheassessorandsupervisorThefifthchapter,conditionsforregistrationThesixthchapteristheprocedureofidentificationTheseventhchapter,legalresponsibilityTheeighthchapteristhesupplementaryprovisionsChapterIGeneralProvisionsThefirstistoimproveoccupationskilllevelofworkers,standardizetheoccupationskillappraisalbehavior,accordingtothe"People'sRepublicofChinalaborlaw"andotherrelevantstatelawsandregulations,combinedwiththeactualsituationofShenzhenSpecialEconomicZone,theenactmentofthisordinanceTheterm"vocationalskillappraisal"asmentionedintheseRegulationsreferstotheexaminationanddeterminationofthetechnicalrankandtechnicianandseniortechnicianqualificationoftheworkersaccordingtothetechnicalstandardsandtechnicallevelstandardsofthesecondclassesThetechnicalgradeisdividedintoelementary,intermediateandadvancedlevelsThirdvocationalskillsappraisalshouldfollowtheobjective,open,fairandstandardprinciplesFourthPeople'sgovernmentsatalllevelsshouldtakemeasurestoencourageworkerstoimprovetheirprofessionalskillsFifthemployersshouldcoordinateandsupportemployeestoparticipateinprofessionalskillsappraisalArticlesixththroughtheidentificationofvocationalskillsworkers,theMunicipalPeople'sgovernmentlaboradministrativedepartments(hereinafterreferredtoastheMunicipalLaborDepartment)issuedthecorrespondingvocationalqualificationcertificateTheemployershallapplytheprincipleofcombiningtheuseandtreatmenttotheworkerswhohaveobtainedthecorrespondingprofessionalqualificationcertificatesThesecondchaptermanagementorganizationSeventhMunicipalLaborDepartmentcomprehensivemanagementofthecity'svocationalskillsappraisalwork,andperformthefollowingresponsibilities:()toformulatetheprovisionsfortheappraisalofvocationalskills(two)trainingandevaluationofassessorsandsupervisors(three)formulatethedevelopmentplanofthevocationalskillsappraisalinstitution(hereinafterreferredtoastheidentificationinstitution)(four)toexamineandapprovetheaccreditationauthoritiesoftheindustryadministrationdepartmentsinconjunctionwiththeMunicipalPeople'sgovernmentsTheMunicipalLabourDepartmentmay,accordingtotheactualneedsoftheShenzhenSpecialEconomicZone,incorporatethecountry'soccupation(worktype)whichhasnotyetbeenincludedinthescopeofvocationalskillsappraisalintothescopeofprofessionalskillsappraisalEighth,themunicipallabordepartmentorganizationsetupvocationalskillsappraisalcommittee(hereinafterreferredtoasidentificationCommittee),theIdentificationCommitteebytheMunicipalLaborDepartment,tradeunions,tradeassociationsandotherrelevantdepartmentsofthestaffTheappraisalcommitteeshallberesponsibleforthecoordination,supervisionandproceduralworkoftheexaminationandappraisalofvocationalskills,andmaymakesuggestionstotheMunicipalPeople'sGovernmentonthemajorissuesconcerningtheassessmentandappraisalofprofessionalskillsNinthIdentificationCommitteeundertheoccupation(typesofwork)professionaltechnicalexpertgroup,forIdentificationCommitteeassignedtechnicalworkThethirdchapteristheappraisalinstitutionThetenthappraisalinstitutionreferstotheinstitutionsthatassessandevaluatetheskilllevelofworkersTheeleventhbidappraisalinstitutionshallmeetthefollowingconditions:()enterprises,institutionsandsocialorganizationswithlegalpersonality(two)therearemorethantenmanagerialpersonnelwithappraisalworkexperience,amongwhomfulltimemanagementpersonnelshallbenolessthanfive(three)theassessmentsiteswhicharesuitablefortheidentifiedprofession(worktype)andtherank,andtheinstruments,equipmentandtestingmeansconformingtothestatestandardsTwelfthbidappraisalinstitutionsshallsubmitawrittenapplicationtotheMunicipalLaborDepartment,thelabordepartmentshouldbeinconjunctionwiththemunicipalgovernmentrelatedindustrymanagementreview,andmakeawrittenreplyreceiptofapprovalornotwithinthirtydaysfromthedateofapplicationTheappraisalinstitutionsissuedbyexaminationandapprovalshallbeissuedbythemunicipallabordepartmentwiththecertificateofprofessionalskillsappraisalandthesignofthevocationalskillsappraisalinstitutionThirteenthaccreditationbodiesshouldbeprofessionalskillsidentificationagencysignshunginthemainofficeoftheprominentposition,andvocationalskillsassessmentcertificateapprovedbytheidentificationofthescopeoftheappraisalactivitiesThecertificationauthoritymaynotleaseortransfersuchlicensesandsignstoothersFourteenthappraisalinstitutionsengagedinappraisalwork,accordingtotheregulationstocollectfeesThefifteenthmunicipallabordepartmentshallinstituteanannualexaminationsystemfortheappraisalinstitutionsMechanismofidentificationofoccupationskillappraisalworkneedtodotocomplywiththeprovisionsoftheprovisionsofarticleeleventhorequipmentanddetectionmeans,managementhasnotadaptedtothelabordepartmentmaycancelitsqualificationintheannualSixteenthmunicipallabordepartmentsshouldregularlyidentifythename,address,identificationscopeandotherrelevantinformationtothepublicThefourthchapteristheassessorandsupervisorTheseventeenthassessorisapersonwhoperformstheexaminationandevaluationofhisprofessionalskillsandjudgeshisprofessionalqualificationsTheassessorisdividedintoonelevelassessorandtworankassessorEighteenthassessorsshouldmeetthefollowingconditions:()anevaluationstaffshallhaveseniortechnicianqualificationorseniorprofessionaltechnicaltitles,andtwoassessmentstaffshallhavethequalificationoftechnicianorintermediateorabovetechnicaltitles(two)workingexperienceintherelevantprofession(work)(three)goodprofessionalethicsNineteenthinlinewiththeprovisionsoftheeighteenthunitsrecommendedbytheirunits,youcanapplyforevaluationofqualificationsTheappraisalcommitteeentruststheprofessionaltechnicalexpertgrouptocarryonthequalificationexaminationtotheapplicationpersonnelAfterthetrainingofqualifiedpersonsbytheMunicipalLaborDepartment,therelevantqualificationcertificatesofthecorrespondingprofession(worktype)shallbeissuedTwentiethfirstgradeappraisalstaffcanparticipateinseniortechnicians,techniciansandhigh,medium,juniortechniciansassessmenttwoassessmentstaffcanparticipateinhigh,mediumandprimarytechnicalassessmentThetwentyfirstsupervisorsarethosewhosupervisetheassessmentandevaluationofprofessionalskillsTheexaminerisappointedbythemunicipallabordepartmentfromafirstclassappraisalofficerwithmorethantwoyears'appraisalworkexperienceThefifthchapter,conditionsforregistrationTwentysecondintheprovisionsofthestatemustbecertifiedbyoccupation(jobs)ofworkersandtheimplementationofthegraduationcertificateandoccupationqualificationcertificatedoublecertificatessystemofoccupationcolleges(Technology)Bi(junction)industry,shallapplyforoccupationskillappraisalOtherworkersmayvoluntarilyapplyforvocationalskillsappraisalArticletwentythirdhasoneofthefollowingconditions,mayapplyforanentryleveljob:()workinginthesameprofessionfortwoyearsormorethanfouryearsofwork(two)completionofprimarytrainingArticletwentyfourthhasoneofthefollowingconditions,mayapplyforintermediateworkers:()theinitialworkgradecertificateofthedeclaredprofession(work)shallbethreeyears(two)obtaintheprimaryworkcertificateofthedeclaredprofession(job)andfinishthetrainingthroughtheintermediateworkertraining(three)graduatesofinstitutionsofhigherlearningandsecondaryspecializedschoolsareengagedinVocationalandtechnicalworkcorrespondingtotheirmajorArticletwentyfifthhasoneofthefollowingconditions,mayapplyforseniorstaff:()toobtaintheintermediateworkgradecertificateofthedeclaredprofession(work)forfouryears(two)obtaintheintermediateworkgradecertificateofthedeclaredprofession(work)andfinishthetrainingthroughseniorengineer(three)graduatingfrominstitutionsofhigherlearningandobtainingintermediatejobcertificatesoftheprofession(work)tobedeclaredArticletwentysixthhasoneofthefollowingconditions,mayapplyforanapplicationtechnician:()obtainaseniorworkcertificateandworkcontinuouslyfortenyearsoraccumulatedforfifteenyearsinthisprofession(typeofwork)(two)thetopsixwinnersofthetoptenskillscompetitionsinthenationalskillscompetition,thetopsixwinnersoftheprovincialskillscompetition,andthetopthreewinnersoftheShenzhenmunicipalskillscompetitionintwo(three)awardedthreeandaboveattheprovinciallevelandShenzhenmunicipallevelTwentyseventhqualifiedtechnicians,andinthetechnicianpostforthreeconsecutiveyearsormorethanfiveyearsofemployment,mayapplyforseniortechniciansTherearetwentyeighthtechnicalexpertise,inaccordancewiththeMunicipalDepartmentoflaborregulationsinadvanceorleapfrogapplyingconditions,byunitsorindividualsforverificationandapprovalofrecommendation,theMunicipalDepartmentoflabor,inadvanceorleapfrogfortheoccupationskillappraisalForthespecialrequirementsoftheage(job),thecitygovernmentmayformulateconditionsforregistrationThesixthchapteristheprocedureofidentificationThetwentyninthappraisalinstitutionshalldeclaretheannualappraisalplantotheMunicipalLaborDepartment,andannounceittothepublicafterapprovalThirtiethcandidatesforexaminationconditions,holdersofcertificationmaterialstothedesignatedlocationsforregistration,qualificationexamination,paytheidentificationfeeandreceiveadmissionticketThethirtyfirstappraisalinstitutionshallselecttheassessorsaccordingtothenumberofcandidatesexaminedbeforeeachappraisal,andshallformagroupofevaluationoftheprofession(worktype)accordingtothefollowingprinciples:()thenumberofassessorsattheexaminationandappraisalteamisnotlessthanthree(two)thesameoccupation(jobs)theassessmentofeachassessmentgroup,theassessorshouldberotation,rotationnumbernotlessthanofthetotalnumberofevaluationgroup,eachmembershallnotexceedtwotimesofcontinuousevaluationworkinthesameappraisalappraisalinstitutions(three)whenthecandidatesandtheevaluationstaffhavecloserelatives,teachersandstudentsandotherinterests,theassessorshouldapplyforwithdrawalTheappraisalinstitutionshallappointonepersonfromtheexaminationandevaluationteamtobethechiefassessor,andshallberesponsiblefortheorganizationandcoordinationoftheevaluationteamThirtysecondidentificationinstitutionsshouldbeidentifiedtendaysbeforetheassessmentgroupandtheappraisalreporttothemunicipallabordepartmentfortherecordlistThemunicipallabordepartmentshalldeterminethesupervisorafterreceivingthelistofrecordsThirtythirdquestionsofprofessionalskillsidentificationaregeneratedandobtainedaccordingtothefollowingprocedures:()theexaminationquestionsareextractedbythemunicipallabordepartmentfromtheexaminationquestionsdatabaseofthestateandtheprovinceofGuangdongtheexaminationquestionsinthestateandGuangdongprovinceshavenotbeenestablished,andthetestquestionsareextractedfromtheexaminationquestionssetupbythemunicipallabordepartment(two)themunicipallabordepartmentshallprintandsealthetestquestionsbeforetheexamination(three)theappraisalinstitutionshalldrawtheexaminationpaperfromtheMunicipalLaborDepartmentonthedateofidentificationThirtyfourthappraisalinstitutionsshouldcompletetheexaminationpreparation,equipmenttestingandmaterialpreparationbeforethestartoftheappraisalThirtyfifthvocationalskillsidentification,theimplementationoftheoreticalknowledgeandskills,operationalassessmentofthecombinationofmethodsIdentificationoftechniciansandseniortechniciansshouldalsobecarriedoutindefenseofprofessionalknowledgeTheoreticalexaminationpapersshallbesealedonthespotafterexaminationandsenttotheMunicipalLaborDepartmentonthesameday,andshallbeorganizedbyexpertsfromthemunicipallabordepartmentOperationalassessmentbytheevaluationteamforcandidatesonsiteassessment,onsitescoring,thechiefassessorisresponsiblefortheoverallscoreandcomprehensiveassessmentTheappraisalinstitutionshallreporttheoperationassessmentresultstotheMunicipalLaborDepartmentonthedateofassessmentTheexaminershallsuperviseandrecordtheprocessoftheexaminationandappraisal,andreportittothemunicipallabordepartmentThirtysixthmunicipallabordepartmentsshouldreceiveassessmentresultswithinfiveworkingdays,theexaminationresultswillbeannounced,andtheassessmentofqualifiedpersonsissuedbythestatevocationalqualificationcertificateTheprofessionalqualificationcertificateshallbestampedwiththesealoftheaccreditationinstitutionTheseventhchapter,legalresponsibilityThirtyseventhwithoutobtainingalicenseoridentificationexceedthescopeofthepermitidentificationoftheimplementationofoccupationskillappraisal,bythemunicipallabordepartmentshallbeorderedtostopthereturnofcandidatesidentification,appraisalfees,appraisalresultsannouncedinvalid,giveawarningtotheorganizersandtothepublic,inadditiontothefeesamountedtotwotimesthefineIfthecaseisserious,theLaborDepartmentofthecitymayrevokeitslicenseifthecircumstancesareseriousArticlethirtyeighthoftheidentificationlicenseandidentificationagencysignstransferredorleasedtoothers,theCityLaborDepartmentconfiscateditsillegalincomeandrevokeitslicense,andimposeapenaltyoftwotimestheillegalincomeThirtyninthassessors,verifierfraud,breachofprivilege,thelabordepartmentshallcancelitsappraisal,supervisionandexaminationqualificationconstitutesacrime,criminalresponsibilityshallbeinvestigatedbyjudicialorgansaccordingtolawFortiethwithoutincreasingfeesraisefees,bythepriceadministrationdepartmentshallorderthefeereturnedtothecandidates,andpunishedaccordingtotherelevantprovisionsifthecircumstancesareserious,theMunicipalLaborDepartmentwithheldorrevokethelicenseFortyfirstunauthorizedprinting,sellingoccupationqualificationcertificatetoreapbenefits,bythelabordepartmentshallconfiscateitsillegalincome,andimposeafineofthreetimestheillegalincomeconstitutesacrime,criminalresponsibilityshallbeinvestigatedbyjudicialorgansaccordingtolawFortysecondoftheidentificationprocess,orresorttodeceit,bythelabordepartmentshallbeorderedtomakecorrections,andgiveawarningifthecircumstancesareserious,bewithheldorrevokethelicenseconstitutesacrimeagainstthestaff,shallbeinvestigatedforcriminalresponsibilitybythejudicialdepartmentsinaccordancewiththelawArticlefortythirdtheadministrativeorganbeforedecidedtorevokethelicenseorthelargertheamountoffinesandotheradministrativepenalties,shouldhavetherighttorequestahearingtoinformthepartiesaccordingtotherelevantprovisionsifthepartyrequestsahearing,theadministrativeorganshallorganizeahearinginaccordancewiththerelevantprovisionsArticlefortyfourthlabordepartmentandtherelevantdepartmentsofthemanagementpersonnelofbreachofprivilege,derelictionofduty,shallbegivenadministrativesanctionsbytherelevantprovisionsofthedepartmentortheMunicipalPeople'sGovernmentonthebasisofthestateconstitutesacrime,shallbeinvestigatedforcriminalresponsibilityaccordingtolawFortyfifthifapartyrefusestoacceptthedecisiononadministrativepunishmentofadministrativeorgans,afterreceivingthenoticeofadministrativepenaltywithinfifteendaysfromthedateoftheMunicipalPeople'sgovernmentadministrativereconsiderationorganforreconsiderationordirectlytothepeople'scourtaccordingtolawTheeighthchapteristhesupplementaryprovisionsArticlefortysixththeresidentsofHongkong,MacaoandTaiwan,aswellasaliens,applyforprofessionalskillsappraisalintheShenzhenSpecialEconomicZone,andmayrefertotheseregulationsThesefortyseventhregulationsshallcomeintoforceonSeptember,Localregulations(categories)Y(usinglogos)(rank)
