司法院继民国九十二年推行「改良式当事人进行主义」的司法制度改革之后,又宣布将推动下一阶段的刑事诉讼程序改革,包括未来采用「起诉状一本主义」以排除预断,使法官在心证形成上益臻公平客观,使审理活动更为快捷顺畅;同时也准备将现行上诉程序做一番变革,即审级的定位,第二审改为事后审,第三审成为严格法律审等,同时进行配套修正1。鉴于美国系实施「起诉状一本主义」为中心之当事人进行主义制度,究竟其实务上之作法如何?有何相关配套措施?如何师法借镜?对于我国日后刑事诉讼制度之走向有一定的参考价值。故不揣浅陋,藉此际正在美国哈佛大学法学院访问研究之机会,将美国刑事诉讼制度有关此方面的相关规定及实务作法,经本文做一简要之整理介绍。 美国刑事诉讼法系采对抗式诉讼制度(adversary system; 亦称accusatorial system,或 accusatory procedure),主要目的是透过公平的途径解决检、辩双方之间的争端,故公诉方式采取所谓的「起诉状一本主义」,亦即起诉时,只向法院移送一本起诉书,不得附带移送可能使庭审法官产生预断的任何证据数据。美国之刑事诉讼程序将审前程序与审判程序采取彻底分离的模式,以保证法官的中立以及法庭审讯时的对抗性和实质性。基于「起诉状一本主义」的要求,检察官不能向法官移送侦查中形成的笔录和收集的证据。为了防止法官预断,实务上一般也不会在起诉书中记载被告人的前科、学历、经历、性格以及犯罪动机和目的等情况;以避免法官有“先入为主”的观念,甚而对被告产生偏见,此乃提供程序上正义的保障以实现公正审判的目的。而因实行起诉状一本主义,由于法官事先没有接触证据的机会,就不得不将证据调查交给检、辩双方进行言词性的举证、交互诘问,故要贯彻「起诉状一本主义」之实施,相关的配套措施,如起诉书的记载方式、认罪协商及部分犯罪的转向处分在审前程序如何进行、起诉之审查机制、证据开示制度、交互诘问制度,乃至陪审团制度,都值得探究。谨将美国刑事诉讼制度中,有关「起诉状一本主义」及其配套措施之相关规定,择要作一介绍。 1、​ 起诉书记载之方式: 大陪审团2起诉书或检察官起诉书3应当是关于构成所指控罪行的基本事实的清楚、简要和明确的书面陈述,应当由检察官具名签署。起诉书中不需要有正式的起始、结论和其它不必要的内容4。大陪审团起诉书或检察官的起诉书应当就指控的每条罪状说明该行为违反的法律、法规、条例或其它法律规定,援引有关法律条文5( Rule 7(c)(1) of the Federal Rules of Criminal Procedure,附件一)。 2、​ 审前程序之相关配套措施: 美国实行「起诉状一本」,故其刑事诉讼程序将审判程序与审前程序采取彻底分离的模式,以保证法官的中立以及法庭审讯时的对抗性和实质性。故如何运用审前之初审或大陪审团审查程序,先确认案件是否有相当理由(probable cause)足以起诉;或如系简易案件根本就在过堂审讯或初审时以认罪协商方式直接判决处刑、或部分犯罪类型得予以转向处分(diversion, 类似我国缓起诉处分),以减少进入审判程序之通常起诉案件数量之配套措施,就相形重要。兹概述美国刑事诉讼就此配套措施在审前程序的实务运作模式: (1)​ 简易案件在过堂审讯(arraignment)时的认罪量刑6:美国刑事诉讼程序中的过堂审讯通常是开启刑事诉讼法庭活动的一个简单的审讯程序。主要目的是使被告出庭聆听所被指控的罪名并取得书面诉状,法官并听取被告答辩。此阶段并没有陪审团在场,但被告仍应有律师陪同,如其符合当地法律规定之无资力情形,可在此程序声请法院为其指定辩护人。被告或检察官也可以在过堂审讯时要求法院再次审核保释金额是否恰当;且被告可在此程序提出任何审前动议(如争执该法院无管辖权,或争执被告行为根本不构成犯罪等),请求另定庭期审理;法院也可依各州之法律规定,视案件情节轻重,在过堂审讯时决定是否排定初审或认罪协商会议的日期。如果是简易案件,且被告在过堂审讯时就认罪,过堂审讯的法官很可能就接受被告与检察官立时达成的认罪协商结果并直接量刑,案件就毋庸进入审判程序。如果嫌犯在押,过堂审讯通常要求在嫌犯被逮捕后48小时内(周末假日不计入)即须进行。如果被告已交保,过堂审讯就可能几星期之后才进行,细节之规定,各州不一7;不过,联邦最高法院就有判决指出各州过堂审讯之日期「应尽速进行」(as quickly as possible)8。如果过堂审讯之日期延误过久,且此延宕非可归责于嫌犯,而因此造成嫌犯无法及时提出有效抗辩(如重要证人逃逸),则嫌犯可以向法院请求撤销该项对嫌犯之指控。 (2)​ 部分犯罪之转向处分(diversion):转向处分是指刑事被告如符合当地可执行转向处分程序之资格规定者,检察官于考虑其前科纪录或缓刑观护官(probation officer)之意见,可主动提出被告是否接受转向处分之处理;或由被告律师向检察官提出建议,待被告第一次出庭时向法官要求施以转向处分(实务上只要在进入审判前都可以请求)。被告可在审判前依规定参与小区服务、工作教育训练或接受治疗矫正等,一旦成功执行完毕,其被指控之罪名就可被撤销,而毋须进入刑事审判程序。可施以转向处分之犯罪,通常以轻罪(misdemeanors)和施用毒品酒精类有关之非暴力重罪(nonviolent felonies)为主。但也有一些州法将家庭暴力犯罪、对儿童施虐或轻忽、交通违规案件、票据法等案件列入可施以转向处分之案件类型。被告执行转向处分之费用须自行负担,此项费用或许比判处罚金还高;但对被告有利的是其可接受治疗以及避免留下犯罪 记录 混凝土 养护记录下载土方回填监理旁站记录免费下载集备记录下载集备记录下载集备记录下载 (但逮捕记录仍在)。转向处分之做法极似我国现行之缓起诉处分。 3、​ 起诉之审查机制: 基于「起诉状一本」只有诉状没有证据数据的特性,如何就欲进入审判庭的案件进行审查,使审判庭的审理有实益并有效率,则建立起诉案件质量的审查机制应是首要之务。美国刑事诉讼制度下之起诉审查机制有二,一为初审程序之起诉审查,一为大陪审团之起诉审查: (1)​ 初审程序(preliminary hearing)之起诉审查:美国刑事诉讼制度下之初审程序,主要目的即是由法官或治安官于听审后,裁定检察官指控被告犯罪之案件是否具有「相当理由」(probable cause);如果经检视系证据薄弱的案件,该案件是可以被撤销的。须区别的是,法官于初审程序裁定案件具有相当理由,并不意指其已认定被告有罪,而仅是指检察官能提出足够证据让人相信确有犯罪发生且系该名被告所为。初审程序,本质上是一个对检察官决定起诉的独立司法审查机制,故在此程序,法官会要求检察官提示证据;虽然检察官不一定会将所有证据在此程序上都显现出来,但必须能说服法官该案件的指控有「相当理由」。与审判庭不同的是,初审程序审理时间较短(通常数分钟至二小时)、没有陪审团在场、举证责任负担较轻(只须有相当理由,不须达到超越合理怀疑的程度),而且是容许传闻证据(hearsay evidence)的。此外,如果检察官在初审时有提示证人到庭作证,被告可以在此程序要求诘问证人;如有必要,被告也可以在初审程序中提出对自己有利之证据。在初审时的证人证言都会逐字记录或录音,日后诉讼二造可以付费要求此项记录做为审判庭时之证据数据。但并非每一案件都适用初审程序,通常只有被告在过堂审讯(arraignment)或第一次庭讯(initial appearance)并不认罪时才会进行此程序。除了儿童性侵害案件不适宜公开审理,基本上初审程序都是公开审理的。初审后的结果可能有三:1.大部分的案件系以原指控的罪名进入审判庭程序。2.部分案件,法官认为指控罪名过重而变更为较轻罪名。3.小部分案件遭撤销原指控。如果法官裁定指控之案件具有相当理由,通常就会直接在该诉状(criminal complaint)上如此记载,检察官随后会向法院另行提出一份起诉书(information),如同经大陪审团决定的起诉书(indictment)一样,亦即正式对被告起诉。不过,视各地法律规定及案情严重与否,初审程序也可以进行认罪协商,或请求径行依案卷数据审判(submit on the record)。另外,案件是否自始至终都由同一个检察官负责出庭,各州规定亦不一;有的检察署检察官就其承办案件是从提起指控、过堂审讯、初审、审判庭及其它各种诉讼程序都一手包办;但也有检察署的做法是将各个阶段切割,例如有的检察官专门负责过堂审讯,有的检察官只负责重罪案件的初审程序,另也有检察官只负责轻罪的审判庭等等。 (2)​ 大陪审团(grand jury)之起诉审查:美国刑事诉讼制度中另一种起诉审查之方式就是大陪审团审查制度。虽然法官比较喜欢用初审程序(没有陪审团,法官自行裁定),但一般观察,检察官似乎较偏好采用大陪审团制度。或许因为大陪审团审查是采不公开之秘密进行方式,证据数据不须先公开审查,且检方证人不用如在初审程序时可能遭被告诘问之原故。大陪审团的审查进行程序,是由检察官提出指控,并提示检察官认为可成立最基本之诉追条件的证据即可。因大陪审团审查是秘密进行,嫌疑人及其律师并不在场,但遭起诉的嫌疑人可于审查后取得大陪团程序进行的纪录缮本,这也是检察官只会揭露最基本证据之最重要原因。如有必要,检察官可以传唤嫌疑人或其它证人在大陪审团审查时到庭作证。如果大陪审团决定起诉,就会确认检察官之控状,称之为”true bill”,如果决定不起诉,则称其提出之否决为”no-bill”。一般而言,大陪审团的审查程序并非在对抗式的程序下进行,大陪审团只能听闻检察官提出的陈述和证据,虽然检察官对于被告有利的证据也有义务提出9,但此类证据之提出情形通常很少见。所以在缺少对造质疑证据的情况下,大陪审团多会依检察官之请求而对被指控犯罪的被告提起公诉。这也是大陪审团常被讥为是检察官的橡皮图章(rubber stamps)的原因,而遭各界质疑此种审查机制是否有意义。 4、​ 证据开示制度: 证据开示(Disclosure of Evidence),是指检辩双方在法庭审判前相互展示证据的一项制度,因为英美当事人进行主义之对抗式诉讼制度的刑事诉讼中,若实行起诉状一本主义,法官之角色将系消极的中间仲裁者,故证据开示的程序就更为重要,否则法庭审判将演变成出绝招致胜的司法竞技场,检辩双方在诉讼中的相互突袭不可避免,难以达成发现真实的审判功能。一旦检辩双方进行了充分的准备,法庭中的质证就能针对争点进行,证据讯息能够在庭审中充分交流,方能有利于法庭对案件事实形成正确的判断。是确立证据开示制度乃基于其有利于案件的诉讼程序变得迅速、有效率。美国1946年「联邦刑事诉讼规则(Federal Rules of Criminal Procedure )」第16条(附件二)中首次确立了证据开示规则,以后各州也相继规定,并逐渐扩大了证据开示的范围。美国目前证据开示制度之实务运作重点如下: (1)​ 检察官在审判前须对被告揭露所持证物:各州均有制定证据开示规则,规定检察官在审判前须对被告揭露所持证物。此举不纯粹是为了确保审判结果的公平,立法者认为若被告在审判前得悉检方持有强大证据,会比较可能进行认罪协商,以节省案件进入审判程序所须花费的时间和金钱。美国目前百分之九十之刑事案件是在审判前就解决确定,证据开示制度或许扮演一重要角色。 (2)​ 原始资料始须提出:证据开示规则通常区分原始数据(raw information)、准备数据(attorney work product),前者例如:证人姓名、警方 报告 软件系统测试报告下载sgs报告如何下载关于路面塌陷情况报告535n,sgs报告怎么下载竣工报告下载 10、毒品或酒精测试结果等;后者是指检察官或律师的攻防策略。一般来说,原始数据须在审判前提示予被告知悉。但尽管潮流大致是倾向自由开放的证据开示,但各管辖法院对于证据开示法则的规定仍有相当大的不同。例如,联邦法院的做法(依据美国联邦法典18 United States Code §3500,附件三),在政府证人出庭作证之前,被告是不可以知悉其审前陈述的11。但加州刑法典之规定又有不同,其甚至明文规定检察官在审判前(正常状况至少审判前30天)应揭露之证据事项12( Section 1054.1 of the California Penal Code.,附件四)。惟检察官对被告的攻防策略准备资料,是不须要在证据开示时提出的;不论检辩双方,都必须为审判做准备,并保留其智慧结晶以对抗不认真准备的对造。13 (3)​ 证据开示之时间点:证据开示之时点,不限于审判前的某一特定时间。整个审前阶段都可进行各项的证据开示。故被告可能在第一次出庭时收到逮捕报告,却在审判期日前不久才收到检方提出的血液 分析 定性数据统计分析pdf销售业绩分析模板建筑结构震害分析销售进度分析表京东商城竞争战略分析 鉴定书。 (4)​ 对被告有利事证之提供:检察官若知悉对被告有利之事证,即可能使被告获无罪的讯息,必须在审判前对被告揭露(disclose)该项讯息14,英美法称之为「可证明无罪之讯息(“exculpatory” information)15」。只要该项讯息足以使一理性(reasonable)之法官或陪审员,对被告是否犯罪心中产生怀疑(不须达至可证明被告系无辜之程度),此项讯息就必须对被告揭露。若检察官未揭露此项讯息让被告知悉,且因此使被告获致有罪判决,若被告上诉,则上诉法院可以废弃原判决。 (5)​ 被告前科资料之检视:被告可以要求检视其以往之逮捕及犯罪纪录,亦即前科数据(criminal record; rap sheet),若发现前科资料上有同名错误、罪名错误或案件撤销却仍有纪录之情形等,即可及时更正。但须注意的是,若前科纪录上漏失掉部分犯罪纪录,被告并没有义务提醒检察官,因为那是政府的工作。 (6)​ 对等证据开示法则:传统的观念,检察官是不能从被告身上获取讯息的,但近几年来,证据开示制度趋向「双向交流(two-way street)」。因为既然被告可以得悉检察官取得之证据数据,检察官自然也得检视被告所拥有的证据资料。虽然有被告争执此举违反宪法第五修正案所保障的被告有权保持缄默及被告有「无自证己罪」(privilege against self-incrimination)之权利的规定,然而,所谓的「对等证据开示法则(reciprocal discovery laws)」已经联邦最高法院着有判例支持16,联邦法律17( Federal Rule of Criminal Procedure 12. 1.,附件五)及部分州法亦有将此法则订入明文者18(加州刑法典§ 1054.3.,同附件四)、(佛蒙特州刑事诉讼规则16.1(a)(1).,附件六)。依此法则,若被告不愿应检察官的要求,提出能证明其有不在场证明的证人名字及其地址,该不在场证明就不能提出作为证据,法院亦不能传唤该证人出庭作证。 5、​ 交互诘问制度在审判程序中之运用: 既采「起诉状一本」,所有之证据数据待审判庭时才一一呈现,故如何在公诉程序将证人证物完整的陈述、展现,端赖检、辩双方如何进行攻击防御。美国刑事诉讼审判程序和诘问方式,即使同一法院的法官也可能各有不同的做法。一般而言,其刑事诉讼最 标准 excel标准偏差excel标准偏差函数exl标准差函数国标检验抽样标准表免费下载红头文件格式标准下载 的审判程序如下: (1)​ 检辩双方先决定是选择由法官审判,还是由陪审团审判。 (2)​ 若选择采用陪审团,即须进行选任陪审员(voir dire)之程序。 (3)​ 界定证据( address evidence issues):检辩双方在进入正式审判前可以提出动议,请求对于有争议之证据予以排除,禁止该证据进入法庭为证19,希望在第一时间避免陪审团听到不适当之证据而影响其心证。 (4)​ 陈述事实要旨(opening statements):检方、辩方依序陈述事实。在此程序中,双方只能说明待证事实及欲提出何种证据,但不能介绍证据内容,也不能就实体争执;换言之,仅是证据的预览,而不是争执双方所提证据之可信度。 (5)​ 检察官对于己方证人之直接讯问(prosecution case-in-chief through direct examination):因检察官对所述案件负有举证责任,故由其先进行己方证人之讯问。直接讯问应以非诱导式的讯问方式为之。 (6)​ 辩方对于检方证人之诘问(cross-examination):诘问之范围限于证人在直接讯问时之内容,主要目的是质疑证人在直接讯问时之证言可信度。诘问可以诱导式的讯问方式为之。 (7)​ 检察官对己方证人之再次讯问(redirect examination):再次讯问的目的是让证人有机会就诘问时被质疑的证言内容予以说明澄清。 (8)​ 检察官提证完毕(prosecution rests)。 (9)​ 辩方提撤销起诉动议(motion to dismiss):在检察官提证完毕后,如辩方认为检方证据不充分,可以向法官提出撤销起诉动议。若法官准许,即等同于被告无罪释放,被告就不会再被审讯。但法官驳回撤销起诉动议(motion to dismiss denied)之情形较多。 (10)​ 辩方对己方证人之直接讯问(defense case-in-chief through direct examination):若被告没有提出撤销起诉动议,或法官驳回被 告之撤销起诉动议,则辩方提出己方之证人为证,进行直接讯问。 (11)​ 检察官对于辩方证人之诘问(cross-examination)。 (12)​ 辩方对己方证人再次讯问(redirect)。 (13)​ 辩方提证完毕(defense rests)。 (14)​ 检察官提反证 (prosecution rebuttal):辩方提证完毕,检察官 还可以针对辩方所提证据提出反证,但不能藉提出反证之方式,再次提出曾提过的相同证据,或提出与被告所提证据范 围内容无关之新证据。 (15)​ 厘清适用法律及其争点(instructions settled):检、辩双方与法 官共同厘清应告知陪审团之适用法律及其争点。 (16)​ 检察官进行言词辩论(prosecution closing argument):检察官总 结证据,并说明应判决被告有罪之理由。此程序不宜再以尚有证据未提出而要求再行提证。 (17)​ 辩方进行言词辩论(defense closing argument):辩方律师总结证 据,并说明应判决被告无罪或较轻罪名之理由。此程序不宜再以尚有证据未提出而要求再行提证。 (18)​ 法官指示陪审团本案争执要点及适用法律20( jury instructed): 通常法官指示的要点包括各种法律原则,如本案之犯罪构成要件要素、何谓「合理的怀疑」、陪审团之决议须一致之要求、所有本案适用之法律规范、评估证人可信度的因素有哪些,及陪审团之内部规则(例:陪审团主席”foreperson”之选任21、如何执行陪审团之审议等)。但法官不能先向陪审团透露其就本案之心证。 (19)​ 陪审团进行评议( jury deliberations):陪审团之决议须全体一致 才能达成判决。 (20)​ 被告提起对于陪审团有罪评议之审后动议(post-trial motions if guilty verdict) :若陪审团宣告被告有罪判决后,被告可以提审后动议要求法官推翻陪审团之决议,予以重新审讯22或命令被告无罪释放23。但法官通常会驳回被告之审后动议。 (21)​ 法官之量刑判决(sentencing if guilty verdict):对于陪审团评议 有罪之案件,若被告没有提出审后动议,或法官驳回被告之审后动议(post-trial motions denied),法官即可当庭或另择期日宣告量刑之判决。 6、​ 陪审团制度: 英美诉讼制度最大特色并向来被视为其司法制度之核心机制,即其陪审团制度24。虽然被告也可选择放弃陪审团审判之权利25,而由法官审判。陪审团有二种:大陪审团(grand jury) 和陪审团 ( trial jury, 亦称小陪审团”petit jury” )。大陪审团、小陪审团都是公民中随机挑选出来,在案件中扮演听证的角色,二者最大不同在于1. 大陪审团决定是否对犯罪嫌疑人提起公诉,小陪审团决定被告是否有罪。2.大陪审团采秘密程序进行,小陪审团是在公开审判程序进行。3.大陪审团任命期间较长,通常与法庭期间(a term of court)一致,多为六至十八个月;小陪审团审讯期间较短,除非是碰到较长的审判,否则十天即可。4.大陪审团成员为15-23人(在联邦法院为16-23人,参见联邦刑事诉讼规则(Federal Rules of Criminal Procedure6(a),附件八 ),小陪审团成员通常为6人或12人。5. 大陪审团并不一定须要全体意见一致才能提起公诉,例如在联邦法体系,12人以上同意就可提起公诉(参见联邦刑事诉讼规则Federal Rules of Criminal Procedure6(f),同附件八);但小陪审团一般必须全体一致裁定被告有罪(参见Federal Rules of Criminal Procedure第23条、第31条,附件九)。 陪审团制度之利弊优劣,在美国也引起很大争议,如大陪审团被讥为是检察官的橡皮图章(rubber stamps),而小陪审团之审判若仅凭借一般知识经验的陪审员能力是否能够胜任日趋复杂或高科技化之案件型态、如何确保选任之陪审员公平无偏见、支持陪审团制度运作所需付出庞大的社会成本及被告因此增加之费用负担(如律师为在陪审团面前有好表现以说服其为有利被告之认定结果,势必得花费精神时间在搜集证据证人、准备案件,此皆得转嫁为被告之负担)等等,都是近年来在美国引起质疑,要求陪审团制度或相关法律应考虑改革之原因。事实上,不论是民事审判或刑事审判,一些指针和数据显示要求陪审团审判的案件已大幅萎缩26。就刑事案件而言,或许因其刑事政策,如联邦量刑准则(Federal Sentencing Guidelines)对于认罪之惩处甚为优惠,致以认罪协商终结案件之比例大量成长,自然进入刑事审判的案件也就越来越少。虽然亚洲国家如日本、韩国之司法改革有引进陪审团制度之倡议,但是否适用于我国,就得考虑人民素质、法律素养、社会公益及成本等多重因素,可能还有待观察,须审慎思量。司法院此波刑事诉讼程序之改革重点似亦未提及此部分,但为将美国起诉状一本之刑事诉讼程序做一较完整之介绍,故亦将其陪审团制度做一概述,谨供参考。 7、​ 上诉(appeal): 美国刑事诉讼制度既然实行「起诉状一本」,所有证据、证人都在地方法院事实审理时提示、诘问过,纵然被告不服陪审团对其认定有罪之判决27而决定上诉,但上诉法院就不再审酌新证据或传唤证人,亦即上诉法院不审理事实,只决定法律争议。故上诉法院之审理要提上诉理由之书状,不一定有言词辩论的机会。而且上诉法院仅就原事实审之判决本身是否有理由撤销,以及原判决量刑刑度是否符合法律规定做审理。基本上亦只有法律上的错误严重影响到判决结果,上诉审法官才可能撤销原判决;如果虽有法律上错误但可以合理地认为系无害于判决结果的,该判决就不致被撤销28。但量刑判决就不同,如果法官已就法定刑度范围内审慎考虑过,则上诉法院基本上都会维持;惟法官在量刑上若不符合法律规定,上诉法院就会退回原法院重新为量刑判决。 结语: The Indictment and the Information (a) When Used. (1) Felony. An offense (other than criminal contempt) must be prosecuted by an indictment if it is punishable: (A) by death; or (B) by imprisonment for more than one year. (2) Misdemeanor. An offense punishable by imprisonment for one year or less may be prosecuted in accordance with Rule 58(b)(1). (b) Waiving Indictment. An offense punishable by imprisonment for more than one year may be prosecuted by information if the defendant -- in open court and after being advised of the nature of the charge and of the defendant's rights -- waives prosecution by indictment. (c) Nature and Contents. (1) In General. The indictment or information must be a plain, concise, and definite written statement of the essential facts constituting the offense charged and must be signed by an attorney for the government. It need not contain a formal introduction or conclusion. A count may incorporate by reference an allegation made in another count. A count may allege that the means by which the defendant committed the offense are unknown or that the defendant committed it by one or more specified means. For each count, the indictment or information must give the official or customary citation of the statute, rule, regulation, or other provision of law that the defendant is alleged to have violated. For purposes of an indictment referred to in section 3282 of title 18, United States Code, for which the identity of the defendant is unknown, it shall be sufficient for the indictment to describe the defendant as an individual whose name is unknown, but who has a particular DNA profile, as that term is defined in section 3282. (2) Criminal Forfeiture. No judgment of forfeiture may be entered in a criminal proceeding unless the indictment or the information provides notice that the defendant has an interest in property that is subject to forfeiture in accordance with the applicable statute. (3) Citation Error. Unless the defendant was misled and thereby prejudiced, neither an error in a citation nor a citation's omission is a ground to dismiss the indictment or information or to reverse a conviction. (d) Surplusage. Upon the defendant's motion, the court may strike surplusage from the indictment or information. (e) Amending an Information. Unless an additional or different offense is charged or a substantial right of the defendant is prejudiced, the court may permit an information to be amended at any time before the verdict or finding. (f) Bill of Particulars. The court may direct the government to file a bill of particulars. The defendant may move for a bill of particulars before or within 10 days after arraignment or at a later time if the court permits. The government may amend a bill of particulars subject to such conditions as justice requires. (As amended Feb. 28, 1966, eff. July 1, 1966; Apr. 24, 1972, eff. Oct. 1, 1972; Apr. 30, 1979, eff. Aug. 1, 1979; Mar. 9, 1987, eff. Aug. 1, 1987; Apr. 17, 2000, eff. Dec. 1, 2000; Apr. 29, 2002, eff. Dec. 1, 2002.) 附件二: Rule 16. Discovery and Inspection (a) Government's Disclosure. (1) Information Subject to Disclosure. (A) Defendant's Oral Statement. Upon a defendant's request, the government must disclose to the defendant the substance of any relevant oral statement made by the defendant, before or after arrest, in response to interrogation by a person the defendant knew was a government agent if the government intends to use the statement at trial. (B) Defendant's Written or Recorded Statement. Upon a defendant's request, the government must disclose to the defendant, and make available for inspection, copying, or photographing, all of the following: (i) any relevant written or recorded statement by the defendant if: ​ the statement is within the government's possession, custody, or control; and ​ the attorney for the government knows -- or through due diligence could know -- that the statement exists; (ii) the portion of any written record containing the substance of any relevant oral statement made before or after arrest if the defendant made the statement in response to interrogation by a person the defendant knew was a government agent; and (iii) the defendant's recorded testimony before a grand jury relating to the charged offense. (C) Organizational Defendant. Upon a defendant's request, if the defendant is an organization, the government must disclose to the defendant any statement described in Rule 16(a)(1)(A) and (B) if the government contends that the person making the statement: (i) was legally able to bind the defendant regarding the subject of the statement because of that person's position as the defendant's director, officer, employee, or agent; or (ii) was personally involved in the alleged conduct constituting the offense and was legally able to bind the defendant regarding that conduct because of that person's position as the defendant's director, officer, employee, or agent. (D) Defendant's Prior Record. Upon a defendant's request, the government must furnish the defendant with a copy of the defendant's prior criminal record that is within the government's possession, custody, or control if the attorney for the government knows -- or through due diligence could know -- that the record exists. (E) Documents and Objects. Upon a defendant's request, the government must permit the defendant to inspect and to copy or photograph books, papers, documents, data, photographs, tangible objects, buildings or places, or copies or portions of any of these items, if the item is within the government's possession, custody, or control and: (i) the item is material to preparing the defense; (ii) the government intends to use the item in its case-in-chief at trial; or (iii) the item was obtained from or belongs to the defendant. (F) Reports of Examinations and Tests. Upon a defendant's request, the government must permit a defendant to inspect and to copy or photograph the results or reports of any physical or mental examination and of any scientific test or experiment if: (i) the item is within the government's possession, custody, or control; (ii) the attorney for the government knows -- or through due diligence could know -- that the item exists; and (iii) the item is material to preparing the defense or the government intends to use the item in its case-inchief at trial. (G) Expert Witnesses. At the defendant's request, the government must give to the defendant a written summary of any testimony that the government intends to use under Rules 702, 703, or 705 of the Federal Rules of Evidence during its case-in-chief at trial. If the government requests discovery under subdivision (b)(1)(C)(ii) and the defendant complies, the government must, at the defendant's request, give to the defendant a written summary of testimony that the government intends to use under Rules 702, 703, or 705 of the Federal Rules of Evidence as evidence at trial on the issue of the defendant's mental condition. The summary provided under this subparagraph must describe the witness's opinions, the bases and reasons for those opinions, and the witness's qualifications. (2) Information Not Subject to Disclosure. Except as Rule 16(a)(1) provides otherwise, this rule does not authorize the discovery or inspection of reports, memoranda, or other internal government documents made by an attorney for the government or other government agent in connection with investigating or prosecuting the case. Nor does this rule authorize the discovery or inspection of statements made by prospective government witnesses except as provided in 18 U.S.C. § 3500. (3) Grand Jury Transcripts. This rule does not apply to the discovery or inspection of a grand jury's recorded proceedings, except as provided in Rules 6, 12(h), 16(a)(1), and 26.2. (b) Defendant's Disclosure. (1) Information Subject to Disclosure. (A) Documents and Objects. If a defendant requests disclosure under Rule 16(a)(1)(E) and the government complies, then the defendant must permit the government, upon request, to inspect and to copy or photograph books, papers, documents, data, photographs, tangible objects, buildings or places, or copies or portions of any of these items if: (i) the item is within the defendant's possession, custody, or control; and (ii) the defendant intends to use the item in the defendant's case-in-chief at trial. (B) Reports of Examinations and Tests. If a defendant requests disclosure under Rule 16(a)(1)(F) and the government complies, the defendant must permit the government, upon request, to inspect and to copy or photograph the results or reports of any physical or mental examination and of any scientific test or experiment if: (i) the item is within the defendant's possession, custody, or control; and (ii) the defendant intends to use the item in the defendant's case-in-chief at trial, or intends to call the witness who prepared the report and the report relates to the witness's testimony. (C) Expert Witnesses. The defendant must, at the government's request, give to the government a written summary of any testimony that the defendant intends to use under Rules 702, 703, or 705 of the Federal Rules of Evidence as evidence at trial, if -- (i) the defendant requests disclosure under subdivision (a)(1)(G) and the government complies; or (ii) the defendant has given notice under Rule 12.2(b) of an intent to present expert testimony on the defendant's mental condition. This summary must describe the witness's opinions, the bases and reasons for those opinions, and the witness's qualifications[.] (2) Information Not Subject to Disclosure. Except for scientific or medical reports, Rule 16(b)(1) does not authorize discovery or inspection of: (A) reports, memoranda, or other documents made by the defendant, or the defendant's attorney or agent, during the case's investigation or defense; or (B) a statement made to the defendant, or the defendant's attorney or agent, by: (i) the defendant; (ii) a government or
